Abstract

Perceraian sudah menjadi gejala fenomenal di negara tercinta ini. Hampir di seluruh propinsi yang ada di Indonesia mempunyai kasus perceraian yang sangat tinggi tidak terkecuali propinsi Aceh yang sedang menerapkan syariat Islam khususnya di kabupaten Aceh Tengah. Menyikapi hal ini, kabupaten Aceh Tengah yang masih kental dalam melestarikan adat di masyarakatnya harus mengambil langkah yang jitu untuk meminimalisir tingkat perceraian ini. Oleh karena itu, penelitian ini bertujuan untuk mengetahui peran lembaga kampong dalam manajemen konflik keluarga dan kendala apa yang dihadapi mereka dalam memainkan peran ini. Penelitian ini merupakan penelitian kualitatif deskriptif dengan menggunakan teknik wawancara sebagai sumber data primernya. Hasil penelitian menunjukkan bahwa lembaga kampong yang ada di kabupaten Aceh Tengah tidak maksimal dalam memainkan perannya dalam manajemen konflik keluarga, hanya sebagian kecil saja yang menjalankan peran ini. Hal ini dikarenakan terdapat beberapa kendala yang dihadapi oleh lembaga kampong seperti sempitnya ruang gerak yang mereka miliki karena dibatasi oleh qanun, undang-undang serta kewenangan lembaga lain seperti muspika. Selain itu, juga terkendala oleh adanya pergeseran nilai-nilai adat di masyarakat Gayo sehingga masih banyak peran-peran adat dahulu yang sudah kabur dikarenakan konflik yang berkepanjangan dan munculnya pendatang yang membawa budayanya sendiri. Solusi yang bisa dilakukan didiskusikan dalam penelitian ini.

Abstract

Religious conversion is not a new phenomenon in society, especially in the diverse nation of Indonesia. Interestingly, there are several Karo children in Kala Wih Ilang Takengon whose parents or extended families still adhere to their traditional beliefs, but the children have converted to Islam. This community service aims to strengthen the resilience of these young converts, ensuring they remain steadfast in their new faith, and to promote religious moderation. The approach used is Community Based-Research (CBR), which involves treating the supported children as partners in the service project. The steps taken include a pre-assessment activity involving site observation, an assessment to gather information from stakeholders about the children's conditions, and the implementation of the service, which includes providing reinforcement of resilience and religious moderation. The results of this service show that five young converts were supported: Hevi Harpani, Febrina, Marsella, Rivaldo Ginting, and Alex Barus. Currently, they are spread across Islamic boarding schools in Takengon and Aceh Besar. Strengthening resilience and religious moderation was conducted through a personal approach, using question-and-answer sessions and discussions related to the topics to be reinforced. Additionally, the service team provided gifts such as prayer equipment and reading materials to help the supported children remain consistent in their Islamic faith and practice it moderately. This community service recommends that local governments provide attention and support to these children so they can pursue their education. Abstract

An assignment of marriage is obligatory for couples married without the registration of legal marriage for the guaranteed certainty of law. This study aims to determine the number of cases of intermarriage in Kabul at the Central Aceh Syar'iyyah Court, the implementation of contingent marriage licenses, and the position of mediation on the marriage certificate. This juridical empirical research uses a qualitative approach with six judges as informants. Data collection techniques using interviews and documentation. The results showed the number of cases of marriage with the Syar'iyyah Court of Central Aceh in the last six years was 2,117 cases with details of 1,969 volunteer cases and 148 cases of contingency. The implementation of itsbat contingent marriage at the Syar'iyyah Court has met the standard regulations, but there are only petitioners and defendants by children or husband/wife, and there are no disputes involving other parties so that it cannot be categorized as fully contingent. The position of mediation in itsbat contingent marriage at the Central Aceh Syar'iyyah Court was not implemented because there were no disputes and did not involve other parties. Therefore, PERMA No. 1 of 2016 should be reviewed, which requires mediation in contingent cases.
