Abstract

AbstrakSubjek penelitian ini adalah bagaimana permasalahan manajemen produktif wakaf di Kabupaten Bone. Jenis penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan yang digunakan adalah: yuridis normatif, teologis, sosiologis, teoretis utilitarianisme atau utilitisme. Sumber data dalam penelitian ini meliputi; data primer berupa hasil kerja lapangan yang dilakukan di wilayah Kementerian Agama Kabupaten Bone dan data sekunder berupa dokumen yang dianggap relevan dengan penelitian dan mendukung penelitian. Hasil penelitian menunjukkan bahwa bentuk potensi bermasalah dari pekerjaan produktif di wilayah Departemen Wakaf urusan agama Kabupaten Bone memiliki potensi untuk menjadi produktif, tetapi Nazhir dan kurangnya optimisme pemerintah termasuk Kementerian Badan Wakaf Indonesia (BWI) sebagai hambatan dalam memproduksi wakaf di Kabupaten Bone. Aset wakaf di Kabupaten Bone sebagian besar ditujukan untuk kepentingan ibadah, dibandingkan dengan manfaat ekonomi dan kesejahteraan umum. Implikasi dari penelitian ini adalah: (1) Potensi optimalisasi wakaf produktif di Kabupaten Bone perlu mendapat perhatian khusus untuk memaksimalkan fungsi Kementerian Agama dan Badan Wakaf Indonesia dalam melakukan pembinaan dan pengawasan wakaf properti; (2) Rekonstruksi paradigma masyarakat tentang wakaf perlu diprioritaskan dalam pemahaman modern tentang persalinan dalam mengelola wakaf secara produktif (3) Alokasi wakaf harus sesuai dan sesuai dengan kebutuhan Pemerintah Komunitas karena itu harus berkontribusi dalam pengelolaan wakaf dengan mempertimbangkan fungsi wakaf dengan skala prioritas.AbstractSubject matter of the research is how the problematic of productive management of endowments in Bone Regency. This type of research is qualitative research approach belongs to use are: normative juridical, theological, sociological, theoretical utilitarianism or utilitisme. The source of the data in this study include; primary data in the form of the results of the fieldwork conducted in the region Ministry of religious affairs Bone Regency and secondary data in the form of the documents considered to be relevant to the study and supports research. The results showed that the form of problematic potential of productive work in the territory of the Waqf Ministry of religious affairs Bone Regency have the potential to be productive, but Nazhir's and the government's lack of optimism include the Indonesian Waqf Ministry and Agency (BWI) as an obstacle in producing waqf in Bone Regency.Waqf assets in Bone Regency are mostly intended for the benefit of worship, compared to economic benefits and general welfare. The implications of this study are: (1) the Optimisation potential of productive endowments in the Regency of Bone need to attention specially to maximize the functions of Ministry of religious affairs and Indonesian Waqf Agency in doing coaching and supervision of property endowments; (2) The reconstruction of the paradigm of society about endowments need to be prioritized in the modern understanding of the childbirth on managing endowments productively (3) Allocation of endowments must be appropriate and in accordance with the needs of the Community Government must therefore contribute in the management of endowments by considering the function of endowments with a scale of priorities.

Abstract

AbstractThis study examines the role of religious courts in the construction of Islamic inheritance law. Its urgency is to open the dimensions of birth and the growth of inheritance law in the development period of religious courts. In addition, it opens up concrete reasons for the existence of the inheritance law bill that has yet to reach a climax. The methodology in this study is a narrative literature study, with a historical approach by observing juridical aspects in the growth of inheritance law.The findings in this study show that Islamic law existed since the era of the sultanate and was used as an applied law in society, including inheritance law that has been embedded in Islamic law. The authority of the religious judiciary in the field of inheritance became disoriented when the colonialists entered the colonies by applying the receptiveness theory as outlined in the form of the Staatsblad. The climax of the authority of the religious courts is the unification of the judiciary (one roof system) and its independence as the executor of judicial power. The challenge for religious courts in the field of inheritance is the unavailability of material law and the inheritance law bill which creates uncertainty.Keywords: Dynamics; Inheritance law; Religious Courts.

