<![CDATA[Penelitian ini bertujuan untuk mengetahui dan menganalisis mengenai penerapan diversi terhadap anak yang berhadapan dengan hukum di wilayah Hukum Kepolisian Resort Polewali Mandar dan untuk mengetahui faktor-faktor yang mempengaruhi pelaksanaan diversi terhadap anak yang berhadapan dengan hukum di Kepolisian Resort Polewali Mandar. Diversi sebagai salah satu hal yang diatur dalam Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak adalah merupakan pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana dan dari hasil penelitian yang dilakukan ternyata ditemukan fakta bahwa pelaksanaan diversi pada tahap penyidikan oleh Kepolisian Resort Polewali Mandar belum efektif terlaksana sebagai upaya meminimalisasi penggunaan penjara bagi anak yang berhadapan dengan hukum. Faktor-faktor yang mempengaruhi pelaksanaan diversi terhadap anak yang berhadapan dengan hukum adalah faktor substansi hukum, faktor struktur hukum, faktor sarana yang tersedia, dan faktor kemampuan SDM yang dimiliki oleh Polri khususnya penyidik anak. This study aims to identify and analyze about the implementation of the diversion of children in conflict with the law territory of juridiction Polres Polewali Mandar and for aware factor that effect the applicationof the diversion of children in conflict with the law in the criminal justice system on Polres Polewali Mandar.Diversion one of the things regulated juvenile settlement of the criminal justice processto the outside of the criminal justice process and of the research result have found that investigation phase has not been effectively implemented police in an effort to minimize the use of inprisonment for children in conflict with the law. Factors that effect the application of diversion in dealing in conflict with the law is a legal substance factor, factor structure of law, factor available facilities, and human resource capacity factor police investigators especially children.]]>
