Abstract

Di era Iptek, penggunaan medsos hampir tidak bisa dibatasi karena sangat cepat melintasi ruang, waktu dan tempat, sehingga ummat Islam semakin dihadapkan dengan berbagai persoalan, baik yang langsung menyentuh ajaran Islam maupun masalah lain yang masih ada kaitannya dengan keislaman dan persoalan itu membutuhkan instrumen penyelesaian dan salah satu  instrumen itu adalah ajaran/hukum Islam. Salah satu persoalan yang saat ini marak terjadi adalah penggunaan media sosial untuk menyebarkan hoaks serta ujaran kebencian yang berdampak pada instabilitas nasional, media sosial seperti FB, WA, Instagram, Twiter dan sebagainya yang semakin memudahkan pertemuan di dunia maya. Untuk menjaga agar tidak terjadi hal berdampak negatif pada penggunaan media sosial dibutuhkan budaya literasi untuk semua pengguna medsos tersebut, karena dengan penguatan buadaya literasi maka saya, anda dan kita semua akan mampu memfilter, menyeleksi setiap berita yang  disebarkan oleh oran-orang  yang tidak bertanggung jawab. Abstract

Early marriage is still a problem in developing countries, including Indonesia. one of the areas with a high rate of child marriage is West Nusa Tenggara. This study aims to explore the implementation of the Marriage Law Number 16 of 2019 in Rembiga Subdistrict, Mataram City, focusing on the role of Tuan Guru in reducing early marriage cases. While national trends indicate a decline, local data shows a significant increase in early marriage cases, particularly in some Indonesian provinces. The study utilised empirical legal field research and qualitative methods, involving profound observations and interviews with fourteen informants. It identified obstacles in the application of the law, including premarital pregnancy, family conflicts, economic factors, promiscuous behaviour, normative conflicts, and suboptimal socialisation. In this context, Tuan Guru plays a crucial role in fostering understanding and compliance with the law in the Sasak Rembiga community through religious studies and marriage counselling. This strategy highlights the importance of integrating religious, cultural, and legal values to minimise early marriages and calls for cross-sector collaboration for sustained effectiveness.

Abstract

This study examines the tradition of fidyah payments—compensation for missed prayers (ṣalāt) on behalf of the deceased—within the Sasak Muslim community in Central Lombok, Indonesia. Although this practice diverges from the mainstream Shāfiʿī school of law (madhhab), which the community primarily follows, it endures as a deeply ingrained tradition. Based on fieldwork and interviews with tuan gurus (local religious leaders) and deceased family members, the research finds that fidyah is commonly paid using rice, money, or gold from the deceased’s estate, distributed as alms to the poor. The community views fidyah as a means of atoning for missed prayers, offering peace to the family. Tuan gurus legitimize this practice by citing specific Islamic juristic opinions, particularly those of Imām al-Subkī and Imām Abū Ḥanīfah. Over generations, the Sasak community has internalized fidyah as a communal obligation, with non-compliance regarded as a family dishonor. This study demonstrates how tuan gurus’ teachings shape and institutionalize religious practices, transforming them into essential cultural traditions.

Abstract

This study examines the impact of Sitti Raihanun’s philosophy, life experiences and educational initiatives on the educational landscape in West Nusa Tenggara. The study focuses on three main aspects: firstly, the influence of her upbringing in an Islamic environment and her involvement in the founding of Nahdlatul Wathan by her father, Maulana al-Syaikh TGKH. Secondly, her pioneering role in the advancement of women through the Muslimat Nahdlatul Wathan, which broadened avenues for women’s involvement in Islamic education and organisations. Thirdly, her contributions to the establishment of educational institutions, notably Pondok Pesantren Syaikh Zainuddin NW, which became a pivotal centre for Islamic education. The research employs a historical-qualitative methodology, utilising document analysis and interviews with key informants in the field of Islamic education. The findings demonstrate that Sitti Raihanun was able to successfully establish educational institutions from scratch, including the Pondok Pesantren Syaikh Zainuddin NW in Anjani, which subsequently became a central hub for Nahdlatul Wathan’s activities. As a pioneering female leader, she was able to surmount the societal barriers that existed at the time to become the first woman to head the largest Islamic organisation in West Nusa Tenggara, thereby significantly advancing the role of women in education and leadership.

