Abstract

Program kemitraan inti plasma tersebut dalam pelaksanaannya menyimpan banyak kekurangan. Manajemen kebun plasma yang bermitra dengan inti sangat beragam status pengelolaannya. Ada yang bersifat individu  dan ada  pula di bawah pengelolaan berkelompok  seperti Koperasi atau GAKOPTAN. Seringkali dengan banyaknya kekurangan dalam pelaksanaannya tersebut maka kecenderungan kondisi tidak menguntungkan ada pada pihak petani. Penelitian ini bertujuan untuk mengetahui pelaksanaan  program kemitraan inti plasma perkebunan sawit dan peran Koperasi dalam program kemitraan inti plasma perkebunan kelapa sawit di Provinsi Kalimantan Selatan khususnya wilayah perkebunan sawit di Kabupaten Barito Kuala, sebagaimana diatur dalam perundang-undang No.39 Tahun 2014 Tentang Perkebunan dan UU sektoral terkait. Jenis penelitian yang digunakan adalah penelitian yuridis normatif, yakni penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum positif, yang bersumber dari penelitian kepustakaan yang menggunakan bahan hukum.

Abstract

Indonesian criminal law reform has shifted from a retributive orientation toward a more restorative and socially responsive approach, as reflected in the recognition of living law under Law Number 1 of 2023 on the National Criminal Code. However, local wisdom-based social sanctions, which have long functioned as community-based restorative mechanisms, remain absent from explicit codification in the national penal system. This normative gap raises an important legal-political question concerning the possibility of institutionalizing such sanctions through Regional Regulations (Peraturan Daerah) without violating constitutional principles, national criminal law, and human rights standards. This study aims to examine the legal-political basis for such institutionalization and to formulate the normative limits and regulatory model that should govern it. The study employs normative legal research using statutory, conceptual, philosophical, and socio-legal approaches. The findings show that local wisdom-based social sanctions have received indirect normative recognition through restorative justice mechanisms in Law Number 11 of 2012, Prosecutor Regulation Number 15 of 2020, Supreme Court Regulation Number 1 of 2024, and the social work punishment policy in Law Number 1 of 2023. The study also finds that Regional Regulations may serve as derivative policy instruments to accommodate public apology, community service, moral restitution, and customary obligations, provided that they remain participatory, non-repressive, accountable, and consistent with Pancasila and constitutional guarantees. Such institutionalization is legally possible, but it must be limited to restorative measures aimed at restoring social harmony and guiding constitutionally compliant local regulation.

Abstract

Violence against medical and health personnel remains a significant challenge in healthcare services due to its adverse effects on healthcare worker safety, service quality, and the safety culture within hospitals. The low rate of incident reporting, resulting from the absence of an accessible, secure, and integrated reporting mechanism, further limits the effectiveness of violence prevention and response efforts. This community service program aimed to strengthen the violence prevention and response system at Dr. Soeharsono Hospital, Banjarmasin, through capacity building, the development of a Standard Operating Procedure (SOP) for Violence Incident Reporting, the establishment of a Violence Prevention and Response Task Force, and the development of the Fast Response Internal digital reporting mechanism. The program was conducted on June 8, 2026, involving 30 participants consisting of hospital management representatives, medical personnel, and healthcare workers using a participatory, needs-based approach. Program evaluation was carried out using pre-test and post-test instruments, with the results analyzed descriptively. The findings demonstrated an improvement in participants' level of understanding from 49.0% in the pre-test to 95.7% in the post-test. The program also produced several governance instruments, including the organizational structure of the Violence Prevention and Response Task Force, the SOP for Violence Incident Reporting, and the Fast Response Internal digital reporting mechanism integrated with QR Codes, Google Forms, and a monitoring dashboard to support incident reporting, verification, documentation, and systematic follow-up. This program contributes to strengthening hospital governance through the development of an integrated violence prevention and response system and has the potential to be adopted by other healthcare facilities.
