Abstract

Khul' or divorce requested by a wife is one of the causes marital termination. According to Imam Syafi'i, khul' is a divorce (talak) with an 'iddah of three menstruat cycles. In contrast, for Imam Hanbali, khul' is fasakh in which its 'iddah is one menstrual cycle and its legality does not require a judge's decision. This difference has dissimilar legal implications when it is applied in Indonesia. Therefore, this article aims to seek the both relevancies in the context of Indonesian law, especially under the Compilation of Islamic Law and the nature of the religious practice of Indonesian Muslims. After examining the relevant literature sources, this article shows that, both Imam Syafi'i and Imam Hanbali agree that khul' is like a buy-sell contract, and hence a judge's decision is not required. However these both agremeents are not relevance under the Compilation of Islamic Laws, but the Imam Hanbali's fiqh in which khul' as fasakh would be difficult to seek its relevance. Thus, the fiqh of Imam Syafi'i is more appropriate, since beside it is used as a basis for the Compilation of Islamic Laws the majority of Indonesian Muslims embrace the Syafi’i mazhab.

Abstract

Tulisan ini mendiskusikan pertanggungjawaban pidana terhadap orang yang menyuruh untuk melakukan penganiayaan terhadap orang lain (doen pleger) dan atau orang yang disuruh (dader) menurut hukum pidana Islam dan Kitab Undang-Undang Hukum Pidana (KUHP). Kedua hukum ini bertujuan untuk menimbulkan efek jera kepada pelaku tindak pidana serta pengajaran kepada orang lain untuk tidak mengikutinya. Hanya saja, adanya perbedaan sumber hukum pada kedua hukum ini berimplikasi kepada perbedaan sanksi kepada doen pleger dan dader. Untuk mengungkap perbedaan sanski ini, tulisan ini menggunakan pendekatan kajian hukum perbandingan. Data-data didapatkan dari sumber kepustakaan yang relevan. Hasilnya menunjukkan bahwa dalam hukum Islam, doen pleger dikenakan hukuman taʻzir, sementara menurut KUHP sanksi kepada doen pleger sama dengan dader atau orang yang melakukannya. Perbedaan sanksi ini akibat perbedaan sumber keduanya, hukum Tuhan dan hukum manusia. Namun persamaannya terletak pada sama-sama memberikan efek jera kepada pelaku tindak pidana serta pengajaran kepada orang lain untuk tidak menirunya.

Abstract

The arrival of Islam into the lands below the winds, the terminology used to designate the Malay-Indonesian world or the entire South East Asia, was inseparable from the influence of Māturidīyya and Ashāʿira in kalām. This influence was reflected in the translation works or the commentaries upon ʿAqāʾid al-Nasafī of Imam al-Nasafī in the seventeenth century. The eighteenth century and onwards also saw a rapid appearance of the translations, commentaries,ḥāshiya, and taʿlīq of Umm al-Barāhīn of Imam al-Sanūsī. In Jambi, in the early twentieth century, Tuan Guru Abdul Jalil synthesized the worldview of kalam of al-Māturidīyya and Ashāʿira in his work, Minhāj al-Umniyya fī Bayān ʿAqīdāt al-Ahl al-Sunna wa al-Jamāʿā. The result of his endeavor was an epistemology of kalām that was established upon the classical intellectual legacy of Islam. Amid the hegemony of the Western epistemology on the general modern epistemology and, specifically, that of Islam, this article attempts to discuss the epistemology of Tuan Guru Abdul Jalil in order to answer the bewilderment of the modern epistemology. After analyzing the work of Tuan Guru Abdul Jalil along with other relevant results, this article shows that the epistemology of Tuan Guru Abdul Jalil is powerfully relevant in the current debates about epistemology. Datangnya Islam ke ‘negeri bawah angin’, suatu istilah pada masa lalu yang merujuk kepada dunia Indonesia-Melayu atau Asia Tenggara secara keseluruhan, tidak terlepas dari pengaruh kalam Māturidīyyah dan Ashāʻirah. Hal ini tampak dari lahirnya karya-karya dalam bentuk terjemahan dan ulasan terhadap ʻAqāʼid al-Nasafī karya Imam al-Nasafī pada abad ke-17. Semenjak abad ke-18 dan seterusnya, muncul pula ulasan-ulasan terhadap Umm al-Barāhīn karya Imam al-Sanūsī dalam bentuk terjemahan, ḥāshiyah, taʻlīq dan sebagainya secara masif. Di Jambi, pada awal abad ke-20, ada Tuan Guru Abdul Jalil yang mensintesiskan antara kalam Māturidīyyah dan Ashāʻirah dalam karyanya Minhāj al-Umniyyah fī Bayān ʻAqīdat Ahl al-Sunnah wa al-Jamāʻah. Hasilnya, terbentuklah suatu epistemologi dalam bingkai kalam berlandaskan pada tradisi keilmuan Islam klasik. Di tengah hegemoni epistemologi Barat dalam bangunan epistemologi modern umumnya dan kajian keislaman khususnya, tulisan ini mendiskusikan epistemologi Tuan Guru Abdul Jalil untuk menjawab kerancuan-kerancuan epistemologis modern tersebut. Setelah menelaah karya Tuan Guru Abdul Jalil dan karya-karya yang relevan lainnya, tulisan ini menunjukkan bahwa epistemologi Tuan Guru Abdul Jalil masih sangat relevan dalam memberikan tawaran-tawaran epistemologis saat ini.

