Abstract

Pertambangan adalah sebagian atau seluruh tahapan dalam rangka penelitian, pengelolaan dan pengusahaan mineral atau batubara yang meliputi penyelidikan umum, eksplorasi, studi kelayakan, konstruksi, penambangan, pengolahan dan pemurnian, pengangkutan dan penjualan serta kegiatan pasca pertambangan. Pertambangan di Kabupaten Malang dibagi atas pertambangan mineral logam, mineral non logam dan mineral batuan. Tujuan penelitian untuk mengetahui dan menganalisis hambatan implementasi dan upaya mengatasi hambatan implementasi Perda Kabupaten Malang Nomor 2 tahun 2012 terkait dengan pengawasan oleh dinas terkait. Metode yang digunakan dalam penelitian ini adalah yuridis empiris dengan pendekatan yuridis sosiologis melihat pengawasan yang dilakukan oleh dinas terkait seperti Dinas ESDM, BP2T, Bappeda, BLH, DPPKA, BPN, Bagian Hukum dan Satpol PP Linmas Kabupaten Malang. Hasil penelitian menunjukkan bahwa setelah keluarnya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, urusan di bidang pertambangan menjadi kewenangan Pemerintah Pusat dan Pemerintah Provinsi. Undang-Undang Pemerintahan Daerah baru telah menimbulkan hambatan dalam implementasi Perda Kabupaten Malang Nomor 2 Tahun 2012 termasuk dalam hal pengawasan dikarenakan tidak diatur secara spesifik dinas/badan/bagian mana yang seharusnya melakukan pengawasan di bidang pertambangan.Keyword: pertambangan, pertambangan mineral, Peraturan Daerah Kabupaten Malang Nomor 2 Tahun 2012, pengawasan.

Abstract

This study aims to examine how law enforcement against illegal fishing and overfishing in the Indonesian ocean region is carried out by "Foreign Countries" such as Malaysia, Vietnam and other countries. We know that marine resources, in this case fisheries in Indonesia, are one form of the country's "defense" aspects. Indonesia's Exclusive Economic Zone or called ZEEI in the North Natuna Sea is an area that is often the case. For example, Indonesia there will be arrests of Vietnamese – flagged fishing vessels in early 2023 and until November 2018 the Indonesian Government had handled 134 illegal fishing cases and 41 of them had permanent legal force. Illegal fishing itself is often associated with large-scale fishing or overfishing thatresults in damage to the underwater ecosystem. Underwater ecosystems will become extinct if illegal fishing and overfishing cases are not seriously handled by the Government and Law Enforcement Officials. Foreign ships of illegal fishing and overfishing can be sanctioned in the form of violations of Law Number 31 of 2004 concerning Fisheries as amended by Law Number 45 of 2009 with the threat of a maximum prison sentence of 6 years and a maximum of Rp 20 billion rupiah. Also in the 1945 Constitution of the Republic of Indonesia mandates in article 27 paragraph (3) and article 30 paragraph (1) that state defense and security are the rights and obligations of each citizen to participate in the national defense and security effort and defending the country. Abstract

This research aims to see how the concept of utilitarianism is applied in Indonesia. The application of the theory of utilitarianism will be studied more deeply in terms of law enforcement in society. Of course, through this method it can be seen that utilities that are useful and benefit the whole community will have more value than a legal decision that only benefits each party. One figure, Jeremy Bentham, said that the aim of law must fulfill three aspects, namely Justice, Certainty and Benefit. Therefore, legal objectives must be met so that the regulations or legal products formed by law bearers are expected to fulfill these three aspects perfectly. However, the truth of these three aspects as the objectives of creating a legal product that must exist, must be examined more deeply, whether it is true that the law has perfectly created justice, has certainty, and must provide benefits to society. The data collection method was carried out by studying literacy and statutory regulations and conducting qualitative descriptive data analysis.

