Abstract

Elections can only be held in a credible and fair manner if they are placed by an impartial institution. According to the Constitution, elections are conducted by an independent EMB, with no additional definition of independence. The purpose of this study is to determine the post-reform electoral management institution model and the concept of independence in Article 22E paragraph (5) of the 1945 Constitution as recognized by the Constitutional Court, the research methodology is the normative legal method and the legal and case approach. According to the findings of this study, the post-reform election model is an independent model that does not involve representatives from political parties or employees.

Abstract

This research aims to analyze conflicts related to the neutrality of the State Civil Apparatus (ASN) in the context of elections and post-conflict regional elections in Indonesia, with a focus on sources of conflict, dynamics and management strategies for preventing and handling conflicts. The methods used include literature studies, citing media interviews, and ASN observations in several regions involved in the election process. The research results show that conflicts related to ASN neutrality originate from structural inequality in the bureaucracy, differences in values between professionalism and political patronage, as well as conflicts of interest between demands for neutrality and political pressure. In conclusion, preventing and handling conflicts related to ASN neutrality requires a comprehensive approach involving structural reform of the bureaucracy, transformation of organizational culture, and active participation of civil society. Implementing appropriate conflict management strategies will not only strengthen the integrity of ASN, but also support a more transparent and accountable democratic process in Indonesia.

Abstract

This article discusses the issues of illegal parking and street-level extortion at Pasar Angso Duo, Jambi, caused by poorly managed parking fee policies. The public is burdened with dual payments, paying official parking fees while still facing illegal levies from irresponsible individuals. This situation leads to public dissatisfaction and has the potential to trigger social conflicts. This study uses a conflict management approach to analyse the causes, impacts, and possible solutions to these issues. The findings indicate that weak oversight and enforcement of parking policies are the primary factors behind the emergence of illegal parking and street-level extortion. Moreover, the government has been ineffective in managing conflicts involving various stakeholders, such as the public and informal groups. To address these issues, the study recommends that the government enhance monitoring, empower the community by forming parking management cooperatives or workgroups, and implement a more assertive legal approach to combat extortion. Additionally, providing skill training and alternative employment opportunities for those involved in illegal parking can help prevent future conflicts. By implementing these solutions, it is expected that the illegal parking and extortion issues at Pasar Angso Duo can be effectively addressed, creating a safe and conducive market environment.
