Abstract

This literature review aims to examine the presence and impact of Muslim women in administrative roles at the Indonesian ITE. The results show that the leadership structure at the Indonesian Institute of Teacher Education is quite intricate. Transactional, transformational, laissez-faire, democratic, and autocratic techniques are all used by Muslim women in positions of power. As their effects on leadership skills and abilities show, these styles have a strong positive link with leadership efficiency. Understanding the many facets of effective leadership is facilitated by incorporating Islamic leadership ideals, particularly Performance and Islamic Leadership values. The study also identifies several mediating factors—leadership ethos, goals and responsibilities, interpersonal correspondence, professional development, and employee empowerment—that affect leadership efficacy in ITEs. A developed Leadership Effectiveness Model synthesizes the research findings, offering a structured framework for Muslim women leaders to adapt their leadership approaches according to contextual challenges and opportunities. In conclusion, this study contributes novel insights by exploring the impactful presence of Muslim women leaders within the Indonesian Institute of Teacher Education. The study's findings provide valuable guidance for Muslim women leaders' career progression and effectiveness, ultimately contributing to the broader discourse on gender equality and empowerment in leadership positions.

Abstract

This essay seeks to explore the treatment of grand corruption and the legal categorization of civil recovery regimes. It aims to provide fresh insights into the interface between combating corruption and protecting human rights. Specifically, it questions whether grand corruption should be primarily treated as a criminal offense and examines the human rights concerns raised by the civil recovery approach. Moreover, it introduces clear criteria for balancing these competing imperatives. The research employs a literature approach, drawing from legal, human rights, and anti-corruption literature. This essay presents a twofold conclusion. First, it argues that grand corruption should be predominantly treated as a criminal offense, challenging the prevailing emphasis on civil recovery. This research offers fresh insights into reconciling these conflicting imperatives and informs future policy and legal developments in the fight against corruption.

Abstract

This study examines the process of institutionalization of sharia principles in the economic field, along with the process of legislation and regulation in the national legal system. The scope of this study will rely on the existence, opportunities, and challenges of actualizing the Islamic economic system from the perspective of Indonesian legal politics. Specifically, this approach is carried out based on the authority of Islamic law and its existence as a source of law in Indonesia’s national legal order, with a sharp level of attention to the dynamics of regulatory policies on sharia economic business activities. Starting from the characteristics of Indonesian political legalism under the umbrella of the 1945 Constitution, which adheres to the concept of “unification and codification in a “unique way,” the study of sharia economics in Indonesian legal politics has also given birth to several knots that are “unique.” Theoretically, the concept of “unification” is a way for national legal politics to shape law in the condition of a pluralistic Indonesian nation. One principle that is used as a theoretical benchmark in this regard is how to carry out the process of legal unification in a pluralistic society that seeks to maintain a process of differentiation in a sustainable manner of sharia economics. Abstrak Penelitian ini menyoroti proses pelembagaan prinsip syariah dalam bidang ekonomi berikut proses legislasi dan regulasinya dalam sistem hukum nasional. Lingkup kajian ini akan bertumpu pada eksistensi, peluang dan tantangan aktualisasi sistem ekonomi syariah dalam perspektif politik hukum Indonesia. Secara spesifik, pendekatan ini dilakukan dengan bertolak pada otoritas hukum Islam dan eksistensinya sebagai sumber hukum dalam tertib hukum nasional Indonesia, dengan tingkat perhatian yang tajam pada dinamika kebijakan regulasi atas kegiatan usaha ekonomi syariah. Bertolak dari karakteristik legalisme politik hukum Indonesia di bawah payung UUD 1945 yang menganut konsep”unifikasi dan kodifikasi secara “unik,” kajian tentang ekonomi syariah dalam politik hukum Indonesia juga telah melahirkan beberapa kata simpul yang bersifat “unik.” Konsep “unifikasi” secara teoritik merupakan satu jalan bagi politik hukum nasional untuk membentuk hukum dalam kondisi bangsa Indonesia yang majemuk. Salah satu prinsip yang dijadikan tolak ukur teoritis dalam hal ini adalah bagaimana melakukan proses penyatuan hukum dalam masyarakat majemuk yang berupaya mempertahankan proses diferensiasi ekonomi syariah secara berkelanjutan. Abstract

Utilizing a literature review as the primary method, this study delved into the navigation of tradition and modernity within Dubai's criminal justice system. The methodology entailed a comprehensive review of existing scholarly works, legal documents, and reports pertaining to the subject matter. The analysis synthesized insights from various sources to examine the system's integration of international human rights values and Sharia law principles. Additionally, it explored mechanisms for defending minority rights and assessed perceptions of the system's fairness and effectiveness among different segments of the population. Through this literature-based approach, key findings emerged. Firstly, the majority of sources indicated that the system effectively balances international human rights standards with Sharia law principles. Secondly, specialized courts and legal aid provisions were identified as mechanisms for safeguarding minority rights. Lastly, while the system was generally perceived as providing adequate protection, opportunities for improvement, such as enhancing access to justice for marginalized groups, were highlighted. In conclusion, the findings suggest that the Dubai criminal justice system has successfully negotiated tradition and modernity, offering valuable insights for other jurisdictions. Nonetheless, further research is warranted to evaluate the long-term implications of these findings and to refine strategies for ongoing enhancement in response to evolving societal demands.

