Land utilization for investment in local areas raises various land related problems that ends with conflicts within the community. A conflict that occurs, usually begins with the management of communal land “tanah ulayat” within the adat law community environment, and in this case, land utilization that is managed by the third party (investors). The basic problem is the difference of perception and expectations toward the company that exists in the land which is claimed by the community. Both parties have their own claim on the land based on each legal systems, in this situation adat law or local law faced with state law which is used by investors. So far, the Indonesian government has yet to have legal grounds in giving a directions for land dispute/ conflict settlement mechanism. This paper attempts to give an input regarding a land dispute settlement mechanism that can be accepted for all disputing parties. The paper features critical analysis using legal pluralism approach towards related government policies and technical regulations in the ministerial level. These regulations, among others are, Minister of Agrarian Regulation No. 5 of 1999 and Ministry of Agrarian and Spatial Affairs Regulation No. 9 of 2015, also the draft of Law regarding Recognition and Protection of Adat Law Community.

This paper intends to examine the enforcement of land policy related land rights for Indonesian citizens of Chinese descent in the Territory Special Region of Yogyakarta. In this context, they can only be granted land rights in the form of HGB, not allowed to obtain property rights to land in Yogyakarta. This restriction is considered as a different treatment of citizens of Chinese descent. This issue becomes important to be discussed considering the Law No. 5 of 1960 on Agrarian Principles ensuring the arrangement of land tenure is directed to be utilized for all Indonesian citizens without exception in a fair manner. The discussion of the issue will be further elaboratedusing the perspective of the sociology of law in order to explain how the people of Yogyakarta responded to such policy.

This thesis discusses the implementation of the principle of "equitable efficiency" as contained in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment in legislations concerning electricity. This research analyzes how the Constitutional Court interprets the element of "equitable efficiency" in the constitutional reviews Electricity Law. This article concludes that the meaning of "equitable efficiency" in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment is that the national economy should be organized to use the least amount of resources to achieve the greatest amount of welfare which could be enjoyed equitably by the all citizens. In regards to Indonesia's electricity sector, it was found that each electricty regulation has embodied at least one aspect of the principle of "equitable efficiency".

The arbitration decision by BPSK, can be filed with objections in accordance with Law 8/1999 and annulment under Law 30/1999. These two actions raise questions related to the arbitration process to resolve consumer disputes, consumer protection, and the impact of the Constitutional Court’s decision on the annulment of arbitration awards. This is because both actions are contrary to the final and binding nature of the arbitration award. Through the doctrinal research method, it was found that three years since the Constitutional Court’s Decision, there has been an increase in decisions related to the annulment of arbitration awards and objections to BPSK decisions. The Constitutional Court Decision has two contrary impacts. It makes easier for the aggrieved party in the process of resolving consumer disputes through arbitration to file for annulment or objection. Meanwhile, it also makes the process of consumer protection through arbitration lose its final and binding force.

Era globalisasi yang terjadi saat ini memberikan perubahan yang signifikan pada kehidupan manusia. Penerapan teknologi informasi menimbukan berbagai perubahan sosial. Perkembangan teknologi informasi diterapkan pemerintah dalam bentuk penyelenggaraan E-government untuk meningkatkan kinerja pelayanan publik yang lebih berbasis pada good governance. Penerapan penyelenggaraan E-government salah satunya adalah penyelenggaraan pelayanan pajak berbasis Online saat ini. Adapun masalah yang akan dikaji dalam penelitian ini adalah Bagaimana sistem layanan pajak berbasis online di Indonesia menurut Peraturan Perundang-Undangan di Indonesia; dan Bagaimana relevansi sistem layanan pajak berbasis online di Indonesia dengan teori hukum pembangunan dan perubahan masyarakat. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Sumber data yang menjadi acuan dalam penelitian ini adalah data primer dan data sekunder. Teknik pengumupulan data yang digunakan dalam penelitian ini adalah Studi Kepustakaan. Analisis data yang digunakan yaitu dengan menggunakan metode kualitatif. Berdasarkan hasil seluruh penjabaran dalam penelitian ini, ditarik kesimpulan bahwa teori hukum pembangunan dan teori perubahan masyarakat mendorong terciptanya pengaturan atau legalisasi terhadap penyediaan layanan pajak berbasis online, dengan teori hukum pembangunan yang mengharuskan adanya pembaharuan hukum tertentu yang dalam hal ini pembaharuan aturan hukum mengenai layanan pajak berbasis online, dan teori perubahan masyarakat yang diartikan dengan perubahan sosial masyarakat yang berubah dari pada saat masyarakat masih terbiasa menggunakan dokumen cetak, beralih dengan kebiasaan masyarakat di media sosial yang sudah lazim dengan media elektronik dan jaringan, sehingga regulasi mengikuti kebiasaan masyarakat untuk memberikan pelayanan pemerintahan secara online, dalam hal penelitian ini pelayanan pajak secara online.

