Normatively constitutional court and supreme of court has on equal position with a different authority. However, there is a relationship of authority and point of contact. Morever, potential to cause disharmony on law enforcement. For example, on implementation of the constitutional court’s decision directly followed by the decision of the supreme court but some others not. The constitutional court’s decision characteristic are final and binding general (erga omnes), at the same level with legislation (negatif legislator), undirectly binding and enforced by the supreme court. Fundamentally, judge at the supreme court and the courts below is not a mouthpiece of the law, therefore it has some authority to interpre the statute (was also againts the decision of the constitutional court) to be applied on cases they handle. Although the judges decision of the supreme court do not decide on the validity and constitutionality of the norm, but through the efforts of the discovery or the interpretation of the law can gives an effect to the law enforcement and the establishment of a progressive and responsive legal reform.

Undang-Undang Peradilan Tata Usaha Negara telah mengatur mengenai mekanisme pelaksanaan putusan dengan menggunakan upaya paksa administratif dan perdata berupa pengenaan uang paksa. Pada praktiknya mekanisme ini kurang efektif karena masih ada Pejabat TUN yang tidak mau patuh melaksanakan putusan Pengadilan TUN. Perlu adanya kriminalisasi contempt of court terhadap Pejabat TUN yang melakukan pembangkangan tersebut karena dampaknya adalah terabaikannya hak konstitusional warga atas keadilan yang telah diputuskan oleh Pengadilan TUN. Dengan kriminalisasi ini maka dapat memberikan jaminan kepastian hukum dan perlindungan terhadap rakyat atas kesewenang-wenangan Pejabat TUN. RUU Contempt of Court telah memasukkan ancaman pidana bagi para pihak yang tidak mau mematuhi putusan pengadilan. Secara fundamental yang dilindungi dari kriminalisasi ini adalah kepentingan keadilan dan eksistensi Negara hukum Indonesia.Law on State Administration has set regarding the enforcement mechanism by using administrative and civil forceful measures include the imposition of forced currency. In practice this mechanism is less effective because there are officials who do not want to obey implement the Court’s decision TUN. The need for the criminalization of contempt of court against officials who do disobedience TUN because its impact is the neglect of the constitutional rights of citizens to justice that have been decided by the Court of TUN. With this criminalization, it can provide legal certainty and the protection of the people over the arbitrariness of officials TUN. Contempt of Court Bill has included criminal sanctions for those who fail to comply with the court ruling. Fundamentally protected from criminalization of this is in the interests of justice and the existence of the laws of Indonesia.

The Law on Special Autonomy for Papua Province grants the Customary Court the authority to adjudicate criminal cases involving indigenous Papuans. Parties dissatisfied with the decisions of the Customary Court may appeal to the State Court. However, conflicts arise when the formal criminal justice system intervenes before the customary resolution process is completed, creating jurisdictional clashes. This raises the question of how to harmonize the relationship between these two judicial systems in a manner that fosters accommodation rather than resistance. This study employs both document analysis and field research, including interviews with law enforcement officials, judges, academics, and traditional leaders in Jayapura and Manokwari. The findings reveal that the intersection between the Customary Court and the State Court is inevitable, as the subject matter, object, and principles of criminal responsibility overlap between the two systems. To mitigate conflicts, a reconstruction of the interaction between Customary Courts and State Courts is essential, particularly in the adjudication of criminal cases involving customary law communities. Key strategies include fostering synergy and aligning perceptions between the apparatus of the Customary and State Courts. Additionally, the development of comprehensive guidelines for handling customary crime cases is crucial. Such guidelines would provide judges operating within Papua’s jurisdiction with a clear framework for considering customary law, thereby promoting integration and mutual respect between the two judicial systems. This approach aims to ensure that both customary and state legal traditions coexist harmoniously within the context of Papua’s special autonomy.

The functional position generally managed and fostered in a nationally integrated one employment system by the fostering institution of the functional position. Unfortunately, the differentiate management and employment building occurs in the functional position of registrar, along with its judicial institution namely Supreme Court, Constitutional Court and judiciary body below Supreme Court. The different status and functional position requirement from those three judicial institutions become one of the obstacles the registrar fostering system cannot be united. For example, Constitutional Court and judiciary body under Supreme Court require civil servant as a registrar meanwhile Supreme Court Registrar is a judge. The issue of less linear and synchronization employment system led to disproportional of the fostering of registrar functional position. The career development horizontally through the application of credit points is indeed needed to construct as an expertise functional position consequences. Hence the position and career pattern does not only lead vertically to chief and deputy chief of registrar. The reconstruction of the expertise functional position of registrar should also apply the same requirement and fostering system nationally, this will lead performance and professionalism upgrading. Constitutional Court Decision No. 34 / PUU-XI / 2013 has opened the space PK is not just one time as provided for by the Article 268 paragraph (3) Criminal Procedure Code so that PK can be done many times during found and submission of PK Novum although it has done previously. Perspective is the basis of this decision is justice. Responding to the verdict of the Constitutional Court, the Supreme Court publishes SEMA No. 7 Year 2014 on Reconsideration Request Submission In Criminal Case. Through the SEMA Supreme Court warned that provisions PK only once outside the Article 268 Criminal Procedure Code which was canceled by the Constitutional Court, therefore, PK criminal cases (in a similar case) is more than 1 (one) can not be accepted. Restrictions on the desired PK criminal case the Supreme Court is to provide legal certainty in the process of final settlement of criminal matters. Government through Minister of Law and Human Rights take strategic steps in resolving the legal expediency vision polemic filing legal remedies PK criminal cases, by coordinating state agencies and relevant ministries so as to produce an agreement that filing PK many times can not be executed until the issuance of PP. Basically cases of traffic violations is a matter of simple so categorized quick examination. However, when the volume of his case matters reach thousands of cases and should be heard in court within a day, in fact has given rise to problems. In addressing these problems, improvement of handling and settling disputes traffic violation in court is an absolute must do. But apart from that alternative settlement traffic violation outside the court, namely through the implementation of diversion should be used as an alternative way to reduce the caseload and problems in court. Normatively, judicial registrar status is set differently. While explicity defined as a functional, but without the credit and judicial office. Functional qualification held judicial registrar existence is synchronizedwith the structural position of the promotion system and regular. A clerk on the supreme of court must be a judges. So that the clerk have a career at the highest level only appellate court registry. The supreme of court regulation drafting that gaves the registrar portion to career clerk, then enactment of civilian state apparatus regulation get the civil servants functional oriented. Restitution is a form of legal protection form for victims of victim recovery oriented. Normatively, on the positive law, restitution has not been cooperated well yet. Consequenly, the application of the restitution had a problem, specifically unsynchronized legal structure. Under the integrated criminal justice system perspective, legal structure and legal substance disharmony need to be reorganized (regulated). A fundamental arrangement will be done by rephylosophy some punishment, than make restitution become a prinsipal (main)criminal and giving a new position for the victim to the later integrated criminal justice system based on the phylosophy of restoratifjustice.
