Abstract

Business Competition Supervisory Commission (henceforth KPPU), a law enforcement body in Indonesia, was established based on Antimonopoly Law. This commission is a quasi-judicial body holding executorial authority over business competition-related cases. The crucial issue is apparent when business people submit petitions to the District Court since, from this point, different approaches and treatments between the KPPU and the District Court are revealed. This weak legal procedure, especially regarding the efforts made for petitions, is often seen as an opportunity by business people to stand against the decisions of the KPPU by submitting petitions to District Court, and several cartel-related cases have been reinforced by Supreme Court. This research employed normative-juridical methods involving secondary data that were further analyzed by emphasizing juridical aspects for the analysis of the qualitative analysis method to present a description, from which a conclusion and recommendations were drawn. With it, decisions of the KPPU would not be labeled weak in law enforcement concerning business competition. Moreover, this approach is intended to deter business people regarding the violations of Law concerning Antimonopoly especially those regarding cartels which not only harm business people, but also the members of public in general.

Abstract

The covid-19 outbreak that swept across the world has caused a crisis in the economic sector, where physical distancing policies affect the world of trade and tourism. The bankruptcy of companies, hotels, and small and medium-sized micro-enterprises resulted in massive job cuts. Therefore, many people lose their livelihoods and borrow money to meet their daily needs. Financial technology is an advancement of the times in the industrial era 4.0, as a form of convenience in financial services of tempted communities and applying for loans to financial technology. However, instead of getting a financial solution, what happens is the opposite. Where the public is even entangled in the existence of illegal financial technology and there is a misuse of their personal data. It is true that there is an agreement that allows the debtor to access the personal data of the creditor, but whether with it immediately the debtor can misuse the customer's personal data. Therefore, in this study, the author is interested in reviewing how criminal and civil liability related to the emergence of illegal financial technology agreements during the Covid-19 pandemic. The research methods used are normative juridical with statute approach and comparative approach, as well as qualitatively described legal material analysis. The result obtained is, illegal fintech e-agreements do not meet the subjective and objective requirements of the agreement and are related to the misuse of customer data, which can be held criminally accountable are fintech law bodies and debt collectors.

Abstract

This article discusses trademarks in a legal political perspective. The existence of Presidential Regulation No. 63 of 2019 concerning the Use of Indonesian which regulates the use of Indonesian that must be used on trademarks owned by Indonesian citizens or Indonesian legal entities has conflicts with the Law Number 20 of 2016 On Trademarks and Geographical Indications, regarding the function and purpose of the Trademarks, so it is interesting to conduct discussions through normative juridical methods. The results of this study show that the principle of Lex Superior Derogat Lex Inferiori law, which is a principle that interprets higher legal norms, can be used as one of the tools in solving problems.  Thus, the position of Presidential Regulation Number 63 of 2019, is no more binding than the position and binding power of Law Number 20 of 2016 on Trademarks and Geographical Indications. Abstrak Artikel ini membahas merek dagang dalam perspektif politik hukum. Keberadaan Peraturan Presiden Nomor 63 Tahun 2019 tentang Penggunaan Bahasa Indonesia yang mengatur penggunaan bahasa Indonesia yang harus digunakan pada merek dagang milik warga negara Indonesia atau badan hukum Indonesia bertentangan dengan Undang-Undang Nomor 20 Tahun 2016 tentang Merek Dagang dan Indikasi Geografis, mengenai fungsi dan tujuan Merek Dagang,  sehingga menarik untuk melakukan diskusi melalui metode yuridis normatif. Hasil penelitian ini menunjukkan bahwa prinsip hukum Lex Superior Derogat Lex Inferiori, yang merupakan prinsip yang menafsirkan norma hukum yang lebih tinggi, dapat digunakan sebagai salah satu alat dalam memecahkan masalah.  Hal ini berimplikasi kedudukan Peraturan Presiden Nomor 63 Tahun 2019, tidak lebih mengikat dengan kedudukan dan daya mengikat Undang-Undang Nomor 20 Tahun 2016 Tentang Merek Dagang dan Indikasi Geografis.

