Abstract

Kajian ini bertujuan menganalisis penyaluran zakat secara langsung dengan tidak melalui Badan Amil Zakat. Urgensi kajian ini adalah memberikan penegasan akan penyaluran zakat yang tepat dengan pertimbangan maslahat. Kajian ini tergolong telaah konseptual dalam bidang kajian yuridis dan teologis. Pendekatan dalam melihat pokok persmalahan dengan menggunakan pendekatan maslahat mursalah. Metode analisis data yang digunakan dengan analisis kualitatif, hal itu dimaksudkan untuk dengan menganalisis permasalahan dan merasionalkan dengan teori maslahat. Temuan dalam kajian ini bahwa; peran amil telah disebutkan di dalam nash dan perundang-undangan zakat dan penyaluran zakat secara langsung oleh muzakki tidak diatur dalam UU zakat. Perundang-undagan zakat hanya menetapkan kewenangan Badan Amil Zakat dalam soal pengumpulkan, pengkoordinasia, pendistribusikan dan pendayagunaan zakat. Dalam konsepsi maslahat terhadap penyaluran zakat secara langsung, tidak kontributif dan produktif karena tidak terencana dengan baik. Implikasi temuan ini bahwa penyaluran zakat melalui Badan Amil Zakat, di samping itu Badan Amil Zakat melakukan pengelolaan zakat dengan baik dan tranfaran agar masyarakat percaya dan termotivasi untu berzakat melalui amil yang resmi.

Abstract

Abstract This study discusses the mechanism of extension of time and additional fees of pawning gold form an Islamic law perspective (case study at the bone unit of the Islamic pawnshop). The main focus is how the process is implemented and its compliance with sharia principles. The research method used is empirical juridical to analyse field practices and normative theological to assess sharia compliance. The results of the study indicate a lack of transparency and detailed information regarding the time extension mechanism and cost details for customers, even though the costs are claimed as mu'nah (maintenance/administrative) costs. This lack of detail and transparency creates gharar (uncertainty), which is prohibited under Islamic law due to its potential for harm and triggering disputes. This study recommends that Islamic pawnshop evaluate and revise their operational procedures, increasing transparency and clarity of information, to ensure full alignment with sharia principles that uphold fairness, openness, and the avoidance of gharar. Abstract

Gorontalo as the Veranda of Medina is one of the reasons for having cultural and customary values ​​that are closely related to the Qur'an and Islam. The practice of maysir that has begun to exist in the Gorontalo Regency community is contrary to the culture and customs of Gorontalo which are based on the Qur'an. This study aims to explain the form of maysir practice in Gorontalo Regency and explain the causes of maysir practice in Gorontalo Regency. This study is a qualitative study. Two forms of maysir or gambling that are often carried out by the Gorontalo Regency community are boat racing and kite games. Kite games and boat racing in Gorontalo Regency are maysir because they fulfill the four elements of maysir. The two implementations of maysir in Gorontalo Regency have several similarities and also have several of the same causes. The perpetrators of maysir in Gorontalo Regency are not equipped with good and correct religious knowledge. Furthermore, although the majority of Gorontalo society is now Muslim, rejection of Islam in Gorontalo also occurred and continues to this day, one of which is the implementation of maysir which occurred in Gorontalo Regency. Coupled with the influence of parties from outside the Gorontalo society who provide understandings that are not in accordance with Gorontalo customs.