The legalistic positivist Civil Law tradition still dominates legal thinking in Indonesia. Therefore, law is often only defined as legislation. Law that is realized in norms is postulated in the form of laws. Whereas outside state law there is also a law that grows and develops in society which has a very effective force. The law is known in the concept of The Living Law which is translated by academics in Indonesia as Customary Law, where the law is realized in the attitude of legal action. Its existence as an embodiment of the original Indonesian Legal system is different from the Civil Law legal system. The problem is when each claims the truth of the law. Meanwhile, if we look at the legislation, the existence of Customary Law as The Living Law is highly dependent on state recognition. Therefore, to understand and explain it brings methodological consequences that use an external perspective. The question that arises is whether the law embodied in the attitude of legal action can be interpreted sociologically? If it can, is this sociological study part of the study in the discipline of law or is it a study of social disciplines? This paper will argue about the importance of an interdisciplinary perspective in the study of legal disciplines, such as the Sociology of Law in the study of The Living Law.

The rising of education with an environmentally friendly approach becomes one of the focuses on implementing sustainable growth of social life. This principle includes an attempt to develop the ecologically friendly pesantren. Along the time, pesantren is identified as a religion and social center. Meanwhile, its surrounding environment has not become the primary priority. This paper sought to analyze the activity of community service related to initiating the perspective change of pesantren. The study implies that pesantren not only an education institute practicing educational activity, but also become an agent of change for creating a better social life and society around, and further, to perform the environmentally friendly pesantren. The research used the literature review approach to propose the Eco-Pesantren strategy, the benefits and social-economic impact for pesantren and the greater community. Moreover, the Eco-Pesantren concept becomes the basis and good characteristic learning with concern for the environment. Furthermore, environmental theology brings Eco-Pesantren on the profound philosophy of eco-ethical perspectives.

The Government's policy to increase the development of BTS provision and internet access throughout the territory of the Republic of Indonesia for economic development, especially as a result of the Covid-19 pandemic, is not without obstacles. On the one hand, the internet signal brings positive impacts through economic activities that are carried out efficiently and rationally, but for indigenous peoples such as the Baduy Tribe, Banten feels a negative impact with the entry of foreign values that damage the rules and social order in Baduy. Therefore, the Baduy Tribe applied for the removal of internet signals and the transfer of BTS from the Baduy customary land from various directions. There are two research questions, namely, 1) how Baduy Indigenous People respond to it, and 2) how Baduy local wisdom resolves the dilemma. The above questions are answered through the Socio-Legal method with legal sociology approach. This research is chosen because the author analyses the Government's policy and how the policy implementation for Baduy Tribe. The result of the research shows that Baduy Tribe strongly holds the tradition and ancestral belief system with the constancy of the behavior pattern that orientates to their belief system, has been able to solve their problems through local wisdom, they are willing to make adjustments to their customary law even though it is limited by allowing the existence of internet signals in Outer Baduy. The Government's decision to accept the application is also a decision to allow internet signals in Outer Baduy.

Transformation from a customary law community unit (kesatuan masyarakat hukum adat) in Indonesia into a customary village (desa adat) indicates a move enacted by the government of Indonesia to promote asymmetric decentralization. The problem that arises therein is the loss of self-governing community autonomy when the autonomy is combined with local self-government functions, especially when the supervision from the central government to local units in each local government becomes too excessive. As such, the study aims to examine how asymmetric decentralization affects the paradigm of recognition of government functions (local self-government) in customary law community units turned customary villages. The focus of this research is on the recognition of the Baduy tribe in Kanekes Village, Leuwidamar District, Lebak Regency, Banten Province as a customary village. The output of this research is to know the consequences of adopting asymmetric decentralization to the paradigm of local self-government in customary law community units that become customary villages.

This research is socio-legal research with an ethnographic approach regarding the resolution of maritime resource conflicts in the Kei Islands and the conditions of current state laws and regulations. This article discusses how the overlapping of laws and regulations occurs in law enforcement on marine resource management and how customary law is an alternative for resolving conflicts over marine resources in the Kei Islands. This study found that so many laws and regulations besides helping to create legal order can also have an impact in the form of overlapping authorities between state agencies. On the other hand, the resolution of maritime resource conflicts in practice does not always depend on the positive law of the state alone. Another fact is often found that the community and even the state apparatus also accommodate customary law in resolving conflicts that occur. However, this form of settlement developed into a hybrid form.Keywords: the overlapping regulations, Kei customary law, hybrid legal systems.