Abstract

This paper presents an essay that critically analyzes the propulsion and maneuvering characteristics of survey-style AUVs and their development for military applications. The study aims to uncover the strategic significance and transformative potential of innovative contributions, including biomimetic propulsion, AI-driven maneuvering, swarm-scoped autonomy, integrated power solutions, and comprehensive data fusion. Drawing upon an extended version of the Technology Acceptance Model (TAM), the essay explores user attitudes, strategic alignment, system performance enhancements, and environmental interactions. The methodology combines a comprehensive literature review, case study analysis, and examination of policy documents. The study's outcomes offer novel insights into bridging the gap between biology and engineering through biomimetic propulsion, enhancing AUV maneuverability with AI-driven strategies, revolutionizing military operations with swarm autonomy, extending AUV endurance via integrated power solutions, and achieving comprehensive data fusion for informed decision-making. The analysis showcases the evolving landscape of AUV technology and its strategic relevance, elucidating how these cutting-edge advancements reshape underwater exploration across civilian and military domains. Ultimately, this essay contributes to a comprehensive understanding of AUV capabilities and their potential for transformative impact in the underwater realm.

Abstract

This essay aims to provide a comprehensive analysis of decentralization, party competition, and electoral integrity within the framework of institutional design theory. By examining the interplay between central governments, regional authorities, and political parties, we seek to enrich academic scholarship and offer practical insights for policymakers engaged in governance and policy-making. Our analysis employs a literature analysis to examine the impact of decentralization on party behavior, electoral processes, and governance quality. Our comprehensive analysis reveals several key findings. First, decentralization is not a one-size-fits-all phenomenon; it varies across regions and contexts, influenced by a range of factors. Second, an inclusive measure for assessing the risk of electoral defeat within a decentralized framework provides deeper insights into electoral dynamics. Third, the interaction between regional and national parties shapes regional party systems in decentralized settings. Fourth, political parties engage in rational cost-benefit calculations, affecting their decisions on electoral fraud. Most importantly, we find that decentralization can enhance the fairness of national elections by reducing the incentives for electoral fraud, ultimately strengthening electoral integrity and the quality of government. Our study bridges existing gaps in the literature and offers a comprehensive understanding of the complex dynamics inherent to decentralized governance structures. This research contributes valuable insights to academic scholarship and provides practical guidance for policymakers navigating the challenges and opportunities presented by decentralization in contemporary elections.

Abstract

This article aims to address gaps in national policy by analyzing the complex interactions between international law, Indonesian jurisdiction, and child welfare in cross-border surrogacy arrangements. It advocates for prioritizing the best interests of children and offers practical recommendations for stakeholders involved in cross-border surrogacy. The research examines the principles and framework established by the Hague Conference on Private International Law and their implications within the Indonesian context. It also explores domestic Indonesian law, court decisions, and ethical dilemmas surrounding cross-border surrogacy. This article provides insight and perspective on the ongoing discussion of cross-border surrogacy by filling gaps identified in the literature. The analysis highlights the importance of children’s interests in cross-border surrogacy cases, offers a detailed examination of the role of Indonesian courts, and integrates ethical considerations into the legal framework. The research culminates in practical policy recommendations for policymakers, legal practitioners, and other stakeholders, with the ultimate goal of protecting and enhancing the well-being of children born through these complex arrangements. The findings emphasize the importance of prioritizing children’s well-being, recognizing them not simply as objects but as individuals with inherent rights, identities, and needs that require protection.

Abstract

In this paper, the author discusses the urgency of implementing a digital forensic readiness framework used by the Supreme Court of Indonesia and stakeholders to identify, collect, and maintain digital evidence and respond faster during the post-incident phase than usual by initiating forensics investigations. Digital photography, as soon as possible, upon incident detection, gets digital evidence first. The proposed Guideline has been created by considering the principles of digital forensic readiness requirements based on ISO/IEC 27043.

Abstract

The primary objective of this research is to illuminate the evolution of medical responsibility in Indonesia over time. By examining the complex interplay between law and medicine, social transformations, medical advancements, and shifting legal perspectives, this study seeks to enhance understanding of medical responsibility in Indonesia. Utilizing an interdisciplinary approach grounded in the "Social Construction of Technology" (SCOT) theory, the research employs historical analysis to trace the origins of medical responsibility, its evolution, and the impact of various legal frameworks and cultural shifts in medicine. The study integrates qualitative data from legal and medical sources to provide a comprehensive view. Findings reveal that the evolution of medical responsibility in Indonesia is closely tied to the adoption of, and subsequent resistance to, entrenched notions within medical discourse. The research identifies a trend towards greater judicial independence from traditional medical narratives and an increased willingness to scrutinize established medical practices, particularly in the context of technological advancements. By situating these developments within Indonesia's historical and cultural context, this research enriches the understanding of medical liability's progression and ongoing transformation within a dynamic healthcare landscape. It addresses gaps in existing literature and offers a nuanced perspective on the interaction between law and medicine concerning medical liability.

Abstract

This study explores the development and implementation of machine learning (ML) models designed to detect patterns indicating electoral fraud. The aim of this study is to address existing gaps in the literature by integrating advanced ML algorithms, leveraging various data sources, developing real-time monitoring systems, ensuring model transparency, and addressing ethical considerations. The main argument is that ML provides a robust and adaptive approach to enhance the accuracy and efficiency of detecting electoral fraud. This research employs a comprehensive analysis using Systems Theory to integrate and optimize the various components involved in detecting electoral fraud. The study also develops real-time monitoring systems and incorporates methods for model interpretability and transparency. Ethical and practical challenges are addressed through thorough analysis and the provision of guidelines for responsible implementation. The study demonstrates that machine learning significantly improves the detection of electoral fraud by identifying complex and subtle patterns that may be overlooked by traditional methods. The integration of various data sources and real-time monitoring enhances the resilience and timeliness of fraud detection. Ensuring model transparency and addressing ethical considerations helps build trust and accountability in the electoral process. Overall, this research provides a comprehensive solution that enhances the accuracy, efficiency, and trust in detecting electoral fraud, thereby supporting the integrity of the democratic process.
