Abstract

Sistem penegakan hukum di Indonesia dipengaruh oleh paham Positivisme.   Konsep hukum positif merupakan bukti nyata dari pengaruh paham Positivisme tersebut. Hukum positif tumbuh dan berkembang sebagai hukum yang tertulis, dibuat oleh para pejabat untuk mengatur kehidupan yang nyata dalam masyarakat, sehingga hukum positif ini terpisah dengan nilai-nilai moral dan baik buruk. Perbedaan pandangan dalam memahami aliran hukum mana yang tepat untuk diterapkan di Indonesia menjadi topik utama dalam menyikapi permasalah hukum. Hal disebabkan adanya pandangan yang menyatakan, bahwa di dalam pengaruh Paradigma Positivisme, Positivisme Hukum justeru diturunkan kepada permasalahan konkrit. sudut pandang Positivisme Yuridis dalam arti yang mutlak. Positivisme Hukum seringkali dilihat sebagai aliran hukum yang memisahkan antara hukum dengan moral dan agama, antara Das Solen dengan Das Sein. Positivisme menyatakan ilmu alam sebagai satu-satunya sumber pengetahuan yang benar dan menolak aktifitas yang berkenaan dengan metafisik. Penemuan hukum dimaknai sebagai proses pembentukan hukum oleh hakim atau aparat hukum lainnya yang diberikan kewenangan untuk menerapkan peraturan hukum umum pada peristiwa hukum yang konkret bukan hanya sebagai corong Peraturan Perundang-undangan. Fenomena penerapan hukum yang cenderung tajam ke bawah namun tumpul keatas. Kekacauan hukum di negeri ini semakin lama semakin memprihatinkan, Keadilan semakin tidak mencapai apa yang diharapkan dari tujuan dibentuknya hukum.

Abstract

Vehicle load measurement tools can be carried out dynamically without the need to stop the vehicle first with the Weigh In Motion system. This writing aims to find out exactly what is related to the Electronic Ticketing System (E-TLE) in Kulon Progo. Based on this, this research study aims to determine the increase in the performance of the police and the Ministry of Transportation in implementing e-tickets and solving cases of criminal acts of traffic violations. This type of research is field research, namely a form of research that aims to reveal the meaning given by society to their behavior and reality. The research method used is a qualitative method, which is a research approach that reveals certain social situations by describing reality correctly. The results of this study can be seen that the performance of the traffic police and the Ministry of Transportation in disseminating e-tickets includes explaining the procedure for measuring vehicle loads using weigh-in-motion (WIM). The data that can be obtained from this measurement is the total weight of the vehicle, the weight of the vehicle axle, the type of vehicle, the speed of the vehicle, and the distance between the vehicle axles has not been running in accordance with applicable and optimal procedures.

Abstract

The background of this research is community participation in efforts to build village potential starting from the hamlet. The problem formulation in this research is 1) What is the planning strategy for building the potential of Bendungan village starting from the hamlet? 2) What are the obstacles faced in the village development planning strategy from the Dusun Kuncen Wates District, Kulon Progo Regency? 3) What are the efforts to overcome obstacles in the planning strategy for developing Villages from Dusun? The research design that the authors use is a descriptive analysis research design. The primary data source is that there are 15 people who were interviewed. Data collection techniques in this study were library research, and field studies (observations and interviews). Data analysis techniques in this study were collecting observation and interview data, interpreting observation and interview data, describing observation and interview data to answer the research problem formulation and drawing conclusions from observation and interview data to answer the research problem formulation. Based on the results of the study that 1) The village development planning strategy starting from Kuncen Hamlet, Wates District, Kulon Progo Regency, in general, can be implemented, but there are still several indicators of implementation that are still not optimal, 2) lack of awareness that village potential can be explored can be more beneficial for welfare 3) The efforts made, namely inviting the community to be more active, providing understanding to the community, are still not being implemented by the Village Government.

Abstract

The protection and empowerment of farmers aims to realize the sovereignty and independence of farmers in order to increase the level of welfare, quality, and a better life, provide certainty for farming, protect farmers from price fluctuations, high-cost economic practices, and crop failure. Improving the ability and capacity of farmers as well as farmer institutions in carrying out productive, advanced, modern and sustainable farming businesses and developing agricultural financing institutions that serve the interests of farming businesses. In this study the authors analyzed whether the program was running in accordance with Regional Regulation No. 7 of 2015, from an analytical study some of the programs had been running but were not optimal.
