Abstract

Ekonomi syariah merupakan ilmu yang hadir sebagai solusi alternatif dari ekonomi sistem konvensional yang tidak berhasil dalam menciptakan kesejahteraan bagi seluruh manusia. Ilmu ekonomi konvensional diduga tidak ada peran keilmuan Islam dalam catatan sejarahnya seperti diungkpkan Schumpeter dalam the great gap-nya. Padahal beberapa ilmuwan justru menulis bahwa ilmu pengetahuan Yunani-Helenistik didapatkan kelompok terpelajar Eropa saat ini berkat tulisan muslim yang memodifikasinya dan memberikan nilai tambah padanya sebagaimana dinyatakan oleh Mehdi Nakosteen. Maka tentu diperlukan penelusuran keberadaan teori-teori ekonomi konvensional dalam kitab dan buku Islam klasik. Untuk membuktikan bahwa Ilmu Ekonomi Konvensional tumbuh begitu saja dari zero dan tidak pula bahwa Ilmu Ekonomi Islam sebagai bagian dari sejarah kelahiran ekonomi konvensional. Pada beberapa literatur Islam klasik dapat ditemukan beberapa teori dasar ekonomi konvensional yang tidak hanya mirip tapi juga persis samasecara utuh. Pada literatur Islam klasik akan kita temukan teori dasar seperti kebutuhan manusia yang tidak terbatas, teori nilai, teori produksi, teori penawaran dan permintaan, mekanisme harga pasar dan lain-lain. Demikian ini membuktikan bahwa ilmu ekonomi Syariah (Islam) bukanlah konsep dan sistem baru yang sama sekali tidak eksis dalam ilmu pengetahuan.

Abstract

The rapid growth of the global halal food market has intensified the need for effective halal traceability across increasingly complex supply chains. Despite mandatory halal certification policies in Indonesia, maintaining halal integrity throughout the entire supply chain remains a significant challenge, particularly in the food service sector. This study aims to identify priority criteria for halal traceability supply chain management and to develop an integrated strategic framework by combining the Supply Chain Operation Reference (SCOR) model version 14.0 with the Analytic Hierarchy Process (AHP). A quantitative descriptive–analytical approach was employed, focusing on a restaurant enterprise in Bandung, Indonesia, operating a centralized supply chain system with 105 outlets. Expert judgments were collected through AHP questionnaires, supported by interviews and focus group discussions. The SCOR framework was used to structure supply chain processes, while AHP was applied to determine the priority weights of halal traceability criteria and sub-criteria. Consistency of judgments was ensured using the Consistency Ratio threshold of 0.10. The results indicate that the Fulfill process is the most critical stage in ensuring halal traceability, followed by Source and Transform, while Plan and Order play supporting roles. At the sub-criteria level, halal integrity during delivery emerged as the most critical factor, highlighting the vulnerability of downstream logistics to halal non-compliance. The integration of SCOR and AHP enabled the development of a priority-based strategic framework that aligns process importance with performance metrics and improvement actions. This study contributes to halal supply chain management literature by transforming SCOR from a descriptive process model into a prescriptive decision-support framework. From a practical perspective, the proposed SCOR–AHP framework provides actionable guidance for prioritizing resources, strengthening halal logistics governance, and enhancing the effectiveness, efficiency, and sustainability of halal traceability systems in the food industry

Abstract

Financial service activities provided by Islamic banking in Indonesia are applied with various service contracts such as wakalah, hawalah and kafalah. In its current operation, the service contract is still an issue that is discussed, especially regarding the suitability of the contract for sharia requirements. The purpose of this research is to analyze the service contracts of Islamic banks in the review of fiqh muamalah maliyah. The type of qualitative research used in this research describes descriptively to share a clear reflection of the application of contracts used in service products provided by Islamic banks. Literature research in this research is attempted by collecting data both in the form of a novel diary of Fatwa DSN, KHES to strengthen the conclusion. The results of this research describe the operational concepts of service contracts: wakalah, hawalah and kafalah in Islamic banking. Furthermore, the findings in this research state that the service contracts on wakalah, hawalah and kafalah contracts applied to various products in Islamic banking are suitable in the review of fiqh muamalah maliyah.

Abstract

Penelitian ini mengkaji putusan atas perkara penyalahgunaan keadaan (misbruik van omstandigheden) dalam perjanjian kredit, adendum, dan restrukturisasinya. Penyalahgunaan keadaan dilakukan dengan cara memberikan bunga kredit yang tinggi, padahal tergugat mengetahui kondisi para penggugat sedang dalam kesulitan finansial akibat gagalnya rencana ekspansi bisnis. Berdasarkan gugatan tersebut, pengadilan tingkat pertama mengabulkan gugatan para penggugat, dan kemudian dikuatkan oleh pengadilan tingkat banding. Namun, putusan pengadilan tingkat banding dibatalkan di tingkat kasasi oleh Mahkamah Agung. Berdasarkan latar belakang, masalah yang diangkat adalah bagaimana pertimbangan hakim dalam putusan pengadilan tingkat pertama, banding, dan kasasi? dan bagaimana unsur-unsur penyalahgunaan keadaan dalam putusan kasasi. Jenis penelitian ini merupakan penelitian hukum normatif. Objek kajiannya berupa penemuan hukum pada putusan pengadilan. Pendekatan penelitian yang digunakan, yaitu pendekatan kasus, konseptual, dan peraturan perundang-undangan. Analisis bahan hukum menggunakan metode content analysis dengan cara melakukan pengkajian dan penafsiran terhadap fakta hukum, pertimbangan hukum, dan amar putusan. Penelitian ini menyimpulkan bahwa pertimbangan majelis hakim tingkat pertama dan tingkat banding tidak memperhatikan unsur-unsur penyalahgunaan keadaan sebagai dalil hukum dalam gugatan para penggugat, sehingga terdapat kekeliruan dalam menerapkan dalil hukum terhadap peristiwa dan fakta hukum di persidangan; terdapat dua unsur perbuatan penyalahgunaan keadaan, yaitu penyalahgunaan keadaan karena keunggulan ekonomi; dan keunggulan psikologis. Suatu perbuatan dikatakan sebagai penyalahgunaan keadaan, apabila dilakukan pada saat sebelum dan saat penutupan perjanjian.

Abstract

Background: This article analyzes the effects of religiosity, poverty, health, and education on the Islamic Human Development Index (I-HDI) in West Java during 2020-2024, with economic growth positioned as an intervening variable. Method: Using a quantitative descriptive-verificative design, the study employs secondary panel data from 21 regencies/cities over five years, resulting in 105 observations. Fixed Effect Model regression, path analysis, and the Sobel test were processed with EViews 10. Results: Religiosity and poverty have negative significant effects on I-HDI, with coefficients of -0.3421 (p=0.0002) and -0.5123 (p=0.0000). Health, education, and economic growth have positive significant effects, with coefficients of 0.6789, 0.3891, and 0.4123. Economic growth partially mediates health and education but does not mediate religiosity and poverty. The model explains 81.23 percent of I-HDI variation. Conclusion: West Java recovered economically, but maqasid-based human development remained low. In 2024, I-HDI reached 52.72, below conventional HDI of 74.92, indicating the need for moral-security strengthening, spatial poverty reduction, health protection, and education reform.
