Abstract

Di Indonesia, pengadaan Tanah melalui Pembebasan Tanah (Prijsgeving)/ Pelepasan hak atas tanah didasari oleh  ketentuan dalam Undang-Undang No  2  Tahun 2012  Tentang Pengadaan Tanah  Bagi Pembangunan Untuk Kepentingan Umum dan Pencabutan hak atas tanah (Onteigening) didasari oleh ketentuan dalam UU No. 20 Tahun 1961 Tentang Pencabutan Hak-Hak Atas Tanah dan Benda-Benda Yang Ada di Atasnya. Apabila cara musyawarah yaitu dengan pemindahan hak atau pelepasan hak atas tanah tidak berhasil maka baru ditempuh dengan Cara Wajib (Compulsory Acquisition of Land) yaitu ditempuh dengan pencabutan hak atas tanah.Pencabutan hak atas tanah (Onteigening) didasari oleh ketentuan dalam UU No. 20 Tahun 1961 Tentang Pencabutan Hak-Hak Atas Tanah dan Benda-Benda Yang Ada di Atasnya.Kata Kunci: Pembebasan Hak atas Tanah dan pencabutan Hak atas Tanah

Abstract

Disputes in share divestment in Indonesia, such as the case between the Indonesian Government and PT. Newmont Nusa Tenggara, reflect the complexity of law and economy. This dispute was triggered by differences of opinion regarding the payment mechanism for shares sold by PT. Newmont Nusa Tenggara. The government rejects the payment scheme using funds from foreign capital owners such as PT. Bumi Resources Tbk, PT. Newmont Indonesia Limited, and Nusa Tenggara Mining Cooperation, because it is considered not in accordance with national interests. This study uses the Legal Research method with a normative juridical approach as explained by Prof. Peter Mahmud Marzuki. This conflict is caused by the weakness of the Work Contract, the unclear dispute resolution mechanism, and the lack of legal certainty regarding share divestment in Indonesia. The government and PT. Newmont Nusa Tenggara remain adamant with their respective schemes—the government wants national financial resources, while PT. Newmont offers foreign capital loans. This complicates communication and joint solutions. The main issues discussed are the legality of purchasing shares using foreign loans and the need for DPR approval in the divestment of shares in closed business sectors such as coal mining.

Abstract

The mandate of Article 33 of the 1945 NRI Constitution states that the natural wealth contained therein must be managed sustainably for the greatest prosperity of the Indonesian people. It is important to understand that regional autonomy originates from the management of maritime areas, which is the result of the exercise of authority relating to various activities on land. One way to improve people's welfare is by utilizing natural land and sea resources, finance and public services. One of Indonesia's greatest natural riches is natural oil and gas resources (SDA MIGAS). Normative juridical research which aims to study authority, especially the management of OIL and Gas mines in offshore areas under Aceh's special autonomy. This research is based on the diversity of legal science, which results in a normative research approach. Research shows that the law limits BPMA from managing OIL and Gas in Aceh. It is interesting to note that Aceh's OIL and GAS mines, which have large deposits, are located between 12 and 200 nautical miles. One example is the oil and gas location in Simeulue, which is located 20.5 nautical miles. Therefore, BPMA does not have the authority to negotiate, especially in terms of ratifying and signing Cooperation Contract (KKS) agreements. Therefore, laws made by the governor with the approval of the DPRA or DPRK automatically do not apply and become mere rules without action.
