Abstract

The founders of the nation based their philosophy, known as Pancasila, on the religious and cultural diversity of the Indonesian people. It is the foundation of the Unitary State of the Republic of Indonesia. The purpose of this research is to analyse and present a summary of Muhammadiyah's dar al-'ahdi (national consensus) interpretation of the Pancasila State concept. One of the biggest social-community organisations, Muhammadiyah, sees Pancasila as a dar al-'ahdi (national consensus) that was established in the Muhammadiyah Muktamar decision tanfidz of 2015. Because Muhammadiyah holds the belief that Pancasila must occupy the highest position in the life of the nation and state with the concept of Pancasila state darul al-'ahdi wa shahadah, this concept was developed. Muhammadiyah has observed Pancasila being strengthened and is dedicated to doing so as well as interpreting the diversity that has been reflected in the faith and conviction of Muhammadiyah life's values. The Pancasila as Dar al-'Ahdi wa al-Syahadah-based Indonesian state already has a solid ideological foundation.

Abstract

Barito Kuala District has developedpalm oil plantation sector in wetlands area which gradually changed the pattern of its community life. Previously, most of the people were sharecroppers with the land as their main commodities, then they become the labor because the companies employ people especially from the local community.This research is an empirical legal study to obtain primary data and literature study to obtain secondary data. Its population is the palm oil plantations in Barito Kuala District and the sample is palm oil plantations in wetlands, which employ workers. In relation to the employment, there are sometimes disagreements among the parties which can be caused by a variety of factors. The settlement of the industrial disputes is through stages of the bipartite; the mediation(tripartite); conciliation; arbitration; and the Industrial Relations Court. Industrial Relations Court is the last effort for the disputing parties in industrial relations that can not be resolved through out courts, regulated in Law Number 2 of 2004 concerning Industrial Relations Court .

Abstract

:This type of research is juridical-empirical, character of an explanatory study, using non probality sampling technique, with sampling purposive or judgment sampling, with its own considerations for selecting members of the sample. Respondents farmers, farmer groups, informants: National Land Agency, Agency for Agricultural Extension and the National Bureau of Statistics.A redistributionsubject of Agricultural Land in South Kalimantan province, not all poor farmers and sharecroppers, but there are also traders, private employees and civil servants. Due to ignorance of the farming community will Land Redistribution program. Object of agricultural land redistribution in South Kalimantan, only on state land or land uncultivated state-controlled, whereas the maximum limit for the excess land, absentee land and abandoned land is not part of the object of reform because it could not be implemented due to the constraints of data and information not enough about it. Because the object redistribution of agricultural land that is not up to two(2) acres, has not been able to fulfill the lives of farmers, because it is too small farms and agricultural produce is not maximized.

Abstract

Penelitian ini ertujuan untuk mengkaji mengenai bagaimana pengesahan Yayasan sebagai badan hukum menurut Undang-Undang Yayasan, Peraturan Menteri Hukum dan HAM dan Peraturan Menteri Agama Republik Indonesia Nomor 19 Tahun 2021 dan untuk mengkaji kendala Notaris dalam mengajukan pengesahan Yayasan sebagai badan hukum apabila mengikuti Peraturan Menteri Agama Republik Indonesia Nomor 19 Tahun 2021. Dengan menggunakan jenis penelitian yuridis normatif, Penelitian ini bersifat preskriptif analisis yaitu menjawab isu hukum dengan cara menggambarkan, menelaah, mengkaji, dan menjelaskan secara tepat serta menganalisa peraturan perundang-undangan yang berlaku maupun dari berbagai pendapat ahli hukum, dengan tujuan untuk mendapatkan jawaban atas permasalahan yang diangkat. Hasil Penelitian Pertama : pengesahan badan hukum Yayasan yang memiliki kekhususan di bidang keagamaan sebelum pengesahan badan hukumnya diterbitkan oleh Meteri Hukum harus terlebih dahulu memperoleh pemberian pertimbangan pengesahan badan hukumnya oleh Menteri Agama berdasarkan Permenag RI Nomor 19 Tahun 2021. Kedua : Adanya ketidaksinkronan antara Undang-Undang Nomor 16 Tahun 2001 Tentang Yayasan Juncto Undang-Undang Nomor 28 Tahun 2004, Peraturan Menteri Hukum dan HAM Nomor 2 Tahun 2016 Juncto Nomor 13 Tahun 2019 dengan Permenag RI Nomor 19 Tahun 2021, yang membuat Notaris terkendala dalam melakukan pengesahan badan hukum Yayasan yang memiliki kekhususan dibidang keagamaan. Ada beberapa syarat ketentuan untuk permohonan pemberian pertimbangan dari pihak Kementerian Agama yang tidak bisa diakomodir oleh pihak Notaris seperti penerbitan akta pendirian Yayasan dan juga Nomor Pokok Wajib Pajak Yayasan yang penerbitannya tidak bisa dimohonkan oleh pengurus Yayasan karena terbentur syarat harus melampirkan Surat pengesahan badan hukum Yayasan dalam pembuatannya.
