Abstract

In Court Decision Number 2982/Pdt.G/2023/PA.BL, the judge stipulated that infidelity may serve as a legal basis for polygamy. Statutorily, however, such a ground is not recognized within the formal requirements for polygamy under the prevailing Marriage Law. This study examines the use of infidelity as a justification for granting polygamy permits, specifically analyzing the judge's ratio decidendi in Decision Number 2982/Pdt.G/2023/PA.BL and evaluating it through the lens of Imam al-Shatibi’s maqashid al-shari’ah. This research adopts a normative legal method with a case approach. Legal materials are derived from secondary data collected through library research. Data processing involves editing, classifying, analyzing, and concluding, while the analysis of legal materials is conducted qualitatively with a prescriptive approach. The findings demonstrate that Decision Number 2982/Pdt.G/2023/PA.BL is consistent with maqashid al-shari’ah. Regarding the core issue—polygamy on the grounds of infidelity—the petition technically fails to meet the criteria stipulated in the Marriage Law. Nevertheless, the panel of judges exercised judicial discretion, considering various dimensions and emphasizing the substantial harm (mudharat) that would ensue should the petition be rejected. Within the framework of Imam al-Shatibi’s maqashid al-shari’ah, this case intersects with four of the al-kulliyat al-khams (the five essentials): the preservation of religion (hifz al-din), life (hifz al-nafs), lineage (hifz al-nasl), and property (hifz al-mal), as an endeavor to mitigate harm and realize the welfare (maslahah) of humanity.

Abstract

This study examines the acceptance of vasectomy procedures in the family from the perspective of Maqasid al-Sharia, emphasizing the application of sharia objectives in determining the legal and ethical limits of vasectomy implementation. This research focuses on how the principles of the protection of the soul (hifz al-nafs), heredity (hifz al-nasl), reason (hifz al-'aql), religion (hifz al-din), and property (hifz al-mal) can be used as a basis for consideration in the standardization of vasectomy procedures. This research uses a normative qualitative approach through literature studies by analyzing scientific journals, classical and contemporary fiqh literature, and fatwa of the Indonesian Ulema Council. The data were analyzed descriptively and interpretively to identify the relevance between medical procedures and the principles of Islamic law. The results of the study show that vasectomy can be accepted on a limited and conditional basis in Islam if it is done based on medical needs, consent of both partners, in accordance with medical standards, and considering the benefits that outweigh the potential harms. In addition, the procedure must not contradict the basic principles of sharia and must remain within the framework of maintaining family welfare and social harmony. The study concludes that the standardization of vasectomy procedures is essential to ensure medical safety, ethical responsibility, and conformity with the objectives of Maqasid al-Sharia. Therefore, systematic and structured guidelines are needed so that the practice of vasectomy can be carried out safely, ethically, and in accordance with sharia principles in the life of modern society.

Abstract

Konsep hidup yang terus berubah dan berlanjut dari generasi kegenerasi, membuat kebutuhan dan permasalahan kehidupan turut berkembang, banyak permasalahan yang baru yang belum dipecahkan jawabannya di era ulama salaf dulu, sehingga ijtihad yang terbaharu menjadi solusi untuk menjawab permasalahhan-permasalahan tersebut, seperti ijtihad al intiqa’I dan ijtihad al insya’I, yang mana keduanya memiliki karakter dan cara kerja sendiri dalam proses penemuan hukum permasalahan era modernisas ini. Penelitian ini merupakan jenis penelitian normatif dengan menggunakan conseptual approach. Adapun hasil yang dapat diperoleh dalam penelitian ini yakni, diketahuinya bahwa terdapat model-model ijtihad yang baru selain model yang telah ada pada masa ulama salaf, dalam memecahkan permasalahan Islam yang terbaharukan.

Abstract

The fire that occurred in Kroya Market, Cilacap, significantly impacted traders, particularly regarding the fulfillment of financial support within families. In Islam, the husband is responsible for providing for his wife and children, as emphasized by Wahbah al-Zuhaili in Fiqh Islam wa Adillatuhu, which outlines the scope of nafkah (financial support). This study aims to describe the fulfillment of husbands’ financial support for their wives—traders at Kroya Market—after the fire, through Wahbah al-Zuhaili’s perspective.This empirical juridical study uses a qualitative approach with data gathered through interviews, observation, and documentation. Primary data came from informant interviews, while secondary sources included literature studies.The findings show that overall fulfillment of financial support for wives decreased due to the fire. Out of the five aspects of nafkah, only food, housing, and household furnishings were adequately fulfilled in line with Wahbah al-Zuhaili’s views. Although the provision of domestic help was unmet, it remains justifiable in light of financial constraints. Clothing provision showed inconsistencies. Despite these challenges, husbands continued striving to fulfill obligations according to their capacity.
