Abstract

In response to the rapid development of Islamic economic, especially in Islamic banking, hence made Act number 21 Year 2008 on Islamic Banking. Thus, the Act No. 21 year 2008 is a legal framework for the implementation of Islamic Banking in Indonesia. The enactment of Law No. 21 year 2008 is certainly can not be separated from the role of the Indonesian Ulama Council who have contributed substantially in supporting and patronizing Islamic Banking. This study is a normative research with qualitative approach that resulted the role of Indonesian Ulama Council in the formulation Act No. 21 year 2008. First, the involvement of National Shariah Council (DSN - MUI) in the assessment process, deepening and refinement of the substance of the formulation of Islamic Banking. Second, the recommendation and statement issued by the MUI related to the Act Number 21 Year 2008 on Islamic Banking. The MUI’s role in the implementation of Act No. 21 year 2008 on Islamic Banking consists of two functions, i.e. regulatory functions are realized in the form of DSN - MUI fatwas related to Islamic Banking and control functions are realized in the form of DSN - MUI authority to recommend DPS in Islamic banks, give warning to non-compliant Islamic banks and propose to the authority to take action if the warning is ignored. This study recommends the need for effective coordination between the DSN - MUI with other stakeholders regarding fatwas/regulations produced to be implemented well.

Abstract

Indonesia tries to eliminate domestic violence by issuing Act Number23,2004 on domestic violence elimination. It aims at to build happy andprosperous Indonesian society particularly in small context that is family.Indonesian society consists of muslim as the majority. It influences on theway of life of the society for state law and Islamic law including family law.This paper tries to discuss family problem namely spouse’s relationship inIslamic law perspective. The focus of this discussion is spouse’s relationshipin form of domestic violence within its context of which cultural-based understanding as the factor of domestic violence.

Abstract

Tujuan dari sebuah keluarga adalah untuk mencapai sakinah, mawaddah, dan rahmah. Untuk merealisasikan tujuan tersebut terdapat beberapa upaya yang harus dilakukan. Memiliki keluarga yang sakinah adalah sebuah dambaan setiap orang. Namun dalam kenyataanya tidak semua keluarga dapat menjalankan fungsinya dengan baik, sehingga banyak terjadi konflik dan ketidakselarasan antara ayah (suami) dan ibu (istri). Konflik-konflik yang berkepanjangan seringkali berakhir pada perceraian. Dampak dari orang tua yang bercerai dirasakan oleh anak yang berstatus mahasiswa. Berdasarkan fenomena tersebut, artikel ini ditulis guna untuk mengetahui bagaimana pandangan mahasiswa broken home mengenai keluarga sakinah dan bagaimana upaya mereka dalam membangun keluarga sakinah di masa mendatang. Artikel ini ditulis menggunakan metode penelitian empiris dengan pendekatan kualitatif. Mahasiswa korban broken home UIN Malang memahami keluarga sakinah sebagai keluarga yang bahagia, rukun, damai, dan tentram, bisa mengelola dengan baik setiap permasalahan rumah tangga, keseimbangan peran, memiliki kesetiaan dan kesabaran, dapat merawat, mendidik, dan mendidik anak-anak secara bersama-sama. Upaya mahasiswa korban broken home UIN Malang dalam membangun keluarga sakinah di masa mendatang adalah belajar tentang kesabaran, membangun komunikasi yang baik, saling menyayangi dan tidak berbuat kasar, bertanggung jawab dengan kewajibannya, saling menghargai dan menghormati.

Abstract

Mentoring of society base on economics and business science have formed a group in posdaya, posdaya which became example is posdaya of As-syuro village Tlogomas Malang City. The society that developed art actually come from the Assembly of worshipers tahlil and tiba'an. They have been able to operate profesionally their tools, or in other words just do activities as a hobby and do friendship (Silaturahim) between pilgrims (jama’ah). So the common condition need the change of managerial ability. There is no handling expected can increase family income, and ultimately become superior product in Tlogomas and also can create a creative economy that also became the goal of the current Administration (President of Joko widodo). So. All condition commonly need change of managerial ability. Pendampingan masyarakat berbasis ilmu ekonomi dan bisnis yang telah membentuk kelompok dalam pos daya, maka pos daya yang yang menjadi dampingan adalah pos daya As-Syuro Kelurahan Tlogomas Kota Malang. Masyarakat yang mengembangkan kesenian ini sebenarnya bermula dari perkumpulan jamaah tahlil dan tiba’an. Mereka sudah mampu mengoperasikan secara profesioanal alat-alat pertunjukannya, atau dengan kata lain hanya melakukan kegiatan sebatas hobi dan melakukan silaturahim antar jamaah. Belum ada penanganan yang diharapkan memperoleh pendapatan yang dapat menambah pendapatan keluarga, dan pada akhirnya menjadi produk ungulan Kelurahan Tlogomas sekaligus dapat menciptakan ekonomi kreatif yang juga menjadi tujuan pemerintah sekarang (Presiden Joko widodo). Maka kondisi yang ada secara umum memerlukan pembenahan kemampuan manajerial.

