Abstract

The criminal act of sexual violence has not been explicitly regulated in the Criminal Code (KUHP). In its development, Komnas Perempuan and the Service Provider Forum (FPL) initiated and compiled the Bill on the Elimination of Sexual Violence (RUU PKS). This writing formulates 2 (two) things, namely: criminal and problematic legal policies against criminal acts of sexual violence according to the Criminal Code and its development in the PKS Bill which aims to create gender justice.The approach method used by juridical sociology is a legal research method used in an effort to see and analyze a real rule of law that exists in society. Writing specifications use descriptive analysis, sources and types of data used primary and secondary data. Data collection methods by interview, library research, document study, and use qualitative data analysis methods. The theory used in conducting the analysis is the Pancasila theory of justice, the theory of legal certainty, and the theory of neutralization.The criminal law policy regarding criminal acts of sexual violence according to the Criminal Code regulates adultery, rape, intercourse with underage women, and revocation. However, the development of the PKS Bill on sexual violence was formulated into 9 (nine) types. The problem is in the legal system (substance, structure, and legal culture) which has not been in favor of justice for victims.Keywords: Criminal Law Policy, Sexual Violence, Gender Justice

Abstract

Implikasi dari KUHP Nasional yaitu delik korupsi bukan lagi merupakan kejahatan luar biasa (extraordinary crime), namun tindak pidana korupsi disamaratakan dengan delik biasa seperti misalnya delik pencurian atau delik penggelapan. Penulisan ini bertujuan untuk memahami dan menganalisis mengenai pengaturan tindak pidana korupsi dan politik hukum pengurangan hukuman bagi pelaku tindak pidana korupsi dalam Undang-Undang Nomor 1 Tahun 2023 (KUHP Nasional). Metode penelitian yang digunakan adalah metode yuridis normatif. Melalui metode pendekatan perundang-undangan (statute approach), penelitian ini menganalisis berbagai peraturan hukum yang berlaku. Pengaturan tentang tindak pidana korupsi termuat dalam Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dalam Undang-Undang 30 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi (UU Tipikor). Pemerintah juga memberlakukan Undang-Undang Nomor 19 Tahun 2019 tentang Perubahan Kedua atas Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi (UU KPK). Kemudian, dalam KUHP Nasional mengubah bebebrapa pengaturan mengenai tindak pidana korupsi. Tiga poin utama yang menarik perhatian publik mengenai perubahan dalam pengaturan tindak pidana korupsi di Indonesia adalah arah politik hukum pemberantasan korupsi, kepastian hukum dalam implementasi pengaturan tindak pidana korupsi, dan penegakan usaha pemberantasan tindak pidana korupsi.

Abstract

Asset confiscation without criminal punishment in civil forfeiture recognizes the principle of Non Conviction Based Asset Forfeiture (NCBAF) which is a civil law instrument to confiscate assets/proceeds without going through criminal prosecution. The purpose of this writing is to design the mechanism and challenges of implementing NCBAF in the Asset Confiscation Bill. The research method used is normative juridical which emphasizes document studies or library research. The design of the PAS Bill mechanism in highlighting the traces of suspected assets is divided into several stages of practice that have been included in its content, namely starting from the tracing stage, blocking and confiscation, filing and submitting an application for asset confiscation, summons, examination in court, and asset management. The challenges of implementing NCBAF in the PAS Bill are the long process, the type which is an additional optional criminal offense, and the existence of a paradigm that pits NCBAF against the principle of the presumption of innocence so that they argue that NCBAF is contrary to Human Rights.
