Abstrak: Prinsip keadilan sosial dan prinsip musyawarah dalam negara hukumÂ Indonesia adalah prinsip yang sangat mendasar. Artikel ini membuktikan bahwa, menurut hukum Islam, keadilan bisa dilihat dari dua aspek, keadilan hukum dan keadilan sosial. Keadilan hukum berkaitan erat dengan implementasi hukum, sementara keadilan sosial berbeda dengan konsep keadilan sosial kelompok sosialis-komunis atau kelompok liberal. Konsep keadilanÂ sosial didasari pandangan tentang kesejahteraan sosial. Sedang prinsip musyawarah mufakat didasari oleh semangat kekeluargaan.Kata Kunci: Prinsip keadilan, Prinsip musyawarah, Negara

The exact punishment for offenders of Islamic criminal law (jarÃ®mah hudÃ»d) has been clearly mentioned through the language of legal texts in the Qurâan and hadith. However, the realization of the sentence has been problematic and criticized by human rights proponents because they suggest that in contemporary life religious and legal discourses have to be in line with justice, truth, human rights and international law. This study aims to explore legal language of the Qurâan and hadith concerning Islamic criminal law. It shows that any reading and understanding on legal language should consider legal language and the meaning of legal language in various and respective contexts of human life. The truth of the legal language of Islamic criminal law is included in the truth of the religious knowledge, which is dogmatic.

State financial Management which raises state's financial losses shows that there is a separation between official responsibilities and personal responsibility. The limits for determining the distinction of personal responsibility and official responsibilities when there is a state financial loss are the presence of mens rea (inner attitude and malicious intent) and maladministration. National Audit Board Report (LHP BPK) is used to determine the transition of official responsibilities into personal responsibilities in relation to the findings of unlawful acts, misuse of authority, opportunities or means available to them due to position. This is in line with the objective of settling the financial losses of the state from the legal aspects of state administration which emphasize the restoration of state financial losses, although the penalty can be cumulative with criminal, civil and administrative penalties.Â Keywords: Â state finance, official responsibilities and personal responsibility, mens rea, maladminis-tration

Implications of State Policy Through Village Funds Towards the Cultural Values of Mutual Cooperation in the Village Hariyanto Hariyanto

The state policy in the form of providing village funds will have an impact on the pattern of relations and relations between the village government and the village community, as well as among their own village communities. At least the implications of this will affect the values of the mutual cooperation culture in the village community. The present study aims to answer the state policy through village funds towards village autonomy and its implications for the values of mutual cooperation culture in the village of Kedungbanteng sub-district, Banyumas Regency. This research is a sociolegal study, using the methodological approach of the social sciences and the nature of the research used in this descriptive-analytical study. The research location was in the Kedungbanteng sub-district of Banyumas using a purposive sampling method.The results of the study show that the state policy through village funds when associated with village autonomy turns out that the village has autonomy called village autonomy where village autonomy is not given by the state but village autonomy comes from the village itself. Village government is given more space in managing its own household affairs. While the implication, although we cannot deny that the existence of village funds is also the least influencing eroded mutual cooperation culture in society, but this is not a dominant factor

This study sought to determine the role of two legal aid institutions both based campus in an effort to help the poor in the field of legal assistance in litigation and non litigai. The study covered include the role of LPKBHI IAIN Walisongo and LKBH STAIN Purwokerto, procedures for handling cases in LPKBHI IAIN Walisongo and LKBH STAIN Purwokerto, constraints faced LPKBHI IAIN Walisongo and STAIN Purwokerto LKBH and strategies used to address them.This study uses empirical juridical approach to comparative analysis. The findings of this study indicate that there is a difference between IAIN LPKBHI IAIN Walisongo and LKBH STAIN Purwokerto. Among them are not pure LPKBHI IAIN Walisongo without cost as ordered by Law No. 16 of 2011. LKBH STAIN Purwokerto is still very low in both human resources, finance and facilities. The difference between the two LKBH number of clients are very demanding, indicating that LPKBHI IAIN Walisongo is more widely known by the public, more reliable and better in the role of law to function as a public servant.In that case, both LKBH in principle the same in terms of client service procedures both litigation and non-litigation. But in the actualization, LKBH STAIN Purwokerto still difficulties in maximizing its role as hampered by many constraints both internal and external. While LPKBH IAIN Walisongo, the problem is that the performance of each division's full potential, a lot of managers who served on the faculty, the lack of commitment of some managers. Meanwhile, the strategies used to overcome them; LPKBHI build a wide network of institutions, which resulted in strategic collaborations, the support of institutions that provided the impetus for the pursuit LPKBHI in providing legal assistance. While LKBH STAIN Purwokerto to ask DIPA funds from the campus, asking for help advocate from outside (especially from alumni).

