Abstract

This paper aims to find out the Legal Sanctions d for Perpetrators of Infidelity Allegations and their evidentiary mechanisms according to the Customary Law of Lubuk Ruso Village, Pemayung District, Batang Hari Jambi Regency. This research uses Descriptive Qualitative research with data collection methods carried out by observation, interviews and documentation. Based on the research that has been carried out, the following results and conclusions are obtained: Allegations of infidelity according to customary law are proven by the presence of witnesses and oaths in the trial. Customary institutions in enforcing the law on perpetrators of allegations of infidelity (slander) are based on the eight-year-old regulations in the dago-dagi article, namely all forms of acts that violate the common/public interest, causing domestic chaos. Such as mistakes against the government, making slander (provocations) and creating domestic chaos. The punishment was a full, double-folded wake, namely a buffalo, 800 bushels of rice, 800 coconuts, 8 sacks of white cloth and a bag of semanih. Meanwhile, according to the traditional head in the form of buffalo, rice, coconut, semanic selemak, asam segamo, eaten by many people. These sanctions/fines are first discussed by the customary apparatus, then the sanctions/fines imposed are in accordance with the results of the rembukan carried out by the customary apparatus. If the perpetrator cannot pay the sanction, then his heirs can help pay it, if no one can pay the claim then it can be sued in court

Abstract

Abstract: This paper aims to find out the sanctions for adultery perpetrators in the “adat” law of Batang Hari, Jambi Province, to be precise in Lubuk Ruso Village. Adultery according to local custom is an act that cannot be justified, therefore custom regulates sanctions against anyone who commits adultery in the village of Lubuk Ruso. The sanction is in the form of a fine of one goat and 100 rice paid in cash. In addition to this, adulterers are also given social sanctions in the form of exile from their hometown for one year, the aim is to prevent the village from disaster due to adultery. The implementation of customary law sanctions against perpetrators of adultery, although not exactly the same as the provisions contained in the ghoiru muhson adultery sanctions in Islamic law, cannot be separated from the influence of Islamic values in practice as in the traditional slogan "adat with syara' syara' besendi Kitabullah. Sayara' mengato adat wears. "Therefore, customary law in Batang Hari Regency needs to be maintained and preserved as a repertoire of Islamic local wisdom that is linked to  socio-cultural and socio-philosophical values of Indonesian society. Abstrak: Tulisan ini bertujuan untuk mengetahui sanksi pelaku zina dalam hukum adat Kabupaten Batang Hari Propinsi Jambi tepatnya di Desa Lubuk Ruso. Perzinahan menurut adat setempat merupakan perbuatan yang tidak dapat dibenarkan oleh karena itu adat mengatur sanki terhadap siapaun yang melakukan perbuatan zina di desa Lubuk Ruso. Sanksi tersebut berupa denda satu ekor kambing dan 100 gantang beras yang dibayarkan secara tunai. Selain hal tersebut pelaku zina juga diberikan sanksi sosial yang berupa pengasingan dari kampung halaman mereka selama satu tahun, tujuannya untuk menghindarkan kampung tersebut dari bencana karena perbuatan zina. Implementasi sanksi hukum adat terhadap pelaku zina,  meskipun tidak sama persis dengan ketetapan yang ada pada sanksi zina ghoiru muhson dalam hukum Islam, tidak lepas dari pengaruh nilai-nilai Islam dalam pengamalannya sebagaimana sloko adat “adat bersendi syara’ syara’ besendi kitabullah. Sayara’ mengato adat memakai.”Oleh karena itu Hukum adat di Kabupaten Batang Hari perlu untuk dijaga dan dilestarikan keberadaannya sebagai khasanah kearifan lokal bermuatan Islami yang bertautan dengan nilai-nilai sosio-kultural dan sosio-filosofis masyarakat Indonesia

