Abstract

This study examines the implementation of supervision of Behavior Deviation and Misuse of Information for Banks by the Makassar Regional Financial Services Authority 6. Field research is the type of research that is used as a further effort to explore a problem that is presented in a qualitative descriptive form. The results of the study indicate that the implementation of supervision of the behavior of misuse and misuse of information for Banking conducted by the Regional 6 Financial Services Authority (OJK) in Makassar has been carried out. Especially for banks to apply the standard clause contained in the standard agreement in accordance with the guidelines of the Financial Services Authority (OJK). Especially for the government to revise the rules of the Financial Services Authority in the implementation of supervision so that supervision is carried out by only one part, which is carried out by the Consumer Education and Protection (EPK) section or supervision carried out by the Risk Monitoring department so that there is no supervision dualism. Penelitian ini mengkaji Implementasi pengawasan Perilaku Penyimpangan dan Penyalahgunaan Informasi Bagi Perbankan Oleh Otoritas Jasa Keuangan Regional 6 Makassar. Penelitian lapangan menjadi tipe penelitian yang digunakan sebagai upaya lebih jauh untuk mendalami sebuah masalah yang disajikan dalam bentuk deskriptif kualitatif. Hasil penelitian menunjukkan bahwa implementasi pengawasan perilaku penyimpangan dan penyalahgunaan informasi bagi Perbankan yang Dilakukan oleh Otoritas Jasa keuangan (OJK) Regional 6 Di Makassar sudah terlaksana. Khusus kepada Perbankan untuk menerapkan klausula baku yang terdapat pada perjanjian baku sesuai dengan pedoman dari Otoritas Jasa Keuangan (OJK). Khusus pemerintah untuk melakukan revisi terhadap aturan Otoritas Jasa Keuangan dalam hal pelaksanaan pengawasan sehingga pengawasan tersebut dilaksanakan oleh satu bagian saja yaitu dilaksanakan oleh bagian Edukasi dan Perlindungan Konsumen (EPK) atau pengawasan dilaksanakan oleh bagian Pengawasan terhadap Resiko sehingga tidak ada dualisme pengawasan.

Abstract

The covenant is one of the most common legal relationships in the community. The Covenant under Article 1313 of the Civil Code is an act by which a person or more binds himself to one or more persons. Unconsciously, oral agreements are often done in social life and often the parties who make the oral agreement deny the existence of the agreement. This research is descriptive normative juridical research. This study uses primary legal material sources consisting of laws and regulations bound by research. Sources of secondary legal materials in the form of materials or related materials and explain the problem, and the source of tertiary legal materials are materials that provide information about primary legal materials and secondary legal materials related to the research. Against the form of the exercise of the agreement in the oral form declared unilaterally by the party that offers the agreement inevitably the interested party in this case the second party is pressed with the interest of agreeing the contents of the agreement. Not to mention the possibilities that occur in the future that is wanprestasi with large losses so that the court to face, and what if the party who did the default is negligent, broken promise, do not acknowledge or deny having oral agreement Based on the background and problems that have been described above so it is necessary to examine the extent to which the legal protection of oral agreements, if one of the parties making the alleged infringement of the oral agreement is associated with the Law of Contract and the Consumer Protection Number Act. Based on this research it is concluded that the oral agreement is legal and has the legal power to declare a person to default, but if the oral agreement is denied / not recognized by the alleged defendant, the oral agreement has no legal power to declare a person to default, can be true and may not exist, depending on the proof of the parties. but verbal agreements that have been denied / unrecognized may regain their legal power if it can be proven that the oral agreement actually exists or has been made.Based on Law No. 8 Consumer Protection Consumer law is defined as the whole legal principles and rules governing relationships and problems between various parties or each other in relation to goods and / or services within the association of life. Based on Article 163 HIR and Article 1865 of the Civil Code, any party that argues for a right, then the party must prove it. So if the consumer demands his right to the business actor that harms him, then the consumer must prove. However, in Law Number 8 Year 1999 concerning Consumer Protection Article 22 and Article 28, the evidentiary obligation is "reversed" (reversed proof) to be the full responsibility and responsibility of the business actor. So the provisions on responsibility and redress in the Consumer Protection Act are lex specialists against the general provisions contained in the Civil Code.

