Abstract

The practice of buying and selling online, a seller is required to be not deliberate contradiction between words and deeds in his business. The seller must have a mandate by displaying an attitude of openness, honesty, optimal service, and doing good with everything, let alone relating to community service. That there are some problems that occur in buying and selling online (online). Among these are sellers who post pictures on Shoppe that don't match the original. This study aims to explain the application of Islamic business ethics in Shopee's online store. This type of research is juridical-normative or normative legal research. the nature of this research is descriptive-analysis research. Primary data is research material in the form of rules, norms about Islamic business ethics and documented online trading concepts. Data collection techniques in this study used literature, documentation and interviews. Data analysis technique is done by inductive thinking. The results showed that: the application of Islamic business ethics in the practice of buying and selling online (online) at Shopee's online store, has not implemented Islamic business ethics. Because there are still lies and also post pictures that are not in accordance with the original.

Abstract

Abstract If a business wants to develop into large , it is necessary as a means of advertising and promotion for the introduction of memory products to the public . In making the ads required elements are very influential in the success of the advertisement so as to boost sales. Business according to fiqh perspective included in muamalah that allows the human to one another conduct transactions or civil relations . In terms muamalah , any activity is allowed as long as no arguments proscribe ( al - ashlu fil - mu'malah illa al - ibahah ayyadulla dalilun ' ala tahrimiha ) . Trading activities are permissible in Islam as long as there are no elements that conflict with Personality ' such as the element of maysir, gharar and riba. This means that in sharia marketing , the entire process of creating a good process , bidding process , and the process of change in value there should not be things that are contrary to the contract and the principles of Islamic economic . The extent they can be guaranteed and irregularities muamalah Islamic principles does not occur in a transaction or in the form of business processes in the marketing of any transaction can be allowed Keywords: Ethics, Advertising, Islamic business

Abstract

The protection of Muslim consumers against halal products is not just halal labeling contained in the Food Law, but must have integrity of other economic laws, so there is guarantee of the implementation of halal labeling. This is closely related to matters of a business nature, such as trade agreements, distribution, advertising, packaging, negligence and misuse of halal labeling. This paper concludes that first, the position of Muslim consumer protection against halal products in Islamic Economic Law has a great attention. Second, the concept of Muslim consumer protection against halal products in Indonesian Economic Law has a strong juridical foundation, that is stated in the 1945 Constitution Article 29 paragraph (1) and (2), which contains about the freedom to implement religious shari'ah. Third, basically the Indonesian Economic Law contains the protection of Muslim consumers against "labeling and Halal certification "almost entirely contains the halal provisions and patterns of Muslim food in Islamic Law.

Abstract

This article aims to describe the state’s role in guaranteeing and protecting Muslim consumers in Indonesia to obtain halal products. This article is a normative legal research which is conducted by exploring principles and norms. The conclusion of this article is that the role of the state in protecting Muslim consumers from prohibited products can be seen from two perspectives, namely the Islamic perspective and the Indonesian constitution perspective. From an Islamic perspective, this protection is obligatory, as well as in the perspective of the Indonesian constitution that the role of the state in facilitating Muslim consumers in obtaining halal products has been described in Article 29 of the 1945 Constitution of the Republic of Indonesia which is a justification of the state's role in ensuring the protection of Muslim consumers from products that are forbidden. This is a public interest to create a welfare state.

Abstract

Dalam perspektif etika lingkungan, manusia harus memperlakukan alam tidak semata-mata dalam kaitannya untuk kepentingan dan kebaikan manusia. Nilai-nilai etika Islam seharusnya berorientasi untuk mengembangkan kesadaran bahwa pelestarian lingkungan juga untuk kepentingan seluruh makhluk yang berimplikasi pada terwujudnya konsep ekonomi hijau (green economics) dan implementasi etika bisnis Islam terhadap green economy dalam pengaturan lingkungan hidup di Indonesia. Metode penelitian yang digunakan  adalah pendekatan yuridis normatif, sedangkan sifat penelitiannya adalah diskriptis analitis. Hasil penelitian menunjukkan bahwa: 1) Islam tidak memandang aktivitas bisnis hanya dalam tataran kehidupan dunia sebab semua aktivitas dapat bernilai ibadah jika dilandasi dengan aturan-aturan yang telah disyariatkan Allah. Etika bisnis Islam adalah tuntutan yang harus dilaksanakan oleh pelaku bisnis dalam menegakkan konsep keseimbangan ekonomi. Bisnis yang berdasarkan etika akan menjadikan sistem perekonomian akan berjalan secara seimbang. 2) Implementasi green economy adalah implementasi energi terbarukan, green economy merupakan rezim ekonomi yang mampu meningkatkan kesejahteraan manusia dan kesetraan sosial, dan sekaligus mengurangi resiko lingkungan secara signifikan, dikarenakan green economy  adalah perekonomian yang rendah karbon dan tidak menghasilkan emisi serta polusi lingkungan, hemat sumber daya alam, dan berkeadilan sosial.

Abstract

This article focuses on the implementation of the just price in islamic perspective, in which government intervention can be tolerated in this context. It is important therefore to be discussed what is the Just price and also pricing theory in islamic point of view. This article concludes that the Just price is a fixed price, and it is also called as equal price. This price is resulted by a fair market, by a fair supply and demand. The participation of the state or government here will only be Justified when instability arises, then the government should determine the price to maintain the interests of public as well as avoiding hoarding and injustices.Key words: Just price, market mechanism, government

Abstract

The massive number of money politic and clientelism cases occurring between legislative electoral candidates and the community should be eradicated, especially as the general election comes close. This article analyzed the causes of money politic and clientelism in the electoral system and which electoral system that Indonesia as a state should pursue in the legal political context. This normative juridical research discussed the subjects from the point of view of positive legal norms in Indonesia and focused on a statutory approach. The research data were collected by reviewing various literatures. From the research findings, it was concluded that the open-list proportional electoral system in Indonesia in Law No. 7 Year 2017 concerning General Election should be changed into a close-list one considering that the legal politic of the Law on General Election led to the many money politic cases occurring before and after the election. The Constitutional Court in its decision No. 144/PUU-XX/2022 rejected entirely the application for a change of proportional electoral system in the Law on General Election for many considerations and the upcoming general election in 2024 would still use the open-list proportional electoral system. Nevertheless, in the national legal political context, the party drafting the Law on General Election was authorized by the Constitutional Court to change the electoral system in the future on various requirements that they need to fulfill.

Abstract

Protection of land ownership has been regulated in various policies to protect human rights. However, it is essential to comprehensively examine the government's role in protecting land ownership because there are still various land conflicts. This research analyzes the government's role in protecting land ownership based on human rights principles and compares it with the Netherlands. This research uses a normative legal approach, using laws and cases and comparing policies with the policies of other countries. The research results show first, the Indonesian government guarantees the protection of land ownership through basic regulations on agrarian principles and the Indonesian government is trying to protect land ownership by registering land, limiting foreign land ownership, and developing governance plans at the regional level. Second, the Dutch government protects land ownership through a systematic, transparent land registration system implemented effectively to provide legal certainty for owners, investors, and related parties. Thirdly, Indonesia's regulatory approach adheres to the  basic regulations on agrarian principles  system, and the Netherlands uses civil law. However, both countries experience the same problems, such as land ownership disputes and scarcity. Therefore, the government needs to implement human rights-based policies through a transparent and fast land ownership process and public consultation in resolving land disputes.
