Abstract

Although the secularization process has been carried out tremendously in modern Turkey since the establishment of the republic, the role of religion (i.e. Islam) was not fully denied. This became more apparent especially in the area of education. In this regard, the Kemalist regime has established the Imam-Hatip School since the formation of modern Turkey. However, throughout its development, the schools have experienced various challenges and sanctions. Hence, this paper aims to discuss the conflicts faced by the Imam-Hatip School as a religious educational institution in Turkey and attempts that have been made to overcome the conflicts. Thispaper relies on the textual study by analyzing related documents, reports, and other previous studies. In general, the conflicts that struck the Imam-Hatip School were due to a narrative where its existence was contrary to the principle of secularism. As a result, the schools were undermined by authorities where graduates from the schools were marginalized from pursuing their study in universities, and the schools were closed as an effect from the structuration of the schooling system. The conflicts have led some attempts to revive the status of the school as a religious educational institution. Although the attempts have led to positive implications, they also contributed to the polarization among people.

Abstract

This article describes the various forms of Islamic philosophy because some scholars claim that philosophical thought in Islam has declined after Ghazâlî's criticism. This library research uses qualitative method and historical approach, and focuses on examining the distinctive characteristics of each school of Islamic philosophical thought by emphasizing its epistemological aspects. This article shows that philosophy in Islamic world is very dynamic and not in a single character. In each period, the Islamic philosophy reveals a variety of patterns. To facilitate the discussion, this article is elaborated on a series of times and examines the distinctive patterns of epistemology that developed in each epoch. Although ontologically they are similar, there are epistemic differences in the philosophy developed by Muslim philosophers: Peripateticism, which dominated during the classical Islamic period (850-1250); 'Irfânâyah and two schools of wisdom (al-h}ikmah al-ishraqîyah/illumination theosophy and al-h}ikmah al-muta'âlîyah/transcendent theosophy), which dominated in the medieval Islamic period (1250-1850); and the school of al-h}ikmat al-ladunîyah/perennialist theosophy and al-'aqalîyah in the contemporary Islamic period (1850-present). This diversity emerged as a response to different challenges and adaptations to local situations.

Abstract

This study aims to examine the social history of Islamic law from a gender perspective in terms of the Samadua marriage traditions in South Aceh. This empirical legal study used a socio-historical approach to Islamic law and gender. The study collected data by means of literature review and in-depth interview. Findings showed that the couples living at the in-law’s house before holding the walīmah al-‘ursy (wedding reception) was a violation of adat (custom) in the Samadua community. The customary sanctions imposed included being completely prohibited to hold walīmah al-’ursy and intat linto/tueng dara baroe (escorting the groom/accepting the bride) procession. From the view of Islamic law, the customary sanctions that apply in the Samadua community are intended to avoid slander and to gain maslāhah (benefit). This is also in line with the principle of sadd al-żarī'ah and does not conflict with the concept of sahih ‘urf. This is because walīmah al-’ursy for women is the time when they are treated with respect and dignity, and this time prayers will also be made for as well as dowry, valuables, and other gifts, making it worth to celebrate. From the perspective of the social history of gender-based Islamic law, the application of this customary sanction also shows that the position of women in Acehnese society is respectable enough that they must be treated with dignity. Because Acehnese women in the past have experienced periods of glory, until now their position and bargaining value are still respectable in customary practices in the Aneuk Jamee community in South Aceh.

Abstract

The study of Quranic exegesis in Malaysia has witnessed significant developments. However, various challenges persist, particularly in the form of misinterpretations. Identifying these misinterpretations is crucial to fostering accurate understanding and addressing contemporary issues effectively. This research explores the current realities and challenges in Quranic exegesis in Malaysia, identifies the forms of misinterpretations, and anticipates future directions to ensure accurate and contextually relevant interpretations of Quranic verses. This study reviews prominent Malaysian exegetical works, such as al-Bayan Pada Ta'wil Ayat-Ayat al-Quran by Abdul Aziz bin Salam, Khulasah al-Qur'an by Maulana Noh, and Pedoman Muttaqin by Abdul Hayei Abdul Syukur. Additionally, it references classical and contemporary commentaries by Muslim exegetes, including Ibn Kathir, Al-Shawkani, Al-Tabari, Al-Maraghi, Ibn Atiyyah, and Tafsir al-Misbah by Muhammad Quraish Shihab. Using a qualitative library approach, the study identifies and analyzes data from relevant sources through thematic analysis. Key themes include deviant interpretations, material constraints, lack of expertise in exegesis, and the influence of social and political factors on Quranic studies. The findings reveal that the development of Quranic exegesis in Malaysia was initially influenced by the reformative efforts of al-Azhari scholars in Egypt, pioneered by Shaykh Muhammad Abduh and further advanced by his disciples, such as Shaykh Mustafa al-Maraghi and Sayyid Muhammad Rashid Rida. Exegetical studies in Malaysia encompass traditional, scientific, and thematic approaches. Despite these advancements, challenges remain, including the misuse of Quranic interpretations for political purposes and rational interpretations by social groups such as LGBT activists, feminist movements, and figures like Kasim Ahmad, who oppose the Prophet's traditions (PBUH). These challenges stem from inappropriate methodologies, extreme ideologies, and rationalist perspectives that deviate from sound exegetical principles. This research concludes that an integrated and unified approach is needed to strengthen the methodologies of Quranic exegesis. Such efforts are essential to ensure interpretations that are not only accurate and relevant to contemporary contexts but also adhere to proper exegetical principles.

Abstract

The Israeli government has been invading and demolishing Palestinian houses in the occupied territories of Jerusalem from the outset of 1948 to date. The Israeli government’s reasons for doing so are critical to analyze, which is the article's primary purpose. This article used a descriptive approach to gather data to describe the reasons for doing such demolition. The researchers investigated, identified, and critically analyzed the frequent actions of Palestinian house demolition based on the collected data, where the qualitative method becomes the data analysis methodology. The finding reveals that, according to the Israeli government, their main reason for demolishing Palestinian houses was because they were constructed illegally without residential permits. However, the finding exposes that these claims are not justifiable; instead, the precise reason for the demolition of Palestinian houses by the Israeli government is only to evict the Palestinians from their occupied territories in Jerusalem. This also violated the position of international law and human rights, which called upon the Israeli government to allocate land to the Palestinian people. This article, therefore, recommends that more research be conducted to expose the unjustifiable actions of the Israeli government.

Abstract

In the Quranic revelations period, the electronic money has not been known yet, but the National Sharia board-Indonesia Council of Ulama (DSN-MUI) has issued a fatwa and referred to the Quranic verses as one of its legal bases. The fatwa mentioned is fatwa Number: 116/DSN-MUI/IX/2017 about Sharia Electronic Money. This fatwa said that sharia electronic money is electronic money suitable with sharia principles. The verses in this fatwa were analyzed based on the historical background of revelation, to find out whether the legal basis for the fatwa is the verses related to economic activities or not. This study showed that the Quranic verses used as a legal basis for a fatwa on the sharia electronic money were not only the verses revealed in relation with the economic activity or the verses in which economic activity was implied, but also the Quranic verses revealed in relation with other activity in which the Islamic principles were implied, and then those Islamic principles have been applied in a fatwa about sharia electronic money.
