Abstract

Indonesia menjadi negara favorit untuk orang asing berinvestasi. Oleh karena itu, indonesia memiliki kebijakan keimigrasian berupa izin tinggal keimigrasian yang diatur pada UU Nomor 6 Tahun 2011 Tentang Keimigrasian, PP Nomor 31 Tahun 2013 Tentang Pelaksanaan UU Nomor 6 Tahun 2011 Tentang Keimigrasian, PP Nomor 26 Tahun 2016 mengenai perubahan kedua dari PP Nomor 31 Tahun 2013, dan PERMENKUMHAM Nomor 27 Tahun 2014 mengenai prosedur permohonan izin tinggal keimigrasian termasuk Izin Tinggal Kunjungan. seiring berjalannya waktu di masa pandemi covid-19, pemerintah indonesia mengeluarkan PP Nomor 48 Tahun 2021, yaitu perubahan ketiga dari PP Nomor 31 Tahun 2013. Tetapi, didalam PP Nomor 48 Tahun 2021 mengalami ketidakselarasan terhadap ketentuan perpanjangan Izin Tinggal Kunjungan. Rumusan masalah yang didapat adalah apa yang alasan pemerintah mengeluarkan PP Nomor 48 Tahun 2021 dan bagaimana letak ketidakharmonisasi hukum dalam PP Nomor 48 Tahun 2021 mengenai ketentuan perpanjangan Izin Tinggal Kunjungan. metode penelitian yang digunakan berupa penelitian hukum normatif dengan pendekatan statute approach. Hasil penelitian adalah pemerintah mengeluarkan PP Nomor 48 Tahun 2021 untuk pemulihan perekonomian nasional melalui reformasi regulasi untuk mempermudah orang asing berinvestasi di indonesia; selanjutnya letak ketidakharmonisasian hukum dalam PP Nomor 48 Tahun 2021 mengenai ketentuan perpanjangan izin tinggal kunjungan berada pada bagian ketentuan perpanjangan izin tinggal dari visa single trip, multiple trip, dan VOA dengan aturan sederajatnya seperti PP Nomor 31 Tahun 2013 dan PP Nomor 26 Tahun 2016 serta aturan khususnya yaitu PERMENKUMHAM Nomor 27 Tahun 2014.

Abstract

Immigration is an agency that oversees and acts against foreigners, in addition to that immigration also has a big impact on Indonesia. One of the actions taken by immigration is deportation. Deportation is the attitude of the immigration authorities for foreigners who are suspected or should be suspected of endangering the environment and disturbing public order. Based on the above statement, it can be concluded the formulation of the problem namely how international law views immigration acts, namely deportation. The research method for compiling this journal is the normative-empirical method. Indonesian immigration authorities must urge foreign citizens to comply with the provisions in force in Indonesia so that no party is harmed by the public at large.

Abstract

Indonesia is one of the countries that has not ratified the 1951 Convention on refugees but that does not prohibit refugees from coming and getting protection in Indonesia because based on the prevailing constitution, Indonesia has the responsibility to handle refugees and carry out immigration control over them. With the existence of Government Regulation Number 125 of 2016 concerning Handling of Refugees from Abroad, immigration plays a role in collecting data, placing, monitoring, and returning refugees to their home countries or third countries. Supervision is an important action taken in dealing with refugees while in Indonesia. Refugees who have received approval from UNHCR and have special needs will be placed in the Community House. The formulation of the problem in this study is how to implement immigration control for refugees in the Jakarta Community House and what obstacles are found in conducting surveillance. The purpose of this research is to find out how the implementation of immigration control carried out on refugees in Community House Jakarta. The research method used is normative empiris, using primary and secondary data, studying and evaluating phenomena about refugees and legal norms related to refugees and immigration control obtained from literature and law, then analyzed to get conclusions. So it can be explained that the implementation of immigration control of refugees at the Jakarta Community House is carried out by means of attendance and data collection on refugee identification cards and stamps and signatures of Jakarta Rudenim officers. The obstacle to monitoring at the Community House is that there is still conflict between the refugees and the refugee's poor health condition.

Abstract

The era of Globalization has a possibility for us as a human an easy way and flexibility almost in every kind of sections. It is also made things easier for us in benefit of technology advance in every sections. After that, one of our convenience is that we could stay or live in another country. When it comes to live in another country we as a foreigner is far from reach of our homeland, in other words we’re not under our homeland protection no more. Therefore, there’s Embassy as a representation of a foreign country in another nation. Besides, Embassy also needs an expert on every sections. Because of that, it is need an officials that have an expert on specific sections that called Embassy Attaché. One of those sections that has an officials or Embassy Attaché is Immigration’s section. Immigration section’s Attaché had a spesifical task and function simply and solely is on Immigration things such a passport services, self reporting, also Official Passports renewal.

Abstract

Deportation is an act of expelling foreigners who violate the law in order to maintain the sovereignty of the country. however, article 85 of Law Number 6 of 2011 concerning Immigration is not regulated regarding the period of deportation. This is by the National Legal Development Agency of the Ministry of Law and Human Rights of the Republic of Indonesia in the Final Report on the Evaluation of Immigration Law in 2020. The formulation of the problem of this study is how the legal consequences are on the absence of provisions governing the period of deportation. The research method used is a qualitative-normative metde with a conceptual approach. The results of this study are due to the law, namely the occurrence of overcapacity, there are detainees who have served more than 10 years of detention, and the occurrence of conflicts of detention with officers and between detainees. The advice that can be given is to immediately make provisions for the period of implementation of deportation.

Abstract

Refugees and asylum seekers are often the topic of problems between the receiving State and the United Nations High Commissioner for Refugees (UNHCR) as a mandate from the United Nations (UN) to protect refugees and help refugees find solutions to their situation. In order to minimize the impact of the existence of foreigners as illegal immigrants who later declare themselves as asylum seekers and refugees, it is necessary to have arrangements that provide equality and uniformity of direction in immigration handling and treatment. The implementing provisions of these regulations are derived from the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number M.05.IL.02.01 of 2006 concerning Rudenim which regulates temporary shelters for foreigners who violate applicable laws and regulations, especially in the field of immigration. For example, the protection status of Rohingya refugees in Indonesia. This research uses a statutory approach, a conceptual approach, and a case approach.
