Abstract

Fiqh is the discipline that is most affected by the changes in human life that come incessantly. Fiqh is intended to harmonize between the syar'i texts that have completed their revelations and are standardized in the Qur'an and assunaah with humans as objects of jurisprudence that never stop changing. So fiqh is the most extensive space for new ijitihad-ijitihad. Islamic jurisprudence and law will always adjust to socio-cultural conditions, and socio-historical and space that surrounds it, as well as in Indonesia, fiqh is used as a means in determining the direction of religious life of the Islamic community in Indonesia, the basic attitude of this Islamic tradition seems to have become the dominant choice and grip among fiqh experts in Indonesia. The dynamics of Indonesian jurisprudence in the Syafiiyah discourse, this can be understood because the process of Islamization in Indonesia since the 12th and 13th centuries was a time when the development of Islamic law was in a time of crisis by closing the door of ijtihad as its lowest point even in the next period many figures who sued this matter, the experts did not dare to think as freely and creatively as possible so as to bring up a product that is timeless, space and time. Departing from the conceptul, the steps taken for Indonesian fiqh are: First, critical dialectics among Islamic law (particular texts containing practical rules), illat (causal law of wisdom) legal significance) Annadhoriyyah al ammah (azaz -azaz law) maqosidu syariah (the basic purpose of sharia) this analysis is one step that is normative deductive. Second, what is needed in analyzing these legal issues is an empirical-inductive step, which is analyzing problems related to reality, views, and practices in the community, in this case Urf Indonesia, through actual inductive field research. Having raised the offer of methodologies that are deductive and empirical-inductive normative and then make jurisprudence in Indonesia as living a living tradition that seems to be a breakthrough that makes Islamic law more lively so that sociologically and politically it will be easily proposed as legislation in Indonesia.

Abstract

Krisis lingkungan global menjadi persoalan serius. Bumi terancam tidak ada satu bangsa/negara manapun yang luput dari dampak krisis. Kerusakan lingkungan menjadi salah satu isu global yang meresahkan masyarakat dunia. kerusakan naturalis alam dapat disebabkan oleh dua faktor yaitu akibat peristiwa alam dan akibat ulah manusia. Padahal dalam konteks krisis lingkungan saat ini, fikih Ekologi menjadi sangat urgen. Melalui fikih Ekologi, perlu ditanamkan kepada masyarakat sebuah keyakinan bahwa mencemari sungai, laut, menebang hutan sembarangan dan membunuh hewan terlindungi merupakan dosa besar yang harus ditanggung. Relasi Tuhan-manusia-alam ini selanjutnya akan menjadi basis ontologis-teologis bagi pengembangan paradigma fiqh al-bî`ah, dan selanjutnya fiqh al-bî`ah dibangun atas dasar hubungan komplementer antara manusia dan alamdi mana tidak ada pihak yang saling mendominasi satu atas yang lain. Melalui maqoshid syari’ah gagasan dari para ulama’ ini diharapkan menjadi dasar ikhtiyar pelestarian lingkungan.

Abstract

Artikel ini akan membahas hubungan maqâṣid asy-syarî’ah dengan berbagai dalil fiqih, baik yang disepakati maupun yang diperselisihkan. Syari’ah mempunyai spirit mencari maṣlaḣat dan menghindari mafsadat. Teks-teks suci keagamaan (Al-Qur`an dan Sunnah) tidak selalu memberi jawaban yang terperinci dan konkrit atas kemaslahatan, tetapi dalil-dalil utama tersebut menjadi standar pasti terhadap eksistensi maṣlahat, dan senantiasa terbuka lebar ruang untuk berijtihad dan beristinbâṭ. Konsep maqâsid secara terus-menerus mengalami proses transformasi konseptual mulai dari nilai hingga pendekatan. Sebagai nilai, maqâṣid syarî’ah adalah bagian integral dalam kajian maṣlaḥah mursalah, istiḣsân dan qiyās dalam kajian usul fikih. Maqâṣid mempunyai hubungan yang erat bagaikan Asal dan Cabangnya jika dihubungkan dengan al-Qur’an dan al-Hadits. Ketika Maqâṣid disandingkan Dalil seperti, al-Ijmâ’, al-Qiyâs, al-maṣlaḣah al-Mursalah, Istihsân dan Sadd aż-Żara`i’, maka Maqâṣid merupakan spirit yang dijadikan dasar dalam menerapkan dan mengaplikasikan 5 metode ijtihad tersebut. Abstract

The rapid digital transformation in the disruptive era has profoundly affected students’ mental health and behavior, leading to increased emotional instability and juvenile delinquency among the so-called “Strawberry Generation.” This study is significant as it bridges the gap between modern technological approaches and Islamic spiritual guidance in student counseling. The research aims to develop a hybrid Islamic counseling model integrating artificial intelligence (AI) for early detection of psychological distress and Islamic values as spiritual interventions. Using a qualitative case study design at IBN Tegal, data were collected through in-depth interviews, participatory observation, and focus group discussions involving 15 students and three counselors. The findings reveal that the AI-assisted chatbot effectively identifies stress symptoms and provides Qur’anic verse recommendations, resulting in improved emotional control for 87% of participants. This hybrid model demonstrates that the synergy of AI technology and Islamic education fosters adaptive, responsive, and spiritually grounded mental health support for students. Abstract

In the realm of Islamic education, increasing motivation and learning outcomes in Jurisprudence requires the application of innovative learning models that suit the characteristics of the material and student needs. This research aims to examine the influence of the CORE-PL (Connecting, Organizing, Reflecting, Extending - Project Learning) learning model on motivation and learning outcomes in Jurisprudence, as well as identifying its influence with learning independence as a control variable. This research uses a quasi-experimental design carried out at MAN 1 Tegal. The sampling technique was carried out through random assignment involving 69 class XI students, divided into experimental and control classes. Data was collected through tests (learning outcomes), questionnaires (learning motivation and learning independence), and analyzed using simple Analysis of Variance (ANOVA) and Analysis of Covariance (ANCOVA). The research results show that the CORE-PL model has a significant influence on increasing student motivation and learning outcomes. In addition, when learning independence is used as a control variable, the influence of the CORE-PL model becomes stronger, which has implications for a significant increase in motivation and learning outcomes in Jurisprudence. This study contributes to the development of relevant active learning methods in the field of Jurisprudence education, and emphasizes the importance of student learning independence in supporting the effectiveness of the CORE-PL model. This conclusion confirms that the use of the CORE-PL learning model can be an effective solution for improving the quality of the learning process and Fiqh learning outcomes in madrasah.
