Abstract

The pandemic Covid it had an impact on all economic sectors which had an impact on the smooth running of consumers in paying consumer financing installments, which led to consumer financing disputes. The people of South Kalimantan who live in a wetland environment have local wisdom in resolving disputes with Adat Badamai tradition. This study aims to find patterns of dispute resolution between consumers and finance companies during the covid 19 pandemic and to analyze whether local wisdom in the wetland environment, namely the Bahamian custom is reflected in the settlement of consumer financing disputes. The research method used is empirical legal research supported by library research. (library research), is prescriptive analytics, it is hoped that a comprehensive, in-depth and systematic picture will be obtained. This research was conducted in South Kalimantan Province. The results showed (1). consumer financing dispute settlement patterns prioritize settlements outside the court (non-litigation), namely by internal company settlements; use third party services; through the Consumer Dispute Resolution Body, if an amicable agreement is not reached, as a last resort, a court settlement (litigation) is taken. (2). Dispute Resolution Financing companies in South Kalimantan have implemented the customary value of Adat Badamai in the settlement of consumer financing disputes. In the Banjar community, if there is a dispute, they tend to choose to settle it peacefully, meaning that there is no need for the settlement to go to court. Adat Badamai tradition is quite effective and plays a role in creating security and peace among the disputing community members.

Abstract

Background: Individual debtor bankruptcy will be an interesting problem if the individual debtor is bound in a legal marriage. Of course, there will be certain legal consequences for the husband or wife of the bankrupt debtor Objective: The purpose of this study is to determine the legal consequences of bankruptcy on the authority of debtors who are bound by marriage and their partners and the legal consequences of assets in marriage. Methods: The research method used is a normative legal research method, which is prescriptive in nature. The analytical method used in this study is a qualitative analysis in order to answer the problems studied. Results: The results of the study show that firstly, the consequences of bankruptcy can affect the authority of the debtor couple, if the husband or wife of the debtor who is declared bankrupt does not make a marriage agreement for the separation of assets, then to represent him a Curator is appointed. Second: the legal consequences of bankruptcy on assets are influenced by the presence or absence of a marriage agreement and the purpose of the use of debt, whether for the personal interest of the debtor or the common interest will determine the status of the assets in the marriage as bankrupt assets, which will be used to pay the debtors' debts. bankruptcy against its creditors.

Abstract

Area gambut di Indonesia mencakup luas + 22 Juta Hektar dan tersebar utamanya di Pulau Sumatera, Pulau Kalimantan dan Pulau Papua. Salah satu yang terjadi pada lahan gambut pada saat musim kemarau adalah mudah terbakar, karena lahan gambut menjadi kering dan sangat rentan munculnya titik api (hotspot). Lahan gambut yang kering akan mudah terbakar dan menyebar secara luas apalagi tingkat kekencangan angin yang tinggi. Kebakaran yang terjadi akan banyak mengakibatkan kerugian bagi kelestarian ekosistem lingkungan hidup, lahan dan rumah milik warga masyarakat. Tujuan penelitian adalah: untuk mengkaji tentang penyebab dan dampak terjadinya kebakaran lahan gambut dan hutan di provinsi Kalimantan Selatan; dan untuk mengkaji upaya pemerintah untuk melakukan pencegahan dan penanggulan kebakaran lahan gambut dan hutan di provinsi Kalimantan Selatan;  Hasil Penelitian adalah: 1. Penyebab terjadinya kebakaran lahan gambut dan hutan di provinsi Kalimantan Selatan adalah: masyarakat membuka lahan pertanian atau perkebunan; sistem pengelolaan hutan yang tidak memberikan manfaat ekonomi yang memicu masyarakat bertindak anarkis; pembalakan liar atau illegal logging menghasilkan lahan-lahan kritis; kebutuhan akan Hijauan Makanan Ternak (HMT);  perambahan hutan (perambah hutan); ketidaksengajaan dari pelaku (menyalakan rokok dan membuang puntung rokok dalam kawasan hutan); g. Belum maksimal penegakan hukum dan kepedulian para pihak. Sedangkan dampaknya adalah: kabut asap sulit dihilangkan dan diperkirakan akan abadi hingga tibanya musim hujan dan dampaknya mengganggu seluruh sektor; kabut asap pekat mengganggu aktivitas masyarakat; kabut asap mengganggu aktivitas penerbangan di bandara; kualitas udara tidak sehat/ berbahaya. 2. Upaya pemerintah untuk melakukan pencegahan dan penanggulangan kebakaran lahan gambut dan hutan adalah dengan membuat kebijakan perangkat peraturan perundangundangan yang dibuat dari aturan yang bersifat nasional sampai ke tingkat pemerintahan dibawahnya. Karena penyelenggaraan penanggulangan bencana merupakan tanggung jawab Pemerintah dan Pemerintah Daerah, yang dilaksanakan secara terencana, terpadu, terkoordinasi dan menyeluruh pada 3 (tiga) tahapan: a. Pra-Bencana; b. Saat Tanggap Darurat; c. Pasca Bencana.