Abstract

This study is a review of the decision of the Mahkamah Konstitusi (MK) No.22 / PUU-XV / 2017 about the age limit of marriage. The marriage age formulation carried out by the Mahkamah Konstitusi through recommendations in its decision to be revised up to the age of female marriage between 18-19 years. This study is a normative study with a library analysis of the Mahkamah Konstitusi decision regarding the age of marriage in the perspective of maqasid syari'ah. The results of the study indicate that the Mahkamah Konstitusi decision No.22 / PUU-XV / 2017 regarding changes in the age of marriage for women is in line with the concept of maqasid syari'ah.

Abstract

Religious moderation is a government program that is encouraged in response to the movement of separates, independence, radicalism and terrorism. The existence of religious moderation has been pursued in various spaces as a form of internalization of moderate attitudes in state life. However, it is not impossible that religious moderation drew criticism because it is considered to moderate the Religion of Islam as something final. To urge to highlight religious moderation based on the Medina charter as an embodiment of tolerance. This study aims to describe the reflection of the Medina charter as a basis for religious moderation in managing the country and, in addition, reveal the dimensions of the Medina Charter, which is full of tolerance and moderate values. Meteorologists in this study used a literature method with the conceptual study. The approach used is a theological, historical and sociological approach, with descriptive-analytical analysis methods. The results of this study showed the construction of the Medina charter as a peace treaty and at the same time as the constitution of Medina. The Charter of Medina is referred to as the constitution because it has qualified the form and content of a constitution. The Medina Charter can be called a base of religious moderation. It can be seen from the indicators of religious moderation that they are full of the values of state unity, peace and tolerance. The rhythm of tolerance is evidence of the breath of the Medina charter inherent in religious moderation in heterogeneous cultures.

Abstract

Kajian ini bertujuan menganalisis penyaluran zakat secara langsung dengan tidak melalui Badan Amil Zakat. Urgensi kajian ini adalah memberikan penegasan akan penyaluran zakat yang tepat dengan pertimbangan maslahat. Kajian ini tergolong telaah konseptual dalam bidang kajian yuridis dan teologis. Pendekatan dalam melihat pokok persmalahan dengan menggunakan pendekatan maslahat mursalah. Metode analisis data yang digunakan dengan analisis kualitatif, hal itu dimaksudkan untuk dengan menganalisis permasalahan dan merasionalkan dengan teori maslahat. Temuan dalam kajian ini bahwa; peran amil telah disebutkan di dalam nash dan perundang-undangan zakat dan penyaluran zakat secara langsung oleh muzakki tidak diatur dalam UU zakat. Perundang-undagan zakat hanya menetapkan kewenangan Badan Amil Zakat dalam soal pengumpulkan, pengkoordinasia, pendistribusikan dan pendayagunaan zakat. Dalam konsepsi maslahat terhadap penyaluran zakat secara langsung, tidak kontributif dan produktif karena tidak terencana dengan baik. Implikasi temuan ini bahwa penyaluran zakat melalui Badan Amil Zakat, di samping itu Badan Amil Zakat melakukan pengelolaan zakat dengan baik dan tranfaran agar masyarakat percaya dan termotivasi untu berzakat melalui amil yang resmi.

Abstract

This study aims to identify indicators of religious moderation in the internalization of Sipakatau, Sipakainge’, and Sipakalebbi cultures among the Bugis community in Mallari Village, Awangpone District, Bone Regency. It employs qualitative research in the form of case studies and interpretive methods. Data collection involves observation and interviews, with the analytical theory of indicators of religious moderation in Indonesia. The findings revealed several indicators of religious moderation in the mentioned cultures. Firstly, Sipakatau culture demonstrates tolerance and the accommodation of local values, as seen in socio-political life, emphasizing respect for political differences and upholding deliberation. Secondly, Sipakainge’ culture is committed to national values, evident through community compliance with village regulations and educational activities aligned with national education orientation. Lastly, the value of humanism is observed in the internalization of Sipakalebbi culture, as reflected in village government policies that empower individuals with disabilities. Theoretical implications suggest that religious moderation can be integrated into local wisdom through socio-political, educational, and cultural activities. However, the study’s limitations include not examining obstacles or challenges in mainstreaming religious moderation within the Sipakatau, Sipakainge’, and Sipakalebbi cultures in Mallari Village.

