Abstract

Tulisan sederjana ini ingin mendeskripsikan berkenaan dengan sejauh mana peran kaum wanita dalam ranah politik ditinjau dari perspektif sejarah dan politik islam. karena sasaran besar yang ingin dibidik dalam tulisan ini adalah bahwa pemikiran ulama-ulama silam klasik yang terekam dalam sejarah terkait dengan partisipasi kaum hawa dalam dunia politik bukanlah sesuatu yang sia-sia dan hampa. akan tetapi dari sekian banyak produk pemikiran itu sangat relevan untuk dijadikan sebagai indikasi konkret bahwa islam memberikan ruang gerak yang sangat luas keoada kaum hawa untuk mengekspresikan ide-idenya dalam setiap interaksi yang dilakukannya, baik dalam tataran interaksi antara satu komunitas dengan komunitas lain manapun dalam tataran kesepahaman dalam berbangsa dan bernegara. nilai-nilai itulah yang dapat ditangkap dalam tulisan ini sehingga dengan sangat trasnparan merekomendasikan perlunya melakukan suatu gebrakan pemikiran yang dapat bersinergi antara warisan pemikiran islam klasik dengan pengetahuan sains modern sebagai proses dalam membumikan nilai-nilai kepatutan yang bersumber dari ajaran yang sakral sebagai sinergi dari hasil kajian sejarah islam klasik dengan wacana pemikiran politik islam kontemporer. karena itulah maka sangat arogan bila islam dianggap sebagai suatu ajaran yang mesti direkonstruksi karena terkesan mendeskreditkan kaum hawa terkait dengan hak-hak mereka dalam kehidupan politik, padahal sesungguhnya tidak demikian.

Abstract

Non-binary gender is a legally recognized phenomenon that is present within global civilization, including the nation of Indonesia. The primary objective of this article is to analyze the concept of non-binary individuals within the context of religious universities, specifically from the standpoint of siyasah syar'iyah. This study employs a combination of qualitative and quantitative research methods, adopting a siyasah syar'iyah framework. Data was acquired utilizing two methods, including in-depth interviews, literature reviews, and surveys. The research study involved conducting interviews with informants who were specifically selected from the academic and religious communities in South Sulawesi. The literature under consideration comprises scholarly journal articles, books, and legal rules. Concurrently, a survey research study was undertaken at five Religious Universities located in the region of South Sulawesi. This study posits that under the framework of gender, non-binary is identified as a distinct category alongside men and women. Nevertheless, the Islamic law refutes the notion of gender and sexuality diversity, asserting that it contradicts sharia law, deviates from the inherent character of humanity, and raises legal issues such as inheritance and marriage. In addition to promoting non-discriminatory attitudes towards individuals, Islamic law also emphasizes the need of satisfying the rights of Non-Binary Gender individuals, provided that such fulfillment does not impede the realization of other human rights. According to siyasah syar'iyah, it is the responsibility of the state, as mandated by legislative rules, to ensure the provision of protection, guidance, and counseling to individuals, with the aim of fostering a life that promotes virtue and harmony within society.

Abstract

The concept of State of Nature is important in political theory because it helps us understand the origin of political authority and the role of government in society. The State of Nature refers to the hypothetical condition of human beings before or without political association. The analysis is about the comparison of Islamic and western views by using two figures, Al-Mawardi and Thomas Hobbes. This research aims to compare their opinion regarding the State of Nature from the perspective of Siyasah Syar’iyyah. This research uses a comparative approach and content analysis. This study discusses the critical analysis of Thomas Hobbes and Al-Mawardi's views on the concept of a state of nature. Thomas Hobbes conducted that the state of nature is the basic nature of humans who are suspicious of each other at war to find happiness or Hobbes calls it Homo humini lupus, which mean the state of the werewolf for other humans, in contrast to Al-Mawardi's view that humans are deliberately created as weak creatures so that they need interaction to help each other, humans are social creatures who need other people to survive. The research results show that Al-Mawardi and Thomas Hobbes have different views about the State of Nature. According to Al-Mawardi, humans are born in a good natural state, whereas according to Thomas Hobbes, humans are born in a bad natural state. Apart from that, Al-Mawardi argued that humans have rights that must be respected by the state, while Thomas Hobbes argued that humans must surrender their rights to the state for the sake of security and peace.

