Abstract

AbstractConsumers’ protection ultimately depends on how the institutions on this matter respond, handle, and document all sorts of issues or claims reported by consumers. The Agency for the Settlement of Consumers' Disputes (BPSK) in this respect serves as an alternative off-court solution to any disputes related to consumers’ right protection as stipulated in UU No.8/1999 on consumers’ rights. In fact, the findings of assessment conducted by the National Agency for Consumers’ Protection (BPKN-RI) reveal that the operating procedures of LPKSMs have contributed to the better performance of the existing BPSKs in serving the BPSKs’ functions as required by UUPK 1999, that is, to protect consumers’ right. Focusing on consumers’ financing scheme, this study suggests that BPSKs have successfully managed to prevent consumers’-protection related cases from remaining unsolved. The handling of these cases—which is under the Junior Chief Justice’ supervision and which is a big success—should be appreciated despite the institution’s lack of sufficient law of procedure. The government should therefore put the revised decree (on the Ministries of Industry and Trade dated December 10 2001 on BPSK’s job description) into effect. So far (until 2013) this decree, which was formulated by an expert team in 2006 and was completed in 2007, has not been put into effect even with the disharmony of control on this matter.Keywords: Optimization, the Agency for the Settlement of Consumers' Disputes, the National Agency for Consumers’ Protection, Consumers’ Financing Scheme, Dispute, Consumers’ Claim, disharmony of ControlAbstrakReferensi sahih dalam perlindungan konsumen digantungkan pada bagaimana berbagai lembaga-lembaga perlindungan konsumen menangkap, menangani dan mendokumentasikan berbagai masalah pengaduan-pengaduan konsumen. Badan Penyelesaian Sengketa Konsumen (BPSK) merupakan salah satu lembaga alternatif penyelesaian sengketa perlindungan konsumen di luar pengadilan yang diamanatkan Undang-undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK 1999). Pada kenyataannya, dari sejumlah assessment Badan Perlindungan Konsumen Nasiona Republik Indonesia (BPKN-RI) yang dilakukan di lapangan diketahui bahwa cara kerja LPKSM-LPKSM turut mendorong dan mempengaruhi kinerja BPSK-BPSK yang sudah beroperasi untuk berperan lebih aktif sesuai tugas pokok organisasi (tupoksi) berpihak pada perlindungan konsumen sejalan dengan latar belakang filosofis pemberlakuan UUPK 1999. Fokus kajian penulis pada topik pembiayaan konsumen menunjukkan sukses BPSK-BPSK dalam mencegah terjadinya penumpukan perkara-perkara perlindungan konsumen yang menjadi tanggung jawab Ketua Muda Mahkamah Agung Republik Indonesia (MA-RI) Urusan Perdata Khusus pada tingkat kasasi, layak untuk diapresiasi di tengah-tengah berbagai kendala keterbatasan yang dialami BPSK-BPSK tersebut, antara lain hukum acara yang mengaturnya. Pemerintah perlu segera memberlakukan revisi Keputusan Menteri Perindustrian dan Perdagangan RI tanggal 10 Desember 2001 tentang Pelaksanaan Tugas dan Wewenang Badan Penyelesaian Sengketa Konsumen yang revisinya sudah diselesaikan oleh satu tim ahli (2006-2007) namun hingga kini (2013) revisinya pun belum diberlakukan dalam situasi dimana terjadi disharmonisasi pengaturan.Kata Kunci: Optimalisasi, Badan Penyelesaian Sengketa Konsumen, Badan Perlindungan Konsumen Nasional, Pembiayaan Konsumen, Sengketa, Pengaduan Konsumen, Hukum Acara, Disharmonisasi Pengaturan

Abstract

This study aims to analyze the implications of the Constitutional Court's decision on state rights in the context of tax collection, tax law enforcement efforts and fair legal protection and certainty for all parties interacting with legal entities. This study indicates that the state's right to collect taxes is a valid authority not only because it is lawful utilizing normative legal research and a legal approach as normative juridical research that directs research on secondary material such as books, positive legislation, and written norms. Article 23A of the 1945 United States Constitution states that it is constitutionally anchored on the Constitution. This analysis also demonstrates that the arrangements outlined in Article 2 paragraph 6 and Article 32 paragraph 2 of the KUP Law, which are subject to material review, are extremely important and helpful for preserving legal certainty and justice in tax payments.

Abstract

Land utilization for investment in local areas raises various land related problems that ends with conflicts within the community. A conflict that occurs, usually begins with the management of communal land “tanah ulayat” within the adat law community environment, and in this case, land utilization that is managed by the third party (investors). The basic problem is the difference of perception and expectations toward the company that exists in the land which is claimed by the community. Both parties have their own claim on the land based on each legal systems, in this situation adat law or local law faced with state law which is used by investors. So far, the Indonesian government has yet to have legal grounds in giving a directions for land dispute/ conflict settlement mechanism. This paper attempts to give an input regarding a land dispute settlement mechanism that can be accepted for all disputing parties. The paper features critical analysis using legal pluralism approach towards related government policies and technical regulations in the ministerial level. These regulations, among others are, Minister of Agrarian Regulation No. 5 of 1999 and Ministry of Agrarian and Spatial Affairs Regulation No. 9 of 2015, also the draft of Law regarding Recognition and Protection of Adat Law Community.

Abstract

The purpose of this study is to explain the concept of sustainable development that needs to be implemented in resolving conflicts between indigenous peoples and how the government is making concrete efforts to realize the concept of sustainable development. This study uses a socio-legal approach because it uses non-legal elements in its study. The results of the study show that the values ??contained in the concept of sustainable development can be a means of resolving land conflicts of customary law communities. Considering the concept of sustainable development is also in line with the concept of Planning for Sustainable Use of Land Resources. The implementation of the concept of sustainable development in solving problems of conflict resolution of customary law communities is carried out through achieving goals with political will, consistent government customary law and companies, responsiveness of stakeholders including local governments to land conflicts, and the establishment of a sustainable maintenance system.