Abstract

Rental agreements are usually made in writing in a standardized form, namely the content, form and closing have been standardized unilaterally by the business actor. This agreement is coercive and causes losses for the lessee and even an imbalance in the position between consumers and producers. This study aims to: (1) determine the contents of the standard clauses in the car rental agreement at Komando Rent a Car whether or not they are in accordance with the principle of good faith (2) to determine the legal consequences of including the standard clause in the car rental agreement at Komando Rent a car. The type of research used in this study is empirical juridical by using data collection techniques through interviews and literature studies. The results of the study show that: (1) the car rental agreement at Komando Rent a Car is not in accordance with the principle of good faith because there is a standard clause in the form of delegation of responsibility for business actors to the detriment of one of the parties, does not reflect a sense of justice and violates the law (2 ) the legal consequence of the inclusion of a standard clause which contains the transfer of responsibility for this business actor is that the agreement is null and void and can be subject to imprisonment and fines. Abstrak Perjanjian sewa biasanya dilakukan secara tertulis yang sudah dalam bentuk baku yaitu isi, bentuk serta penutupannya telah dibakukan secara sepihak oleh pelaku usaha. Perjanjian ini bersifat memaksa dan menimbulkan kerugian bagi pihak penyewa bahkan terdapat ketidakseimbangan posisi antara konsumen dan produsen. Penelitian ini bertujuan untuk: (1) mengetahui isi klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car telah sesuai atau tidak dengan asas itikad baik (2) untuk mengetahui akibat hukum dari pencantuman klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan menggunakan teknik pengumpulan data melalui wawancara dan studi kepustakaan. Hasil penelitian menunjukkan bahwa: (1) perjanjian sewa menyewa mobil di Komando Rent a Car tidak sesuai dengan asas itikad baik karena terdapat klausula baku berupa pelimpahan tanggung jawab pelaku usaha sehingga merugikan salah satu pihaknya, tidak mencerminkan rasa keadilan dan melanggar Undang-Undang (2) akibat hukum dari pencantuman klausula baku yang memuat pengalihan tanggung jawab pelaku usaha ini adalah perjanjian tersebut batal demi hukum dan dapat dikenai sanksi penjara dan denda.

Abstract

This study aims to investigate the Legal Position of celebrities in promoting goods through the Instagram platform and the form of legal liability by celebrities for endorsements or advertised products. With a normative Legal method supported by statutory and conceptual approaches in the context of problem-solving, and Library Research, this research reveals that the legal position of celebrities holds no legal basis which specifically regulates the legal position of celebrities and no rules used and applied, resulting in a vacuum in norms. When a problem regarding endorsement with indications of products not in accordance with what is advertised emerges, this issue involves Liability based on fault. In such a case, the relevant form of liability where the celebgram is responsible for losses caused by mistakes contravening Article 4 letter h of Law No. 8 of 1999 concerning Consumer Protection asserting that consumers are entitled to compensation, compensation and/or replacement if the goods and/or services received are not by the agreement or not as they should be. Abstrak Penelitian ini bertujuan untuk dapat mengetahui tentang Kedudukan Hukum selebgram dalam mempromosikan barang melalui platform Instagram serta untuk dapat mengetahui tentang bentuk pertanggungjawaban hukum oleh selebgram atas endorsement atau produk yang diklankan. Metode penelitian yang dipakai adalah jenis Penelitian Hukum Normatif dengan metode pendekatan perundang-undangan (the statute approach), penelitian ini juga menggunakan pendekatan konseptual (the conceptual approach) yang digunakan dalam rangka pemecahan masalah, serta penelitian ini merupakan penelitian kepustakaan (Library Research). Hasil penelitian yang didapat adalah Kedudukan hukum selebgram secara khusus ditegaskan bahwasanya tidak ada dasar hukum yang mengatur secara khusus mengenai kedudukan hukum selebgram dan belum memiliki aturan yang dipakai dan diterapkan akibatnya terjadi kekosongan norma. Ketika terjadi permasalahan mengenai endorsement dengan indikasi produk yang tidak sesuai dengan yang diklankan maka bentuk pertanggungjawaban yang dilakukan adalah Liability base on fault. Dimana dalam hal ini dapat dijelaskan bahwa Bentuk pertanggungjawaban yang relevan adalah dimana selebgram bertanggungjawab atas kerugian yang disebabkan oleh kesalahan yang dilakukannya terdapat dalam Pasal 4 huruf h UU No. 8 Tahun 1999 tentang Perlindungan Konsumen yang berbunyi konsumen berhak untuk mendapatkan kompensasi, ganti rugi dan/atau penggantian, apabila barang dan/atau jasa yang diterima tidak sesuai dengan perjanjian atau tidak sebagaimana mestinya.
