Abstract

AbstractPrivate law  in civil law system is generally contains two major sections: contract law and commercial law. In contract law, parties imposed upon themselves certain obligations. Notwithstanding that, parties may at some point lose their ability to meet their obligations due to overmacht/force majeure. This article examine the legal status force majeure in Indonesia contract law. Force Majeure is intended to protect one party from damage arising from non- performance. The existence of which require the fulfillment of one or two conditions, subjective and objective. The Force Majeure clause is regulated in the Civil Law Code and encompasses situations such as fire, flood, earthquake, strom, typhoon (or other natural disaster), loss of electricity, catalisator damage, sabotage, war, invasion, civil war, rebellion, revolution, military coup, terrorist activities, blockade, embargo, labour dispute, strike, and goverment sanctions.

Abstract

Condominium development is the answer for those who need a place to live, but not a few whose development was violate the laws and regulations related to spatial planning, then this research is on behalf to anticipate the causes of spatial deviation by using socio legal research method. Based on the research that has been carried out found the factors that cause spatial deviation (Study of Condominium Development) in Bandung are Citizen Factors, Government Factors and Market Strength Factors in which these three factors are not stand-alone but become a linkage that can not be separated from one another.

Using a comparative law method, this article compares how Indonesian and Australia law on franchise regulates specifically the matter of franchise offering circular.  Hopefully this comparison shall not only indicate similarities or differences in both countries approach but more than that reveals what can be learned from the Australian approach to franchise offering circular.

Abstract

This study examines the legal protection of well-known trademarks in Indonesia, focusing on the Osakafom trademark dispute. Using a normative legal research methodology, this research analyzes relevant legal norms, judicial decisions, and the enforcement of Law No. 20 of 2016 concerning Trademarks and Geographical Indications. Despite the existence of this legal framework, enforcement remains weak, allowing counterfeit goods to flood the market. Through an analysis of the Supreme Court Decision No. 1390 K/Pdt.Sus-Hki/2023, this study highlights the shortcomings in enforcement and the slow judicial process. The results indicate that while the law provides a basis for trademark protection, the delays in legal proceedings and the burden placed on trademark holders to monitor infringements reduce the law's effectiveness. The findings emphasize the need for stronger enforcement mechanisms, quicker judicial proceedings, and increased government involvement in monitoring counterfeit goods. This paper also suggests that international cooperation is crucial in addressing the cross-border nature of counterfeit operations and protecting the integrity of well-known trademarks in the global market.

Abstract

AbstrakPassing off mengakibatkan kerugian bagi pemilik merek sesungguhnya seperti menurunnya reputasi perusahaan, omset penjualan yang menurun, dan tuntutan dari konsumen yang merasa tertipu karena kualitas produk tidak sesuai dengan merek aslinya. Rumusan masalah yang akanpenulis bahas dalam penelitian penelitian ini adalah: 1) Bagaimana perlindungan hukum bagi kosumen atas tindakan passing off yang dilakukan oleh pengusaha?dan2) Bagaimana penyelesaian secara hukum bagi pengusana yang melakukan pemalsuan merek dengan tindakan passing off atas merek terkenal ?. Adapun metode penelitian yang penulis gunakan adalah metode yuridis normatif, yaitu yaitu menganalisis kaitan antara peraturan perundang-undangan yang berlaku dengan teori-teori hukum dan praktek pelaksanaan hukum positif yang menyangkut permasalahan yang dibahas denganmengutamakan data kepustakaan yaitu penelitian terhadap data sekunder. Data sekunder tersebut dapat berupa bahan hukum primer,sekunder maupun tersier. Akhirnya berdasarkan hasil penelitian, penulis menyimpulkan bahwa perlindungan hukum bagi kosumen atas tindakan passing off yang dilakukan oleh pengusaha, yaitu : a) Perlindungan konsumen dari barang tiruan, artinya, konsumen diberikan jaminan atas keamanan dan keselamatan kepada konsumen dalam penggunaan, pemakaian dan pemanfaatan barang dan atau jasa yang dikonsumsi atau digunakan. Jadi para pengguna produk atau konsumen tidak merasa dirugikan oleh pihak pelaku usaha ; b) Perlindungan atas tanggungjawab pelaku usaha terhadap konsumen yang membeli barang tiruan, artinya tiap perbuatan melanggar hukum, yang menimbulkan kerugian bagi orang lain mewajibkan orang yang karena kesalahannya mengakibatkan kerugian itu, mengganti kerugian.” Ketentuan ini memberi perlindungan kepada seseorang terhadap perbuatan melawan hukum (onrechtmatige daad)Kata Kunci: Perlindungan Konsumen, Merek Palsu AbstractPassing off results in losses for the real brand owner such as declining company reputation, declining sales turnover, and demands from consumers who feel deceived because the quality of the product does not match the original brand. The formulation of the problems that the author will discuss in this research is: 1) How is the legal protection for consumers for passing off actions carried out by entrepreneurs?and2) How is the legal settlement for the proposer who commits brand counterfeiting with the act of passing off the famous brand ?. The research method that the author uses is a normative juridical method, namely analyzing the relationship between applicable laws and regulations and legal theories and the practice of implementing positive law which concerns the problems discussed by prioritizing literature data, namely research on secondary data. The secondary data can be in the form of primary, secondary or tertiary legal materials. Finally, based on the results of the study, the author concludes that the legal protection for consumers for the act of passing off carried out by entrepreneurs, namely: a) Consumer protection from counterfeit goods, that is, consumers are given guarantees for security and safety to consumers in the use, use and utilization of goods and or services consumed or used. So product users or consumers do not feel disadvantaged by business actors; b) Protection of the responsibility of the business actor against consumers who purchase counterfeit goods, meaning that any unlawful act, which causes harm to others, obliges the person who by his fault resulted in the loss, to compensate." Abstract

The importance of legal protection for trademarks in Indonesia is reflected in the preventive measures regulated by Law Number 20 of 2016 concerning Marks and Geographical Indications. This study analyzes the implementation of preventive legal protection with a focus on trademark registration. Normative analysis methods and literature study approaches are used to examine the roles and constraints in implementing this preventive measure. In Indonesia's trademark protection context, a preventive legal approach plays an important role in preventing trademark rights infringement. With reference to Law Number 20 of 2016 concerning Marks and Geographical Indications, preventive efforts in the form of registering a mark at the Ministry of Law and Human Rights (HAM) as well as the obligation of trademark holders to fulfill formal and substantive requirements form the basis for providing exclusive protection for brands. Through registration, brand holders obtain legal certainty that secures their exclusive rights. Furthermore, the practical implementation of this preventive protection also requires improving the quality of human resources in related institutions, as well as mastery of foreign languages and the application of technology to minimize opportunities for trademark rights violations.