Abstract

Keadilan Tuhan menjadi salah satu isu teologis sentral dalam Islam. Mu'tazilah dan Ahlu Sunnah, dua aliran teologi utama dalam Islam, memiliki pandangan yang berbeda tentang konsep ini. Tulisan ini bertujuan untuk memberikan gambaran umum tentang perdebatan teologi antara Mu'tazilah dan Ahlu Sunnah tentang keadilan Tuhan. Ahli sunnah dalam tulisan ini difokuskan pada dua paham besar yakni, Ash’ariyah dan Maturidiyah. Tulisan ini menggunakan metode deskriptif-analitik. Data dikumpulkan dari berbagai sumber primer dan sekunder, seperti buku, artikel, dan jurnal ilmiah. Hasil dari pembahasan ini adalah Perbedaan pendapat yang terjadi antara aliran Mu’tazilah dan Ahlu Sunnah dilatar belakangi oleh dua hal; Pertama.Pemahaman tentang kebebasan manusia: Mu'tazilah menekankan kebebasan manusia dalam bertindak, sedangkan Ahlu Sunnah menekankan kemahakuasaan Tuhan atas segala sesuatu, termasuk tindakan manusia. Kedua, Pemahaman tentang keadilan Tuhan dalam memberikan reward dan punishment. Mu’tazilah berpendapat bahwa Tuhan akan mengadili manusia berdasarkan perbuatannya. Keadilan Tuhan harus dipandang kesesuaian untuk membei reward bagi yang beramal baik dan punishment bagi yang berbuat salah. Perbuatan manusia, menurut Mu'tazilah, berasal dari dirinya sendiri dan bukan diciptakan oleh Tuhan. Di sisi lain Ahlu Sunnah memiliki perbedaan pandangan dalam hal ini. Ash’ari berpendapat Tuhan dengan kehendak absolutnya dapat memasukkan manusia yang taat ke neraka atau manusia yang bermaksiat ke surga. Keadilan Tuhan, menurut Ash'ari, tidak terikat pada konsep reward dan punishment manusia. Sedangkan Maturidi berpendapat Tuhan tidak mungkin melakukan hal tersebut karena akan berdampak pada janji dan ancaman Tuhan yang telah ditetapkanNya sendiri’. Namun demikian manusia tidak memiliki kemampuan untuk menentukan hal “baik” dan “buruk” yang menyebabkannya masuk surga atau neraka.

Abstract

Artikel ini membahas bimbingan perkawinan yang diberikan kepada calon pengantin khususnya perempuan, dalam mempersiapkan peran sebagai istri dan ibu. Fokusnya pada materi bimbingan, kesiapan mental calon pengantin, serta persepsi perempuan terhadap esensi dan perannya setelah menikah. Penelitian ini menggunakan metode kualitatif dengan studi kasus di KUA Kecamatan Lohbener, melalui observasi partisipan, wawancara mendalam, dan dokumentasi. Temuan utama mencakup desain pendidikan pranikah memiliki materi yang meliputi strategi kesiapan mental menghadapi pernikahan dan pemahaman atas peran perempuan untuk mendewasakan usia menikah pertama. Meskipun materi yang diberikan mencakup aspek hukum, ekonomi, dan manajemen rumah tangga, namun belum menjangkau materi psikologis yang disampaikan oleh para ahli seperti psikolog.   This article discusses premarital counseling provided to prospective brides, particularly women, in preparing them for their roles as wives and mothers. The focus is on the counseling material, the mental readiness of brides-to-be, and women's perceptions of the essence and their roles after marriage. This research employs a qualitative method with a case study conducted at the Office of Religious Affairs (KUA) in Lohbener District, utilizing participant observation, in-depth interviews, and documentation. The key findings reveal that the design of premarital education includes material covering strategies for mental readiness in facing marriage and understanding women's roles in ensuring maturity at the time of their first marriage. Although the material addresses legal, economic, and household management aspects, it does not yet cover psychological topics delivered by experts such as psychologists.

Abstract

Purpose – This study aims to analyze the impact of animated content on the NU Kids YouTube channel on traditional Islamic education for early childhood by examining viewership metrics, community engagement, behavioral changes in children, and how these animations integrate character education, appreciation for local traditions, and the formation of a moderate religious identity. Design/methods/approach – A netnographic approach was employed to observe and analyze 7 out of 13 available videos on the NU Kids Sumenep channel. These 7 videos were selected based on their thematic relevance to the research objectives, focusing on the portrayal of Nahdlatul Ulama’s history, character education, and the development of religious identity. Thematic analysis was used to identify key themes in these videos, including representations of Nahdlatul Ulama history, character education, and the development of religious identity. Findings – The findings indicate that NU Kids animations successfully promote traditional Islamic values rooted in local traditions. For instance, episodes such as "The Founding of Nahdlatul Ulama" and "The Story of Kiai Hasyim Asy'ari" emphasize respect for elders, community solidarity, and the integration of Islamic principles with local customs, which resonate deeply with audiences. The channel effectively builds a strong digital community and strengthens the collective identity of the NU community in the era of globalization. Research implications/limitations – The study is limited to the community analyzed, which may be confined to those already affiliated with Nahdlatul Ulama. The research primarily relies on public data such as view counts and comments, which may not fully reflect long-term impacts. Practical implications – This study demonstrates that digital media, such as YouTube, can be an effective tool for disseminating traditional Islamic teachings to young audiences. The findings could influence the development of educational content based on local values in the future. Originality/value – This research provides new insights into the role of digital media in traditional Islamic education, particularly in early childhood education, by demonstrating how platforms like NU Kids integrate local cultural narratives with religious teachings, employ storytelling and digital tools to foster collective identity, preserve traditional values, and shape the younger generation's identity in a rapidly globalizing world. Abstract