Abstract

This study aims to explore the local wisdom values of the Buginese community regarding Sipakatau, Sipakainge, and Sipakalebbi, manifestations of local wisdom values, and their relevance to religious moderation in Indonesia. This research is classified as qualitative descriptive research with exploratory methods and anthropological approaches. This research was conducted in Mallari Village, Bone Regency, which still has a strong practice of local wisdom and historical values. Data collection was carried out through in-depth interviews, observation, and documentation. The collected data was analyzed, and then the qualitative data were coded for the credibility of the results using the Nvivo-12 software. The results of the study show that (1) the local wisdom values of the Buginese, Sipakatau, Sipakainge, and Sipakalebbi are understood as traditional teachings/noble values, life guidelines, identity and customs that are in line with the Shari'a. (2) The manifestation of Buginese local wisdom values is reflected in people's behaviour by humanizing each other, having good etiquette towards the government, and mutual respect. (3) The relevance of Buginese local values to religious moderation programs lies in the human values of humanizing one another (sipakatau),  respecting  each other (sipakalebbi),  and  reminding  each other (sipakainge’).  The principle of Buginese local wisdom values that as long as they are human beings, it is appropriate to humanize, respect, and remind each other regardless of ethnicity, religion, and race; this is in line with national commitment and tolerance in religious moderation in Indonesia.

Abstract

The environmental law enforcement is a form of re-actualization of the hopes and dreams of a good living environment. The portion and content of positive law in environmental law enforcement are sufficient in ensnaring perpetrators of environmental destruction. In Islamic law, environmental enforcement is something that must be guarded and preserved, this is stated in the Qur'an and hadith. This study is a literature study, which examines the legislation on environmental enforcement and text arguments relating to the environment. The approach in this study is a formal juridical approach to the scale of positive law and a normative approach to Islamic law. The findings in this study prove that the rules regarding environmental law enforcement in positive law are very adequate. In Law Number 32 of 2009, it has accommodated acts of environmental destruction that can be ensnared with administrative, civil and criminal offenses that lead to fines and imprisonment. Meanwhile, in Islamic law, law enforcement against environmental destruction in jinayah law is subject to ta'zir punishment or a sentence stipulated by the government. In the concept of benefit, environmental destruction needs to be enforced because it is against the benefit of human life and/or can threaten the survival of mankind. The implication of this finding is that environmental law enforcement has been regulated in environmental legislation and is very adequate, and this is in line with the concept of negligence in Islamic law, so that environmental violations need to be taken firmly in order to maintain environmental sustainability. Keywords: Law enforcement; Environment; Positive Law; Islamic law.

Abstract

AbstractThis study emphasized the interconnection between the concepts of Islamic law and customary law in the marriage ceremony. The focus of this study examined the concept of marriage in Islamic law and customary law, as well as the interconnection between Islamic law and the custom of marriage in Bugis Bone. This study was a descriptive analytical which described the sources obtained and then analyzed. The researcher applied normative and historical social approaches. Comparative methods were used to analyze various data and then correlated one another. This was conducted to measure the interconnection of Islamic law and customary law, therefore the relevant and irrelevant elements can be identified. The results of this study proved that the concept in the implementation of the marriage ceremony showed correlation between Islamic law and customary law of Bugis Bone. Both are considered not contradictory, even the procession of the marriage in Bugis Bone tradition has philosophical values that are in line with the principles of Islamic law. Keywords: Marriage ceremony-Islamic Law-Customary Law.

Abstract

The study of progressive sources of modern Islamic finance aims to look closely at the increase of Islamic financial resources in Islamic philanthropic discourse. The superiority of Islamic finance in the modern era will be able to predict the contribution of Islam to the country in the social religious field. Methodology of analysis namely by examining actual scientific sources by considering formal juridical aspects. This research proves that the progression of Islamic finance in the modern era is highly responded, it is seen from the regulation of simplification of the implementation of Islamic philanthropy; for example, zakat, waqf and BaitulMal. The response to the progression of Islamic finance is important to pay special attention toeven thoughtstill being guided by productive-based management guidelines. The great desire of Islamic finance progress in the modern era is to be able to contribute through productive movements through the coordination of independentinstitutions.