Abstract

Moderate attitudes in understanding and practicing religious teachings are highly necessary to be instilled in every Muslim, as they lead to the avoidance of conflicts with people from different beliefs. Islamic teachings about moderation in worship, as written in the Qur'an and Hadith, imply the principles of justice and balance in practicing religion. These principles are the essence of Islamic teachings that emphasize the "wasathiyah" or moderate approach in adhering to religious doctrines. Providing an understanding of religious moderation must be integrated into the curriculum of an Educational Institution. Hence, this research focuses on Islamic boarding schools (pondok pesantren) as the target of the study, as they are one of the Religious Educational Institutions in Indonesia. By employing the Community Based Research method and using a quantitative approach in data analysis, this study concludes that the development of the understanding of religious moderation in Pondok Pesantren Al-Ikhlas Ujung, Bone Regency, has shown improvement. The researcher's efforts in this development involved conducting seminars/dialogues and distributing books containing speeches related to the theme of religious moderation.Keywords : Religious Moderation, Islamic Boarding School, Tolerance, Anti-Violence

Abstract

Penelitian ini membahas kebijakan pembebasan bersyarat bagi pelaku extraordinary crime di Lembaga Pemasyarakatan Kelas II A Watampone dengan pendekatan yuridis empiris dan tinjauan Maqashid Syariah. Fokus utama adalah implementasi prosedural pemberian pembebasan bersyarat dan prinsip keadilan dalam hukum Indonesia berdasarkan UU No. 22 Tahun 2022 tentang Pemasyarakatan serta Peraturan Pemerintah Nomor 99 Tahun 2012 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan. Hasil penelitian menunjukkan bahwa secara hukum positif dan Maqashid Syariah, pembebasan bersyarat tetap menjunjung prinsip keadilan dan kesetaraan. Implikasinya mencakup pentingnya optimalisasi kebijakan tanpa intervensi serta perlunya sosialisasi publik mengenai perbedaan prosedur bagi pelaku extraordinary crime agar tidak terjadi kekeliruan dalam penafsiran keadilan hukum.

Abstract

In the framework of Indonesia's legal pluralism, the deferred mahar tradition leads to societal disputes, raises divorce rates, and encourages debt-related crimes by placing financial burdens on the groom’s side. Such systemic issues critically need policy reforms. This paper primarily aims to critically analyse this phenomenon—the mowindahako tradition—within the legal plurality system observed by the Tolaki ethnic community in Southeast Sulawesi, Indonesia. Data was gathered through observation and in-depth interviews and subsequently analysed within the theoretical framework of Living Customary Law (LCL). The findings suggest that the practice of deferred mahar in Indonesia can be attributed to the complex interplay between customary law, the state, and religion within the country's framework of legal pluralism. Both legal politics and gender biases influence this phenomenon, evident in traditional institutions' policies that empower women to dictate substantial dowry sums, thereby imposing a financial burden on men. Concurrently, customary institutions provide men with credit to help them pay dowries, thereby enhancing their convenience. This approach has led to prolonged societal disputes, reflected in increased divorce rates and rising criminal prosecutions due to debt-related issues. This paper provides a comprehensive analysis of the Deferred Mahar policy implemented by the Tolaki tribal customary institution.

Abstract

This article discusses the issue of Rohingya refugees in Aceh, Indonesia, from an Islamic perspective. The Rohingya refugees flee from violence and discrimination in Myanmar, seeking asylum in neighboring countries, including Indonesia. This research employs a qualitative method to gather and analyze data to understand the concepts, opinions, and experiences related to this issue. The findings indicate that Islam emphasizes the importance of humanity, even towards non-Muslims. The majority of Acehnese people oppose the Rohingya refugees due to concerns over economic security and social cohesion. However, they do not justify the violation of human dignity and rights. Islam teaches tolerance, justice, and kindness to all of God's creatures. Despite the challenges in handling refugees, support and cooperation from the government and the international community are crucial in seeking comprehensive long-term solutions to the Rohingya crisis. This article also examines political asylum policies from the perspective of Islamic law, emphasizing that Islam is a religion that acknowledges and respects human rights, encouraging its followers to be just and kind to all people, including non-Muslims.