Abstract

Background: In numerous Muslim-majority nations, paternal guardianship rights over girls are frequently maintained, despite evidence of the fathers' negligence of their duties. This prompts essential inquiries regarding the equilibrium Islamic legal systems must maintain between father power and child care Purpose: This paper examines the legitimacy of designating inattentive fathers as walī nikāḥ (marriage guardians) in accordance with Islamic law, utilizing Sa‘īd Ramadān al-Būṭī’s maslahah theory as the primary analytical framework Methods: This research utilizes a normative-comparative legal method to analyze classical Islamic law, Indonesia's Compilation of Islamic Law (KHI), and pertinent provisions in Tunisia's Code of Personal Status and Morocco's Mudawwanah Results: Research indicates that al-Būṭī’s quintuple criteria of maslahah—comprising its congruence with maqāṣid al-sharīʿah, the Qur’an, Sunnah, qiyās, and a hierarchy of benefits—can substantiate the revocation of guardianship powers from negligent fathers and their reassignment to judicial authorities. The research illustrates that this principle-based, textually anchored paradigm upholds both legal integrity and child protection. Implication: Theoretically, the research redefines maslahah as an instrument for reform within conservative legal frameworks, while practically, it advocates for legal systems such as Indonesia's to implement more explicit statutory exclusions and child-focused policies. Originality: This study's originality is in its conservative yet reformist interpretation of maslahah, demonstrating that legal reform is both feasible and essential for upholding justice and ethical oversight within Islamic family law, even within a traditionalist context

Abstract

In the era of science and technology, the use of social media can hardly be limited because it crosses space, time and place very quickly, so that the Islamic ummah is increasingly faced with various problems, both those that directly touch Islamic teachings and other problems that are still related to Islam and these problems require instruments of resolution. and one of those instruments is Islamic teachings/law. One of the problems that is currently widespread is the use of social media to spread hoaxes and hate speech which has an impact on national instability, social media such as FB, WA, Instagram, Twitter and so on which make it easier to meet in cyberspace. To ensure that there is no negative impact on the use of social media, a literacy culture is needed for all social media users, because by strengthening literacy culture, I, you and all of us will be able to filter and select every news spread by irresponsible people.

Abstract

Salah satu tujuan pengaturan keperawatan menurut Pasal 3 Undang-Undang Nomor 38 Tahun 2014 tentang Keperawatan adalah untuk memberikan pelindungan dan kepastian hukum kepada perawat dan klien serta meningkatkan derajat kesehatan masyarakat namun, dalam implementasinya perawat dalam melaksanakan tugas berdasarkan pelimpahan tindakan yang diperoleh dari pendelegasian wewenang, profesi perawat kurang justru kurang mendapat pelindungan dan kepastian hukum. Penelitian ini merupakan penelitian hukum yuridis normatif yang meneliti tentang analisis yuridis terhadap pendelegasian wewenang dokter kepada perawat dalam perspektif Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan dengan tipe penelitian kepustakaan.Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan dalam pelaksannya memiliki ada beberapa faktor yang mendukung dan menghambat pelaksanaan pendelegasian wewenang dokter kepada perawat dalam perspektif Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan yaitu faktor sumber daya manusia, pelayanan optimal kepada masyarakat dan juga ada kendala dalam aturanya hal ini tidak sesuai dengan tujuan hukum. Abstract

Economic stability is the main pillar in building a sakinah family. In this regard, economic stability in today's society is affected by online loans. The risks caused by online lending affect the psychological, social, and even emotional conditions in household life, and can further affect household harmony. This research will explore the form of online lending practices and analyze the impact of online lending on household harmony in West Lombok Regency. The research was conducted using a qualitative method. The results of the research found First: Layered Motivation signifies that Muslim families resort to online loans as a result of a mix of urgent circumstances, economic strain, insufficient literacy, and restricted access to conventional banking. Second: Multidimensional Impact suggests that online loans not only harm the economy but also dismantle the social, psychological, and spiritual structures of Muslim families. Third: Destructive Cycle demonstrates that online loans establish a vicious cycle where financial remedies worsen issues and undermine family unity. Fourth: Crisis of Religious Identity emphasizes that engagement in usury generates spiritual discord and jeopardizes the passing down of Islamic values to subsequent generations. Fifth: Systemic Vulnerability indicates that rural populations are at risk of online loan exploitation due to inadequate digital financial literacy and limited availability of Sharia-compliant financial services.
