Abstract

Abstract UUD NRI 1945 mandates the government to protect the rights of every citizen, one of which is the protection of the rights of indigenous people (adat) to inhabit the indigenous forests. The legal issues in this research is how the position of indigenous and tribal peoples in the indigenous forest inhabit and how the protection of the constitutional rights of indigenous forest communities by the government. This study uses normative juridical approach made to the things that are theoretical principles of law. Based on this research, it is known that the position of indigenous and tribal peoples as subjects of law and customary rights to the forest owner. While legal protection by the government in the form of guaranteeing legal certainty of tenure of indigenous forest by indigenous and tribal peoples is to produce local law as a form of protection and recognition of indigenous peoples. Keywords : Forests; Governments; Indigenous And Tribal Peoples (adat); Abstrak UUD NRI 1945 mengamanatkan pemerintah untuk melindungi hak setiap warga negara, salah satunya adalah perlindungan terhadap hak masyarakat hukum adat dalam mendiami hutan adat. Isu hukum dalam penelitian ini adalah bagaimana kedudukan masyarakat hukum adat dalam mendiami hutan adat dan bagaimana perlindungan terhadap hak konstitusional masyarakat hutan adat oleh pemerintah. Penelitian ini menggunakan pendekatan yuridis normative yang dilakukan terhadap hal-hal yang bersifat teoritis asas-asas hukum. Berdasarkan hasil penelitian, dapat diketahui bahwa kedudukan masyarakat hukum adat sebagai subjek hukum dan pemilik hak atas hutan adat. Sedangkan perlindungan hukum yang dilakukan oleh pemerintah berupa penjaminan kepastian hukum atas penguasaan hutan adat oleh masyarakat hukum adat adalah dengan menghasilkan produk hukum daerah sebagai wujud perlindungan dan pengakuan masyarakat hukum adat. Abstract

Indonesia is one of the world's megabiodiversity countries, with a high level of biodiversity, including various endemic plant species that play a crucial role in ecosystems. However, uncontrolled mining exploration poses a serious threat to biodiversity conservation, particularly for plant species that lack legal protection. Exploration activities can lead to habitat degradation, landscape changes, and disruption of pre-mining ecosystems. Normatively, Indonesian regulations govern environmental protection in the mining sector, yet they do not explicitly require holders of Exploration Mining Business Licenses (IUP Exploration) to conduct conservation efforts for affected plant species. Consequently, there is no adequate mitigation mechanism at the exploration stage. This study employs a normative juridical method with a literature study approach to analyze existing regulations and identify legal gaps related to plant conservation in pre-mining areas. The findings indicate the need for more comprehensive policies, including the implementation of ex-situ conservation and vegetation mapping prior to exploration. Strengthening regulations and strict supervision are strategic steps to maintain ecosystem balance and support sustainable mining practices.