Indonesia-Malay scholars in the past have paid great attention to hadith, but a special work which prescribes hadiths with Sufism nuances, Shaykh Yusuf was the initial figure who started it. However, studies on Shaykh Yusuf’s tasawuf thought have so far focused more on tasawuf itself, paying little attention to hadith’s aspects. This article discusses the intersection of Sufism and hadith in Shurūṭ al-ʻĀrif al-Muḥaqqiq by Shaykh Yusuf, a work that elaborate two hadiths: qalb al-mu’min ʻarsh Allāh and man ʻarafa nafsah fahuwa ʻarafa rabbah. This paper shows that from the hadith of qalb al-mu’min ʻarsh Allāh emerged the key terms such as al-qalb, al-insān al-kāmil, al-iḥāṭah, al-maʻiyyah, and conditions al-ʻārif al-muḥaqqiq borrowed from earlier Sufis such as Junayd al-Baghdadi, al-Ghazali, Ibn ʻArabi and others. However, Shaykh Yusuf’s creativity lies in his elaboration of these five key terms as the basis for the intersection of hadith and tasawwuf in the hadith man ʻarafa nafsah fahuwa ʻarafa rabbah i.e. those who know themselves, then realize that they do not exist, all that exists is Being al-Ḥaqq, so that he also proceeds to become a perfect person, al-insān al-kāmil. Para ulama nusantara telah menaruh perhatian besar terhadap hadis, tetapi suatu karya khusus yang mensyarahkan hadis-hadis bernuansa tasawuf, Syaikh Yusuf merupakan tokoh awal yang mengawalinya. Hanya saja, kajian-kajian terhadap pemikiran tasawuf Syaikh Yusuf selama ini lebih difokuskan pada tasawuf itu sendiri, kurang memperhatikan aspek hadis. Tulisan ini mendiskusikan persinggungan tasawuf dan hadis dalam Shurūṭ al-ʻĀrif al-Muḥaqqiq karya Syaikh Yusuf, sebuah karya yang mensyarahkan dua hadis: qalb al-mu’min ʻarsh Allāh dan man ʻarafa nafsah fahuwa ʻarafa rabbah. Tulisan ini merupakan kajian pustaka dimana sumber utamanya dari bahan-bahan kepustakaan. Tulisan ini menyimpulkan bahwa dari hadis qalb al-mu’min ʻarsh Allāh muncullah istilah-istilah kunci seperti al-qalb, al-insān al-kāmil, al-iḥāṭah, al-ma‘iyyah, dan syarat-syarat al-‘ārif al-muḥaqqiq yang ia pinjam dari para sufi terdahulu seperi Junayd al-Baghdadi, al-Ghazali, Ibnu ‘Arabi dan lain-lain. Hanya saja, kreatifitas Syaikh Yusuf terletak pada elaborasinya terhadap kelima istilah kunci tersebut sebagai landasan terhadap persinggungan hadis dan tasawuf pada hadis man ʻarafa nafsah fahuwa ʻarafa rabbah, yakni orang yang kenal akan dirinya, maka sadar bahwa ia tidak ada, yang ada hanyalah Wujud al-Ḥaqq, sehingga ia berproses menuju insan paripurna, al-insān al-kāmil.

Abstract

This study aims to analyze cryptocurrency fatwas issued in two countries: Malaysia and Indonesia. The objectives include identifying the fatwas related to cryptocurrency, examining the similarities and differences between the two, and understanding the reasoning behind them. The research employs a qualitative approach using library research and document analysis as data collection methods. The findings reveal two main points: First, scholars hold differing opinions on cryptocurrency some deem it impermissible (haram), while others consider it permissible (halal). Second, both Malaysia and Indonesia share a common stance in their fatwas by not recognizing cryptocurrency as legal tender or a valid means of payment, as it contradicts national regulations and monetary laws.