Abstract

Legal protection for children is to give protection to the child so that the rights of children as perpetrators of crime narcotics more secure so that the child can live, and grow optimally in accordance with the dignity and the dignity of humanity. Form of legal protection of children as perpetrators of crime narcotics is by implement a diversion. Diversi in fact also has the goal to  keeping the child spared from negative effects of the application of the criminal. Diversion also has the essence to keep guarantee the child grow and develop both physically and mentally.Perlindungan hukum bagi anak adalah memberikan perlindungan kepada anak agar hak-hak anak sebagai pelaku tindak pidana Narkotika lebih terjamin sehingga anak bisa hidup, tumbuh dan berkembang secara optimal sesuai dengan harkat dan martabat kemanusiaan. Bentuk perlindungan hukum terhadap anak sebagai pelaku tidak pidana narkotika adalah dengan menerapkan diversi. Diversi pada hakikatnya juga mempunyai tujuan agar anak terhindar dari dampak negatif penerapan pidana. Diversi juga mempunyai esensi untuk tetap menjamin anak tumbuh dan berkembang baik secar fisik maupun mental.

Abstract

Artikel ini membahas tentang tanggung jawab seorang suami untuk mencukupi kebutuhan keluarga yang muncul akibat perkawinan yaitu nafkah. Nafkah memiliki dua kategori, pertama nafkah lahir dan yang kedua nafkah batin, sifat nafkah ada yang wajib dan sunnah. Rekreasi adalah menciptakan kembali hal yang baru dengan tujuan untuk memperoleh kenyamanan dan ketenangan. Dalam berkeluarga di era modern ini mulai muncul kebutuhan-kebutuhan baru yang dibutuhkan oleh keluarga misalnya adalah rekreasi. Melalui pemikiran kontemporer, apakah rekreasi dapat dikategorikan nafkah? dan apakah rekreasi dapat dikategorikan sebagai nafkah yang dapat menunjang keharmonisna keluarga?. Artikel ini hasil dari penelitian yuridis emperis, dengan menggunakan pendekatan kualitatif. Sumber data yang digunakan adalah sumber data primer dan sekunder. Metode pengumpulan data menggunakan metode wawancara. Pengolahan data dilakukan dengan tahap pemeriksaan data, klasifikasi, verifikasi, analisis, dan kesimpulan. Hasil pembahasan artikel ini menunjukan bahwa seluruh informan menyatakan terdapat hubungan antara nafkah dengan rekreasi, sehingga rekreasi dapat dikatakan salah satu kategori nafkah yang menjadi kebutuhan keluarga. Dengan melihat fungsi keluarga, nafkah rekreasi telah memenuhi empat dari tujuh fungsi keluarga, diantaranya fungsi edukatif, fungsi religius, fungsi sosialisasi, fungsi rekreatif, sehingga nafkah rekreasi yang diberikan pemenuhannya oleh suami dapat menunjang keharmonisan keluarga.Kata Kunci: Nafkah, Keluarga, Keharmonisan Keluarga, Rekreasi

Abstract

This study aims to determine the internalization of religious moderation among Muslim students at ITB and IPB and its implications for the deradicalization movement in Indonesia. There are four main pillars that indicate national commitment: tolerance, non-violence, and respect for local traditions and culture. Two important factors motivated the writing of this article: first, the suspicion that radicalism occurs among students, and second, the belief that most radicalism occurs on non-religious campuses due to a lack of understanding of Islamic religious sources. Are these assumptions true? Therefore, this research was conducted on the campuses of ITB and IPB, which are well-known non-religious campuses in Indonesia. This research employed a qualitative method with a phenomenological approach, collecting data through in-depth interviews. The study concluded that the internalization of moderation at IPB and ITB is very good, drawing insights from various sources including the campus environment, social media, several studies, and the broader community. Students at both campuses generally exhibit a moderate attitude, although some students' understanding of moderation is not yet fully developed. For example, when asked to choose a president, 45% of students chose a Muslim candidate, while 40% based their choice on justice and skills rather than religion. Based on the moderate attitudes of students at both universities, the behavior of religious radicalism is unlikely to occur or even exist. Thus, students on both campuses are considered to have implemented the four main pillars of religious moderation.

Abstract

Iddah is a waiting period given to women to check whether they are pregnant or not. Until the issuance of the Circular Letter from the Director General of Islamic Community Guidance, Ministry of Religious Affairs No: P-005/DJ.III/Hk.00.7/10/2021, which regulates the application of the waiting period (Syibhul Iddah) for men who have divorced before remarrying. This research aims to describe the implementation of Syibhul Iddah based on the Circular Letter at the KUA Klojen District and to analyze its concept from the perspective of Wahbah Az-Zuhaili. This research uses a juridical-empirical approach with a qualitative descriptive method. Data sources were obtained from primary sources in the form of interviews with informants such as the Head of KUA, modin, and widowed prospective grooms, and were supported by secondary sources such as relevant literature, including the Islamic book "Wa Adilatuhu" and Circular Letters. Data were collected through interviews and documentation. The research results show that the KUA of Klojen District has implemented this policy in accordance with the regulations. The KUA does not process the administration of male prospective brides who are still in the iddah period of their former wives. This policy provides benefits, particularly in protecting women's rights post-divorce. Furthermore, an analysis from the perspective of Wahbah Az-Zuhaili shows that Syibhul Iddah aligns with two shari'ah prohibitions, namely the prohibition of marrying more than four wives (including in the case of raj'i divorce) and the prohibition of marrying women who are blood relatives of former wives.
