Abstract

In the reality and teaching experience in SMA Negeri 1 Kerambitan, Tabanan regency, the use of discussion method can't run like as we hope. That is caused by both of the teacher who can understand or comprehend their role in the discussion. The discussion method is one of the method which is qualified by the 2013 curriculum. That is why important to improve the discission method on teaching and learning activity and to increase the student and the teachers skill in discussing, one of the effort is whit Discovery Learning. Discovery learning approach is mentioned as Discovery Guided, that is Discovery learning where the students in choosing the matter of the lesson, the kinds of data which is collected and the discussion are guided by the teachers. The aplication of this approach uses student work sheet (LKS) type B and C. The role of the teachers in the discussion are as moderator, consultant, motivator, encourager, and evaluator. All of these have purpose to increase the skill in discussion which cover communication skill, skill of presenting opinion, and can appreciate the other person's idea, has skill to make decision. Now the phase of the Actions learning which the teacher (researcher) does to reach the objective is to give the stimulation to motivate the students in studying, identifying the problems which will be solved by the students then collect the data, and has the discussion to reach the truth of the data which they got and is ended by making agreement to find one meaning in the conclusion. The data analyze which is used in this research is qualitative descriptive approach, the result of this research shows that discovery learning approach can increase the skill in discussion on both of students and teachers. This can be seen that there is incresing of the discussion skill of the students up to 75% and the teacher reach more than 85%. By the classroom Actions research the teachers can reach the teaching purpose as they expect.

Abstract

This study examines the Police Authority in Corruption Investigation Process. There are two issues that were examined. First, what is the authority of the Police in the investigation of the handling of corruption. Second, whether the factors that support and hinder the police investigation against corruption. This research was conducted using the method of empirical legal research. Thus the legal data obtained in two ways, namely primary data obtained directly in the field and secondary data obtained through library research. The following results that the Police have the authority to investigate corruption by Act 2 of 2002 on the Indonesian National Police, Law No.31 of 1999 on Eradication of Corruption, and Law No.30 of 2002 on Corruption Eradication Commission , all of them referring to the criminal Procedure Code as a basis for criminal law. Blocking is done in the process of investigation is used as an investigator and foreclosure prevention efforts can be used as a repressive efforts in saving theĀ proceeds of corruption. The factors that influence the investigation of the factorssupporting the legal factors inhibiting factor is the factor of infrastructure and lawenforcement factors.

Abstract

Article 18B paragraph (2) of the Constitution of the Republic of Indonesia provides recognition of laws that live and develop in society. One of the law enforcement officers who are given the authority to explore the values that live in the community, namely the Judge as regulated in Article 5 paragraph (1) of Law no. 48 of 2009 concerning Judicial Power. The values that live and develop in the community or better known as customary criminal law can be a way for judges to carry out restorative enforcement, so the role of judges is needed in assessing and considering the facts of case settlement outside the trial. This study aims to determine and analyze the role of judges in the enforcement of restorative justice through customary criminal law. This article is a normative legal research using a statutory and conceptual approach. The results of the study show that judges are facilitators and catalysts in the enforcement of restorative justice through customary criminal law in order to find a satisfactory solution to all parties as an effort to make peace between victims and defendants through customary criminal law that occurs outside the trial. Article 2 paragraph (2), Article 3 paragraph (2), Article 5 paragraph (1) of Law no. 48 of 2009 concerning Judicial Power and Article 5 paragraph (3b) of Law no. 1 of 1951 concerning Temporary Measures for Organizing Unitary Powers and Procedures for Civil Courts can be used as the basis for the application of customary criminal law as one of the efforts to enforce restorative justice.Judges as facilitators and catalysts in the enforcement of restorative justice through customary criminal law in order to find a satisfactory solution to all parties as an effort to make peace carried out by victims and defendants through customary criminal law that occurs outside the trial.