Abstract

This research aims to examine how financial policy is analyzed in DKI Jakarta, which incidentally was the State Capital (IKN) of Indonesia when it was no longer an IKN. IKN's move to Nusantara certainly has various impacts on the people of Jakarta. Both on the social, cultural and economic sides. The economic side will certainly experience quite significant changes. Status as an IKN certainly provides added value to Jakarta. When IKN status has moved to Nusantara, economic policies will definitely follow in the areas that become IKN. In this research, we will examine financial policies for Jakarta, with a developed region, capable infrastructure, of course economic policies will be different compared to other regions even though they no longer have IKN status. The data collection method was carried out by studying literacy and statutory regulations and conducting qualitative descriptive data analysis to find out how the financial policy analysis of DKI Jakarta was carried out after the transfer of IKN to East Kalimantan.

Abstract

This research aims to examine how the Papuan conflict from the perspective of emergency constitutional law. The perspective of emergency constitutional law in this study discusses more about the development of the Papuan case from time to time. We all know that the conflict in Papua has yet to be resolved. The role of the TNI and Police in maintaining defense and security in Papua makes its own attention not only in the national arena but also in the international arena. The method of data collection is carried out by means of literacy studies and laws and regulations and conducting qualitative descriptive data analysis to find out how the Papuan conflict from the perspective of emergency constitutional law. Both internal and external threats due to the desire of the Papuan people to separate themselves from Indonesia.

Abstract

This study aims to examine how the relevance or legal relationship between the National Resource Management Law and the Indonesian National Army Law. The relationship referred to here wants to examine the aspects of military law and military institutions. We know that after the issuance of the PSDN Law on October 24, 2019 there are several things regulated in it that are closely related to the TNI Law. Especially when talking about the human resources in it (for example the reserve component - komcad). The data collection method is carried out by studying literacy and laws and regulations and conducting qualitative descriptive data analysis to find out how the relationship between the PSDN Law and the TNI Law, especially for the management of human resources - komcad.

Abstract

This study aims to examine the review of military law for cases of desertion committed by TNI members in the unit. Military law review in criminal cases at Ajendam XVIII/Kasuari in 2018 committed by one of its members. We know that as stipulated in the TNI Law, every member of the TNI has an obligation to submit to official matters. When not complying with these regulations, there will be legal consequences for this. The method of data collection is carried out by means of literacy studies and laws and regulations and conducting qualitative descriptive data analysis to find out how the legal review of criminal cases of desertion of TNI members in a case study at Ajendam XVIII / Kasuari.

Abstract

The relocation of the national capital from Jakarta to East Kalimantan has changed many sectors. Both in the government sector, social sector, and economic sector. This is done as a form of equalization of various sectors which have only been centered in the Java Island region. The equalization to the eastern region of Indonesia allows sustainable development to be carried out to the eastern region of Indonesia, which has been considered underdeveloped compared to the western region of Indonesia. Law No. 3 of 2022 and Law No. 17 of 2003 will be associated with the determination of the special regional government status of the National Capital. The author wants to analyze how the implications of the special regional government status in IKN with the state financial system are certainly associated with Law (UU) Number 21 of 2023 concerning Amendments to Law Number 3 of 2022 concerning the National Capital. The normative juridical research method will be studied with a statutory approach, comparative approach and conceptual approach. The results of this study will have an impact on the relationship between the establishment of a special regional government and the state financial system that should be owned by the State Capital in the future. And can be a guideline for running good finance in eastern Indonesia.

Abstract

This research aims to examine the status of DKI Jakarta after the plan to move the National Capital to East Kalimantan. We know that before the plan to move the National Capital, the center of Indonesia, both in terms of government, economy and resources, was centered in the DKI Jakarta area. Of course, after the construction of the National Capital in East Kalimantan, precisely in the North Penajam Paser area, the center of economic government and resources will gradually be moved to the Kalimantan region. This is where the position of DKI Jakarta, which was previously the National Capital, will change status to become a province in general and will give rise to several domino effects that will follow when DKI Jakarta's status no longer becomes the National Capital of Indonesia. The data collection method was carried out by studying literacy and statutory regulations and conducting qualitative descriptive data analysis to find out what the future status of regional autonomy will be for the DKI Jakarta region after the move of the National Capital.
