Abstract

(This article is retracted because of dupiclate publication)The land was the state's authority to govern the giving and use of land to the people so that the land would be used for the greatest measure of civic prosperity requiring a sure law and protection of the law among peoples. While wisdom regarding land civilty governed by the state exists in reality often does not establish order and certainty of law. For example the case example on ruling Supreme Court number 658 PK/Pdt/2017 in the two hedges of the same land as the different rights, Dirman was using the building rights and John as his property which turned John's property into an object of dispute at the State Enterprises Court. How can legal protection be provided for land buyers who lost their rights through land sale that was once an object of national governance court dispute at the State Enterprises Court? How would the deed of ownership of the deed of the land deed be formed between bacce and Gunadi and Gunadi and John? The authors examine the problem using normative legal methods and use interviews as backup data. Studies reveal that legal protection is obtained if land buyers can prove their rights in court and Land deed deed official only responsible for the purchase papers made between Gunadi and John because they were consciously created that the land was in dispute over the state governance court.

Abstract

Multiple certificates, namely a plot of land that has more than one certificate, causing legal uncertainty for holders of land rights which is highly undesirable in land registration in Indonesia. The purpose of this study, among other things, is to find out and analyze the responsibility of the National Land Agency when it was discovered that there were multiple certificates based on Decree Number: 177/Pdt.G/2022/PN Tjk. The research method uses a normative and empirical juridical approach. This case of multiple certificates can occur because the main certificate has not been mapped, so when an online check is carried out through an application it cannot be read, resulting in the re-creation of the certificate either partially or wholly on the same land by another party. If there are several certificates, the responsibility of the National Land Agency is to assist in mediation between certificate holders. If it cannot be resolved through mediation, the National Land Agency will help direct it to a settlement in the District Court or State Administrative Court because it is the State Administrative Court or District Court that can decide whether or not the certificate is cancelled.

Abstract

A living person may give away their property by grant or gift instead of distributing it to their heirs through inheritance. When both the grantor and grantee are still alive, a grant is a legal action that aims to transfer ownership rights that are knowingly transferred to another party. Grants may be made to whoever the grantor chooses, but it must be stated that the grant's terms cannot be harmful to other people. The Burgerlijk Wetboek, or Civil Code, governs these issues. By being careful not to violate the legitimate component (absolute part). Problems with legal protection and legal repercussions for heirs about grants that hurt the absolute portion (Legitieme Portie) of the heirs will occur if they breach the law's restrictions. By looking into secondary data or library resources, the normative juridical research methodology was applied to create this paper. As a result of identifying the absolute portion (Legitieme Portie), as specified in Article 913 of the Civil Code, various provisions in the Civil Code (Burgerlijk Wetboek) have given the heirs legal protection. Then, if the heirs feel wronged by the grant or grant or based on a will or who has passed away, the legal implications of a grant deed that breaches Legitieme Portie be revoked.

Abstract

Abstract

This study aims to examine the legal status of land rights that can be owned by transmigration communities and the legal protection that can be taken by the community if they feel disadvantaged. The research method used is normative legal research using a statutory approach and a case approach. The government is holding a transmigration program for population equality throughout Indonesia, therefore, a transmigration area was formed as a residential area and a place of business for the community to improve the community's standard of living. Over time, the need for land has increased because community growth is not comparable to the available land, so it often causes disputes. One example of a land dispute that occurs is transmigration land owned by the community that has changed ownership to company land, where the transmigration land owned by the company was obtained by winning an auction. This study was conducted to determine the appropriate legal system in resolving transmigration land disputes whose land is used as an auction object, as well as to find out about the legal protection received by transmigration communities. The results of the study are that the legal status of transmigration land that is used as an auction object should still belong to the transmigration community because transmigration land cannot be transferred, while legal protection for transmigration communities should mean that the land is not used as an auction object by the local government because it still belongs to the transmigration community.