Abstract

Scholars are divided into two groups in assessing the relationship between Islam and the West. Some see it as a clash, while others propose a tolerance thesis. As a result, there is an ongoing debate. However, this paper will negate both. Therefore, this paperwill contextualize this relationship from a historical standpoint and assess its trajectory. This paper is a literature study that takes the sources from library data. By taking scientific cooperation and conflict, crusades and economic cooperation, imperialismagainst the Islamic world, and tolerance of captive colonialists as examples, this paper shows that the relationship between Islam and the West is not unidirectional but multidirectional. Competition, conflict, and cooperation served both interests simultaneously. The interests of religion, knowledge, politics, economy, and culture before, during, and after colonization made the relationship both competitive, conflicting, and cooperative. Thus, the implication of this article is to refute Huntington’s theory and his critics by some scholars.

Abstract

Distorsi artinya pemutarbalikan suatu fakta, aturan serta penyimpangan. Dihubungkan dengan maqāṣid al-syarīʿah al-Syāṭibī, maksudnya pemutarbalikan dan penyimpangan dalam mentafsir, mengguna dan menerapkan maqāṣid tersebut untuk tujuan tertentu. Tulisan ini mendiskusikan distorsi terhadap maqāṣid al-syarīʿah al-Syāṭibī di Indonesia. Sampelnya adalah Siti Musdah Mulia, Budhy Munawar Rachman dan Nasaruddin Umar. Untuk menguji distorsi tersebut, tulisan ini menggunakan analisis perbandingan. Tulisan ini menunjukkan bahwa distorsi terhadap maqāṣid al-syarīʿah al-Syāṭibī diakibatkan oleh sikap tidak amanah dalam menggunakan data, pandangan dunia (worldview) dan kerangka epistemologi (epestemic framework) yang bermasalah, dimana maqāṣid al-syarīʿah al-Syāṭibī dijadikan sebagai alat untuk membela lesbian, gay, bisexual, and transgender (LGBT), atau untuk mempertahankan pandangan tentang pluralisme agama serta untuk meliberalkan kaidah al-ʿibrah bi maqāṣid al-syarīʿah lā bi ʿumūm al-naṣṣ aw bi khuṣūṣ al-sabab.

Abstract

Human rights activists and the educated urban society strongly criticize the practice of early marriage, including the classical fiqh on which it is based. They have repeatedly proposed amendments to article 7 of the Marriage Law No. 1 of 1974 concerning age restrictions on marriage. This paper is a response to these groups’ views with the formulations, first, what are the factors and the problems of early marriage and their status in the perspective of maqāṣid al-sharīʻa?; second, what worldview that projects the human rights activists’ criticism in the midst of living fiqh and maqāṣid al-sharīʻaʼs review on it? This paper is a combination of field and literary studies. Samples are taken from the living fiqh or the doctrine of Shāfiʻī School which exists in the Malay community of Tebo Ulu, Jambi Province and supported by relevant literature. This paper concludes that, in early marriage, the harms are far greater than the benefits. Hence, according to the holistic understanding of maqāṣid al-sharīʻa, the marriageable age needs to be regulated by law. However, the above groups’ criticism is not completely justifiable because early marriage is also closely related to the state's failure in improving the welfare of its citizens, providing educational facilities, as well as differences in worldview between human rights activists and article 284 of the Criminal Law Code on adultery and traditional customs of Malay and other Indonesia’s indigenous custom that need to be resolved.

Abstract

This paper discusses the Islamization of Suku Anak Dalam (Jambi’s people of the jungle/the SAD) in Jambi as well as proves that the Islamization has moved from the realm of aqidah to the deepening of fiqh, especially fiqh al-ṣalāh, unlike previous researchers’ accusations who generalized that animism is still attached to the the SAD who have converted to Islam. This paper applies field study principles combining qualitative and quantitative research methods by applying sociocultural anthropology theory, with a research object being the SAD residing in Pelempang Village, Muaro Jambi. This paper concludes that SAD’s Islamization has succeeded in removing animist teachings that are not in line with Islamic values. However, SAD’s understanding of fiqh al-ṣalāh is still relatively low. This is due to a low level of education, inability to read and write, remote geographical locations, barriers between the SAD and other residents, and the absence of teachers of fiqh al-ṣalāh who teach actively and consistently in the area.

