Abstract

Tujuan penelitian ini adalah mendeskripsikan orientasi maz\hab fiqih komunitas Hijrah United yang berkembang di Kota Malang dalam perspektif Kajian Hukum Islam. Maz\hab fiqih komunitas Hijrah menginduk kepada pemahaman empat imam maz\hab dengan kategori sebagai muqallid secara dominan, muttabi’ dan mujtahid muttabi’ sebagian lainnya. Penelitian ini merupakan penelitian deskriptif yang proses pengambilan data dilakukan melalui metode penelitian lapangan dengan mengumpulkan informasi dari para nara sumber untuk memperoleh data primer. Mempertegas posisi maz\hab fiqih dari komunitas Hijrah menjadi sangat penting dalam proses menciptakan trusted branding di masyarakat pada era disrupsi moral kaum millenial. Fokus penelitian mengacu kepada upaya mendeskripsikan terminologi hijrah pada komunitas Hijrah United dan mendeskripsikan orientasi fiqih yang dipergunakan komunitas Hijrah United.

Abstract

The problem of lineage, in relation to Islam, is getting important to be discussed and to be given sufficient attention by Muslims today. This situation is driven by the verdict of the Indonesian Constitutional Court No. 46/PUU-VIII/2010 on the case of children which were born outside marital relation. The said verdict has been considered as controversial and led to prolonged polemics in the society, and particularly among Muslims. This due to the content of the verdict that is not within the boundary of the established norm in Islamic law. One of the negative effects that seems to happen is that adultery will be justified by such verdict, since the children born as result of this adultery is considered as legal from the civil law perspective. This article tries to analyse the topic from the perspective of Islamic law. The article concludes that such verdict has not carry any legal power if it put in the context of Islamic law.Key words: mahkamah konstitusi, status anak, luar nikah

Abstract

Pengabdian ini bertujuan untuk memberikan pemahaman komprehensif tentang penguatan ketahanan keluarga bagi ibu berusia muda di kecamatan Pujon Kabupaten Malang. Pengabdian ini didasarkan pada kebutuhan masyarakat yang berada di lingkungan masyarakat Pujon yang secara faktual banyak terjadi pernikahan pada usia muda. Kasus yang terjadi di daerah tersebut, akibat dari pernikahan adalah maraknya terjadi perceraian pada pasangan muda dan lahirnya anak-anak dengan status stunting yang cukup besar. Metode pengabdian dilakukan melalui metode ceramah, diskusi dan simulasi. Pengabdi berupaya untuk menyiapkan langkah-langkah dan materi-materi yang akan dipergunakan untuk mengedukasi pasangan muda sebagai bagian dari masyarakat. Setelah mengikuti kegiatan masyarakat memiliki pemahaman komprehensif tentang ketahanan keluarga, memahami pentinganya manajemen konflik yang sehat serta memiliki kompetensi aplikatif dalam komunikasi bersama keluarga. Hal tersebut tergambar dari hasil pretest dan post test yang dilakukan serta diskusi interaktif bersama peserta.

Abstract

This research examines the status of children born out of wedlock under Fatwa No. 11 of 2012 issued by the Indonesian Council of Ulama (MUI) and analyzes it through the lens of Maqasid Shariah using Jasser Auda’s system approach. Employing a qualitative method with descriptive analysis and a philosophical approach to Islamic law, the study focuses on ensuring the welfare and rights of children born out of wedlock. It highlights the importance of scholars' cognitive construction, such as Ibn Taimiyyah’s views, and the integration of arguments to prevent methodological reductionism. Emphasis is placed on protecting these children in line with Maqasid Shariah principles, including the use of modern tools like DNA testing to adapt Islamic law to contemporary needs. A multidimensional approach involving knowledge, psychology, and legality is essential to safeguard their rights. The hierarchical framework in Maqasid Shariah supports the recognition of biological fathers to ensure the child’s welfare and universal justice. The study argues that MUI Fatwa No. 11 should reflect Maqasid Shariah’s holistic and dynamic principles to align Islamic law with social changes. It asserts that reconstructing the lineage of children born out of wedlock is intended to affirm their inherent dignity (fitrah) as equal to other children, without endorsing adultery or undermining the institution of marriage in Islam. Ultimately, this approach seeks to uphold social justice and universal welfare.

Abstract

Trading in influence is a corruption practice involving the abuse of position or relationships to influence officials for personal or group gain. While recognized under the United Nations Convention against Corruption (UNCAC) Article 18, Indonesian positive law does not explicitly regulate this act. This study aims to (1) identify gaps in Indonesian law regarding influence peddling, (2) examine the potential for its inclusion as a corruption crime, and (3) explore the relevance of Islamic law as a normative foundation. Using normative legal methods with a doctrinal approach, the research analyzes legislation, international conventions, expert opinions, and Islamic legal sources such as the Qur’an, Hadith, and jurisprudence. Findings show a normative gap in Indonesian law, while Islamic law strongly prohibits abuse of influence through bribery and istighlal al-jah. Influence trading contradicts principles of justice, honesty, and trustworthiness, as well as the objectives of maqasid sharia, since it disrupts the economic order and harms society. Although Indonesia ratified UNCAC, national law still lacks provisions to prosecute such acts. Therefore, trading in influence should be firmly formulated in future legal reforms (ius constituendum) to enhance anti-corruption efforts and ensure justice in line with Islamic values.

Abstract

One of cases in islamic law today is same-sex marriage. The case sparked a controversy in muslim society. On theone hand, the case can be seen as an integral part of a person’s rights to meet the biological needs, but on the otherhand is seen as a violation of religious norms and moral principles. Those who have a sexual orientation towardsthe same gender (homosexual), which was also approved this orientation, continue to get same-sex marriagelegalization because a sense of love towards the same sex due to biological and psychological factors is viewed aspart of human rights. This paper attempts to examine same-sex marriage from the point of view of Islamic studies.[Salah satu kasus dalam hukum Islam saat ini adalah perkawinan sesama jenis. Kasus ini memicukontroversi. Di satu sisi, kasus tersebut dapat dipandang sebagai bagian tidak terpisahkan dari hakhakasasi seseorang untuk memenuhi kebutuhan biologisnya, tetapi di sisi lain dipandang sebagaipelanggaran norma keagamaan dan moral yang prinsip. Mereka yang memiliki orientasi seksualterhadap gender yang sama (homoseksual), juga yang menyetujui orientasi ini, terus berupaya untukmendapatkan pelegalan perkawinan sejenis karena rasa suka terhadap sesama jenis yang disebabkanfaktor biologis dan psikologis dipandang sebagai bagian dari hak-hak asasi manusia (HAM).
