Abstract

This research paper addresses the significant issue of disciplinary actions under the Police Code of Ethics concerning officers involved in adultery. The problem is particularly pressing for the Indonesian National Police, as such ethical violations not only undermine the integrity of the institution but also erode public trust and confidence in law enforcement. The study aims to explore the implications of enforcing disciplinary measures for adultery among police members and to identify preventive strategies to mitigate such violations. The research employs a normative juridical methodology, focusing on the implementation of existing legal norms and regulations related to police discipline. This approach involves a thorough examination of formal legal rules, including relevant laws and literature that provide theoretical insights into the subject matter. By correlating these legal frameworks with the issues at hand, the study seeks to provide a comprehensive understanding of how ethical violations are addressed within the Indonesian National Police. The findings reveal that despite the existence of regulations, violations of discipline and ethics, such as adultery, continue to occur frequently among police officers. Factors contributing to this issue include low legal awareness among officers and the influence of their social environment, which weakens the enforcement of discipline. The research suggests several solutions, including enhancing the quality of Police Internal Affairs Investigators, increasing awareness and compliance among police members, and fostering public understanding of disciplinary law enforcement as a means of promoting transparency and accountability.

Abstract

Salah satu tujuan pengaturan keperawatan menurut Pasal 3 Undang-Undang Nomor 38 Tahun 2014 tentang Keperawatan adalah untuk memberikan pelindungan dan kepastian hukum kepada perawat dan klien serta meningkatkan derajat kesehatan masyarakat namun, dalam implementasinya perawat dalam melaksanakan tugas berdasarkan pelimpahan tindakan yang diperoleh dari pendelegasian wewenang, profesi perawat kurang justru kurang mendapat pelindungan dan kepastian hukum. Penelitian ini merupakan penelitian hukum yuridis normatif yang meneliti tentang analisis yuridis terhadap pendelegasian wewenang dokter kepada perawat dalam perspektif Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan dengan tipe penelitian kepustakaan.Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan dalam pelaksannya memiliki ada beberapa faktor yang mendukung dan menghambat pelaksanaan pendelegasian wewenang dokter kepada perawat dalam perspektif Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan yaitu faktor sumber daya manusia, pelayanan optimal kepada masyarakat dan juga ada kendala dalam aturanya hal ini tidak sesuai dengan tujuan hukum. Abstract

This research aims to analyze the Critical Role of Agrarian Reform in National Development in Indonesia. This research method is normative; namely, research focused on assessing the application of rules or norms in positive law. By using a statutory approach (statute approach) is an approach that is taken by examining the standards contained in statutory provisions. The primary material sources used in this study are the 1945 Constitution of the Republic of Indonesia (1945 Constitution), Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA), and MPR RI Decree No. IX/MPR/2001 concerning Agrarian Reform and Natural Resource Management (TAP MPR RI No. IX/MPR/2001), and Presidential Regulation of the Republic of Indonesia Number 86 of 2018 concerning Agrarian Reform (Perpres 86/2018). While the secondary legal materials used by the author are publications in the field of law but not official documents, namely: books, journals, and comments. The study results concluded that Agrarian Reform aimed to rearrange the existing order in society so that people could feel justice and equity in the land sector. In carrying out agrarian reform, there are several stages, namely the establishment of a committee at the autonomous regional level, which is tasked with registering land ownership that exceeds the maximum limit and whose goal is people's welfare, legal certainty, and justice. However, in its development, the implementation of agrarian reform experienced obstacles that caused the main objectives of agricultural reform not to be achieved, so a rural reform arrangement was needed to be aimed at the prosperity of the people.

Abstract

The Omnibus Law, also known as the Omnibus Law , is a progressive step taken by the government in the legal sector. Its purpose is to eliminate overlaps and conflicts between laws and regulations in similar sectors by reorganizing them. The legal protection of workers' normative rights in the Omnibus Law will also be analyzed. This thesis aims to examine the regulation of normative rights of workers in the Omnibus Law and compare its strengths and weaknesses to Law Number 13 of 2003. The research method used is normative juridical legal research, which involves referring to legal norms and researching library materials or secondary materials. This includes processing data from primary legal materials, secondary legal materials, and tertiary legal materials. The research results indicate that the Omnibus Law regulates normative labor rights to protect workers, as stated in Article 80. This article aims to strengthen worker protection, increase their role, and improve their welfare in supporting the investment ecosystem. The Omnibus Law is weaker than Law Number 13 of 2003 in terms of regulating the normative rights of workers. It is considered detrimental to workers and lacks legal protection for their normative rights. The only provides limited protection for workers' rights through Article 81, which is related to employment. Legal protection should guarantee workers' rights, as outlined in Law Number 11 of 2020 concerning Job Creation