Abstract

The formulation of this research problem is how the responsibility of the drop shipper in E-Commerce transactions in terms of Law Number 8 of 1999 concerning consumer protection and legal relations between parties in E-Commerce transactions by way of dropshipping. This study aims to determine and analyze the responsibility of the drop shipper in e-commerce transactions and legal relations between parties in e-commerce transactions by means of dropshipping. This thesis research uses a type of normative legal research, which is based on statutory regulations that use primary legal materials that have binding power as the main basis for this research, including the Civil Code and other related regulations. Secondary materials, namely materials that are closely related to primary legal materials and help analyze and understand primary legal materials, such as the results of previous research related to the Law of Consumer Protection. The results of this study indicate that the responsibility of the drop shipper as a business actor bears full responsibility for all legal consequences of the agreement. Then related to the legal relationship between the dropshipper and the consumer, it is a legal relationship between the seller and the buyer which creates rights and obligations between the two of them and leads to the legal consequences that occur. Abstrak:Rumusan masalah penelitian ini bagaimanakah tanggung jawab dropshipper dalam transaksi E-Commerce ditinjau dari Undang-undang Nomor 8 Tahun 1999 tentang perlindungan konsumen dan hubungan hukum antara pihak dalam transaksi E-Commerce dengan cara dropship. Penelitian ini bertujuan untuk mengetahui dan menganalisis Tanggung Jawab Dropshipper dalam Transaksi E Commerce dan Hubungan Hukum antara pihak dalam transaksi e-commerce dengan cara dropship. Penelitian skripsi ini menggunakan tipe penelitian hukum normatif, yang disandarkan pada peraturan Perundang-undangan yang menggunakan bahan hukum primer yang mempunyai kekuatan mengikat sebagai landasan utama dalam penelitian ini, diantaranya KUHPerdata dan peraturan terkait lainnya. Bahan sekunder, yaitu bahan-bahan yang erat hubungannya dengan bahan hukum primer dan membantu menganilisis dan memahami bahan hukum primer, seperti hasil penelitian sebelumnya yang berkaitan dengan Hukum Perlindungan Konsumen. Hasil penelitian ini menunjukkan bahwa Tanggung Jawab Dropshipper sebagai pelaku usaha memikul tanggung jawab secara penuh, terhadap segala akibat hukum dari perjanjian. Kemudian terkait Hubungan hukum antara Dropshipper dan konsumen merupakan hubungan hukum antara penjual dan pembeli yang menimbulkan hak dan kewajiban antara keduanya serta bermuara pada adanya akibat hukum yang terjadi.

Abstract

Abstract: This study aims to determine and analyze ways of collecting debt and the factors that affect debt collection at Pegadaian. This study uses the Normative-Empirical research method which in this case combines elements of normative law which are then supported by the addition of data or empirical elements. The results of this study indicate that customers who are unable to pay off their debts at maturity will be auctioned off their pawns as mentioned in Article 1155 of the Civil Code. The factors that affect debt collection at Pegadaian are due to obstacles in the implementation of debt collection, namely the lack of awareness of customers who neglect to pay their debts. Researchers provide recommendations to other prospective researchers to conduct more in- depth research on the issues raised in this thesis. Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis cara-cara penagihan utang dan faktor yang mempengaruhi penagihan utang di Pegadaian. Penelitian ini menggunakan metode penelitian Normatif- Empiris yang dalam hal ini menggabungkan unsur hukum normatif yang kemudian didukung dengan penambahan data atau unsur empiris. Hasil Penelitian ini menunjukkan bahwa nasabah yang tidak mampu melunasi utangnya pada saat jatuh tempo akan dilakukan pelelangan terhadap barang gadainya sebagaimana yang disebutkan di dalam Pasal 1155 KUH Perdata. Adapun faktor yang mempengaruhi penagihan utang di Pegadaian adalah karena adanya kendala dalam pelaksanaan penagihan utang yaitu faktor kurangnya kesadaran nasabah yang lalai untuk membayar utangnya. Peneliti memberikan rekomendasi kepada calon peneliti-peneliti lain untuk melakukan penelitian lebih mendalam tentang masalah yang diangkat pada skripsi ini.
