Abstract

Penelitian bertujuan menganalisis pelaksanaan pengangkatan anak dan akibat hukumnya di Pengadilan Agama Makassar Kelas IA, dan faktor-faktor yang mempengaruhi. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: Pelaksanaan pengangkatan anak di Pengadilan Agama Makassar Kelas 1A telah berjalan secara efektif sesuai dengan kewenangan Pengadilan Agama yaitu, memeriksa dan mengadili asal-usul anak dalam bentuk penetapan pengangkatan anak yang telah sesuai ketentuan peraturan perundang-undangan yang berlaku, akibat hukum yang timbul yaitu tidak mengubah status nasab, perwalian dan kewarisan terhadap orang tua kandungnya dari anak angkat tersebut, namun dalam hal kewarisan anak angkat berhak mendapatkan warisan dari orang tua angkatnya berupa wasiat wajibah. Faktor yang mempengaruhi dilakukannya pengangkatan anak pada Pengadilan Agama Makassar Kelas IA antara lain: substansi hukum, budaya hukum dan psikologi hukum. This study aims to analyze the implementation of adoption and its legal consequences in the Class IA Makassar Religious Court, and the factors that influence it. This type of research is juridical empirical. The results of the authors' research found that: The implementation of adoption in the Class 1A Makassar Religious Court has been effective in accordance with the authority of the Religious Court, namely, examining and judging the origin of the child in the form of adopting a child in accordance with the provisions of the applicable laws and regulations, The law that arises is that it does not change the status of the lineage, guardianship and inheritance of the biological parents of the adopted child, but in the case of inheritance the adopted child is entitled to inheritance from the adoptive parents in the form of compulsory will. Factors that influence the adoption of children at the Class IA Makassar Religious Court include: legal substance, legal culture and legal psychology.

Abstract

The enforcement of administrative restrictions on interfaith marriage following Supreme Court Circular (SEMA) No. 2/2023 has triggered a rise in silariang (elopement) cases in South Sulawesi, risking communal conflict due to clashing triadic jurisdictions (state, Islam, and adat). This study aims to conceptualize Ammotere Abbaji as a culturally embedded victim-offender mediation mechanism within Bugis-Makassar customary law and design a model for its integration into the national criminal justice system. Utilizing an empirical legal method within a qualitative socio-legal framework, this study gathered primary data through a series of in-depth interviews with key informants in South Sulawesi (including customary leaders, religious figures, and law enforcement officers), validated through source triangulation and non-participant observation of tudang sipulung communal deliberations. The qualitative analysis was theoretically reinforced by a secondary review of the sociometric mathematical modeling of marital disputes. The results indicate that Ammotere Abbaji substantively merges the ethical values of Siri’ na Pacce and Islamic Ishlah principles to facilitate organic community-level conflict resolution. However, this customary settlement remains impeded by dual-processing at the police level and administrative registration barriers. This study concludes the necessity of designing a three-level (normative, procedural, and rights-protection) 'Restorative Pluralism Framework' (RPF) under the substantive Penal Code (Law No. 1/2023) and the new Criminal Procedure Code (Law No. 20/2025) to guarantee the protection of women's agency and a just interfaith legal diversity governance.