Abstract

Masyarakat adat adalah aktor kunci untuk pengelolaan lingkungan karena mereka memegang pengetahuan dan kecerdasaan adat dan lokal yang berharga untuk pengelolaan alam yang berkelanjutan. Desain budaya Sasi yang sudah diwariskan leluhur sebagai intelektualitas lokal masyarakat adat di Maluku dalam konservasi alam memainkan peran penting dalam melindungi keanekaragaman hayati planet ini dan kesehatan ekosistem secara keseluruhan. Konsep penting Sasi dapat diasosiasikan sebagai gagasan kosmovisi yaitu menggambarkan bagaimana 'pandangan dunia (misalnya masa lalu, sekarang dan masa depan) dibentuk bersama dengan tempat orang di dalamnya, menjiwai dunia, memberinya makna, dan, dengan demikian merupakan sarana untuk bertahan hidup. Sasi adalah kompleks pengetahuan-praktik-kepercayaan dan secara konsekuen dibentuk oleh kosmovisi manusia. Tantangan peradaban masyarakat adat menghadapi ancaman besar melalui modernisasi serta globalisasi. Kajian ini bertujuan untuk mengkaji dan menganalisis secara sistematis penemuan intelektual Sasi pada komunal adat di Maluku dalam konservasi alam. Penulis berpendapat bahwa Sasi sebagai bentuk keterlibatan pengetahuan adat lokal dalam pengelolaan lingkungan berbasis pada hubungan manusia-alam yang lebih kuat dan dengan demikian kebijakan konservasi yang lebih akan berhasil.

Abstract

The resolution of customary land conflicts often does not bring results. The protracted conflict inflicted losses on both sides. The community cannot benefit from the land that is their customary right because it is under the control of the Oil Palm Plantation Company (PPKS), while PPKS cannot operate comfortably because it must always face community demands. Until now, there are still conflicts in oil palm plantations that occur between indigenous peoples in Kampar Regency, Riau Province and PPKS. Based on these conditions, the legal issue that is also the main problem in this study is why there is a land conflict between oil palm plantation business investors and indigenous peoples and how the parties resolve it. The author found that the conflict occurred due to differences in views on customary land, the non-implementation of deliberations with indigenous peoples before investment was made, and government policies. Conflict resolution is carried out using different means according to the cause of the conflict.

Abstract

Indonesia had 11 million home backlogs in 2020 and 93% of this number are low-income and poor people. South Tangerang is one of the cities in Indonesia where 80% of the area is built by private developers, and 50% of which is developed by three major companies. The existence of large-scale housing they’ve built has caused local people to move to the peripheral of the housing or to places on the outskirts of the city. This paper analysis how the regulations give companies the authority to control large land area and how its impact to low-income people. By using the socio-legal method, this study aims to reveal the implication of law in society. The results showed that the existence of large-scale housing did not contribute to fulfilling the housing needs of low-income people in South Tangerang City. Regulations in the housing sector have not had any implications for the fulfilment of housing needs for low-income people. There are no small houses that the local people can afford.

Abstract

The Government's policy to increase the development of BTS provision and internet access throughout the territory of the Republic of Indonesia for economic development, especially as a result of the Covid-19 pandemic, is not without obstacles. On the one hand, the internet signal brings positive impacts through economic activities that are carried out efficiently and rationally, but for indigenous peoples such as the Baduy Tribe, Banten feels a negative impact with the entry of foreign values that damage the rules and social order in Baduy. Therefore, the Baduy Tribe applied for the removal of internet signals and the transfer of BTS from the Baduy customary land from various directions. There are two research questions, namely, 1) how Baduy Indigenous People respond to it, and 2) how Baduy local wisdom resolves the dilemma. The above questions are answered through the Socio-Legal method with legal sociology approach. This research is chosen because the author analyses the Government's policy and how the policy implementation for Baduy Tribe. The result of the research shows that Baduy Tribe strongly holds the tradition and ancestral belief system with the constancy of the behavior pattern that orientates to their belief system, has been able to solve their problems through local wisdom, they are willing to make adjustments to their customary law even though it is limited by allowing the existence of internet signals in Outer Baduy. The Government's decision to accept the application is also a decision to allow internet signals in Outer Baduy.

Abstract

This paper intends to examine the enforcement of land policy related land rights for Indonesian citizens of Chinese descent in the Territory Special Region of Yogyakarta. In this context, they can only be granted land rights in the form of HGB, not allowed to obtain property rights to land in Yogyakarta. This restriction is considered as a different treatment of citizens of Chinese descent. This issue becomes important to be discussed considering the Law No. 5 of 1960 on Agrarian Principles ensuring the arrangement of land tenure is directed to be utilized for all Indonesian citizens without exception in a fair manner. The discussion of the issue will be further elaboratedusing the perspective of the sociology of law in order to explain how the people of Yogyakarta responded to such policy.

Abstract

This thesis discusses the implementation of the principle of "equitable efficiency" as contained in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment in legislations concerning electricity. This research analyzes how the Constitutional Court interprets the element of "equitable efficiency" in the constitutional reviews Electricity Law. This article concludes that the meaning of "equitable efficiency" in Article 33 paragraph (4) of the 1945 Constitution After the 4th Amendment is that the national economy should be organized to use the least amount of resources to achieve the greatest amount of welfare which could be enjoyed equitably by the all citizens. In regards to Indonesia's electricity sector, it was found that each electricty regulation has embodied at least one aspect of the principle of "equitable efficiency".