This study aims to determine the factors that influence changes in the legal awareness of the community and nazhir in Bantul Regency towards the paradigm of fixed object waqf towards progressive waqf. The type of research is a field study. The method uses descriptive qualitative juridical data analysis. The primary data is conducted by interviewing the respondents with purposive sampling. The results showed that three determinant factors influenced the progressive waqf paradigm: 1) Public understanding of waqf property was limited to fixed objects (unmovable objects). 2) Public understanding of the allocation of waqf property is limited to educational and worship facilities. 3) Public understanding of the waqf reward is limited to education and worship.

This article examines how the Besan Bali marriage tradition in the Muslim community of Banjarnegara and an overview of Islamic law. This type of research is a field research, using qualitative methods with a qualitative descriptive approach. The interview method was used to obtain direct data from the informants. The types of data are primary and secondary data. The results of this study show that the Besan Bali marriage tradition is a tradition of prohibition in marriages that occur between two brothers (besan) that someone who wants to hold a marriage is hindered if the-bride-to-be comes from the Besan family where previously her brother was married to her groom-to-be’s family and vice versa. If it is reviewed based on Islamic law, the prohibition of Besan Bali marriage is actually not in accordance with Islamic teachings, because the reason for the prohibition of Besan Bali marriage is not in accordance with Islamic teachings.

The development of national law must be built through the process of discovery, development, and adaptation of Indonesian volkgeist as well as compromises with various laws that exist and live in the society. The development of national law covers several aspects including: the development of legal material, apparatus as well as infrastructure and facilities of Pancasila as the noble values and become the basis for the life of the nation and state. Therefore, the values in Pancasila must also be used as the foundation of our country in the development of national law, especially in the development of legal material and apparatus.

This article aims to examines the implementation of government affairs. So that it excludes regiÂons to get involved directly and independently in order to manage and fight for the interests of theÂir regions. Therefore, the issue of authority relations is related to how to determine the houseÂhold affairs of the autonomous regions. Thus, the effort to find the ideal form of relationship between the center and the regions within the framework of a unitary state is not an easy problem to find. However, in the author's perspective, the relative autonomy model is a better choice of models to create a pattern of authority relations between the central government and regional governments

Dalam perspektif etika lingkungan, manusia harus memperlakukan alam tidak semata-mata dalam kaitannya untuk kepentingan dan kebaikan manusia. Nilai-nilai etika Islam seharusnya berorientasi untuk mengembangkan kesadaran bahwa pelestarian lingkungan juga untuk kepentingan seluruh makhluk yang berimplikasi pada terwujudnya konsep ekonomi hijau (green economics) dan implementasi etika bisnis Islam terhadap green economy dalam pengaturan lingkungan hidup di Indonesia. Metode penelitian yang digunakan adalah pendekatan yuridis normatif, sedangkan sifat penelitiannya adalah diskriptis analitis. Hasil penelitian menunjukkan bahwa: 1) Islam tidak memandang aktivitas bisnis hanya dalam tataran kehidupan dunia sebab semua aktivitas dapat bernilai ibadah jika dilandasi dengan aturan-aturan yang telah disyariatkan Allah. Etika bisnis Islam adalah tuntutan yang harus dilaksanakan oleh pelaku bisnis dalam menegakkan konsep keseimbangan ekonomi. Bisnis yang berdasarkan etika akan menjadikan sistem perekonomian akan berjalan secara seimbang. 2) Implementasi green economy adalah implementasi energi terbarukan, green economy merupakan rezim ekonomi yang mampu meningkatkan kesejahteraan manusia dan kesetraan sosial, dan sekaligus mengurangi resiko lingkungan secara signifikan, dikarenakan green economy adalah perekonomian yang rendah karbon dan tidak menghasilkan emisi serta polusi lingkungan, hemat sumber daya alam, dan berkeadilan sosial.