Abstract

The debate on the heresy of waqf al-ahlī (family endowment) in the early 20th century significantly impacted its legality in Muslim countries. In Southeast Asia, with samples from Indonesia, Malaysia, and Singapore, they followed the majority opinion of ulama. They implemented it in the law to improve the management of waqf al-ahlī. This paper examines the legality of waqf al-ahlī from the perspective of fiqh and the Law and its implementation model in the three countries through extensive literature study. The results reveal that the debate on the legality of waqf al-ahlī is more influenced by socio-economic and political factors and misunderstandings about the purpose of waqf rather than theological considerations. Therefore, most Muslim scholars recognise this type of waqf, and it is implemented by most Muslim countries, including the three countries that are the objects of this study. Comparative analysis shows that Singapore achieves higher productivity and efficiency in managing waqf al-ahlī than Indonesia and Malaysia. These findings refute the view of waqf al-ahlī as heresy and emphasise the importance of good governance, a comprehensive legal framework, and efficient management to optimise the potential of waqf al-ahlī as an instrument of sustainable socio-economic development.

Abstract

Indonesia-Malay scholars in the past have paid great attention to hadith, but a special work which prescribes hadiths with Sufism nuances, Shaykh Yusuf was the initial figure who started it. However, studies on Shaykh Yusuf’s tasawuf thought have so far focused more on tasawuf itself, paying little attention to hadith’s aspects. This article discusses the intersection of Sufism and hadith in Shurūṭ al-ʻĀrif al-Muḥaqqiq by Shaykh Yusuf, a work that elaborate two hadiths: qalb al-mu’min ʻarsh Allāh and man ʻarafa nafsah fahuwa ʻarafa rabbah. This paper shows that from the hadith of qalb al-mu’min ʻarsh Allāh emerged the key terms such as al-qalb, al-insān al-kāmil, al-iḥāṭah, al-maʻiyyah, and conditions al-ʻārif al-muḥaqqiq borrowed from earlier Sufis such as Junayd al-Baghdadi, al-Ghazali, Ibn ʻArabi and others. However, Shaykh Yusuf’s creativity lies in his elaboration of these five key terms as the basis for the intersection of hadith and tasawwuf in the hadith man ʻarafa nafsah fahuwa ʻarafa rabbah i.e. those who know themselves, then realize that they do not exist, all that exists is Being al-Ḥaqq, so that he also proceeds to become a perfect person, al-insān al-kāmil. Para ulama nusantara telah menaruh perhatian besar terhadap hadis, tetapi suatu karya khusus yang mensyarahkan hadis-hadis bernuansa tasawuf, Syaikh Yusuf merupakan tokoh awal yang mengawalinya. Hanya saja, kajian-kajian terhadap pemikiran tasawuf Syaikh Yusuf selama ini lebih difokuskan pada tasawuf itu sendiri, kurang memperhatikan aspek hadis. Tulisan ini mendiskusikan persinggungan tasawuf dan hadis dalam Shurūṭ al-ʻĀrif al-Muḥaqqiq karya Syaikh Yusuf, sebuah karya yang mensyarahkan dua hadis: qalb al-mu’min ʻarsh Allāh dan man ʻarafa nafsah fahuwa ʻarafa rabbah. Tulisan ini merupakan kajian pustaka dimana sumber utamanya dari bahan-bahan kepustakaan. Tulisan ini menyimpulkan bahwa dari hadis qalb al-mu’min ʻarsh Allāh muncullah istilah-istilah kunci seperti al-qalb, al-insān al-kāmil, al-iḥāṭah, al-ma‘iyyah, dan syarat-syarat al-‘ārif al-muḥaqqiq yang ia pinjam dari para sufi terdahulu seperi Junayd al-Baghdadi, al-Ghazali, Ibnu ‘Arabi dan lain-lain. Hanya saja, kreatifitas Syaikh Yusuf terletak pada elaborasinya terhadap kelima istilah kunci tersebut sebagai landasan terhadap persinggungan hadis dan tasawuf pada hadis man ʻarafa nafsah fahuwa ʻarafa rabbah, yakni orang yang kenal akan dirinya, maka sadar bahwa ia tidak ada, yang ada hanyalah Wujud al-Ḥaqq, sehingga ia berproses menuju insan paripurna, al-insān al-kāmil.

Abstract

The discourse concerning whether the Qur'an possesses thematic unity has persisted as a subject of prolonged debate throughout history up to the present day. While the majority acknowledges this unity, a minority rejects it. These contrasting perspectives bear significant implications for the methodology of tafsīr al-mawḍū'ī (thematic exegesis): namely, the robustness or fragility of this method. Consequently, this paper examines the historical discourse on Qur'anic thematic unity, contextualizing it with the methodology and urgency of tafsīr al-mawḍū'ī in the modern context to strengthen the foundations of this method. After applying the principles of literature review utilizing historical analysis, this study demonstrates that the discourse on Qur'anic thematic unity falls under the terms naẓm (coherence), siyāq (context), and munāsabah (correlation) in 'ulūm al-qur'ān (Qur'anic sciences), as well as the theory of istiqrā' (induction) in uṣūl al-fiqh (principles of Islamic jurisprudence), all of which are relevant as analytical tools for tafsīr al-mawḍū'ī. Thus, this paper has implications for strengthening the arguments of the group that accepts the unity of meaning in the Qur'an while simultaneously reinforcing the methodological foundations of tafsīr al-mawḍū'ī.
