Abstract

Pasien mempunyai hak untuk mendapatkan informasi mengenai penyakit dan tindakan medis dari tenaga kesehatan di rumah sakit. Pemberian informasi ini merupakan upaya mengurangi risiko tuntutan pasien terhadap rumah sakit. Penelitian ini bertujuan untuk mengetahui pemenuhan hak pasien atas informasi penyakit dan tindakan medis di RS TMC Tasikmalaya berdasarkan Undang-Undang Nomor 44 tahun 2009 tentang Rumah Sakit, mengetahui upaya Rumah Sakit dalam mengatasi masalah-masalah yang timbul dalam pelaksanaannya dan memahami pertanggungjawaban rumah sakit yang tenaga kesehatannya tidak memberikan informasi penyakit dan tindakan medis. Penelitian bersifat deskriptif kualitatif dengan pendekatan yuridis normatif. Hasil penelitian menunjukkan  bahwa pemenuhan hak pasien atas informasi penyakit dan tindakan medis di Rumah Sakit TMC Tasikmalaya secara umum sudah sesuai dengan Undang-Undang  Rumah Sakit di Indonesia walaupun terdapat beberapa masalah yang masih berpotensi menimbulkan tuntutan pasien. Rumah Sakit telah berupaya mengatasi masalah-masalah yang timbul dengan mengeluarkan beberapa kebijakan dan melakukan supervisi pelaksanaan di rumah sakit. Rumah Sakit bertanggung jawab terhadap kerugian yang ditimbulkan akibat  kelalaian tenaga kesehatan di rumah sakit yaitu dengan adanya doktrin respondeat superior, doktrin rumah sakit bertanggung jawab terhadap kualitas perawatan (duty of care) dan doktrin vicarious liability, hospital liability dan corporate liability. Doktrin ini diimplementasikan pada ketentuan Pasal 46 Undang-Undang Rumah Sakit di Indonesia yang menentukan bahwa rumah sakit bertanggung jawab secara hukum terhadap semua kerugian yang ditimbulkan atas kelalaian tenaga kesehatan di rumah sakit.

Abstract

This study is motivated by the increasing complexity of financing coordination between the National Health Insurance (BPJS Kesehatan) and supplementary health insurance providers under the Coordination of Benefits (KAPJ) scheme, which creates potential claim disputes and administrative risks for hospitals. Although Minister of Health Decree No. HK.01.07/MENKES/1117/2025 regulates payment allocation and membership verification mechanisms, it does not explicitly recognize pre-admission confirmation as a preventive legal protection instrument. This research aims to analyze the normative position of pre-admission confirmation within the KAPJ framework, conceptualize it as a preventive legal protection mechanism, and formulate a proportional implementation model. The study employs a normative juridical method using statutory and conceptual approaches through literature review of relevant regulations and scholarly works. The findings indicate that pre-admission confirmation possesses implicit normative legitimacy through membership verification obligations and system integration requirements, and functions as a risk allocation mechanism that clarifies payment responsibilities prior to service delivery. Its implementation enhances legal certainty, reduces fraud potential, and minimizes claim disputes, provided that access to emergency medical services remains guaranteed.

Abstract

This study examines the binding force of the WHO Patient Safety Rights Charter (2024) as a soft law instrument within the Indonesian legal system and evaluates the potential application of its principles in the formulation of national health policies. The research employs a normative juridical method with descriptive, analytical, and comparative approaches toward international norms, including the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Global Patient Safety Action Plan (2021–2030), as well as relevant national regulations. The findings indicate that although the WHO Charter is not legally binding, it possesses substantial normative and moral authority derived from the ethical legitimacy of the World Health Organization and its alignment with the principles of the right to health. In Indonesia, several principles of the Charter have been partially reflected in Law No. 17 of 2023 on Health; however, normative gaps remain, particularly regarding patients’ participatory rights and medical justice. Soft law acquires its normative strength through moral legitimacy, broad acceptance, and integration into domestic policy frameworks. The study concludes that strengthening legal protection for patient safety in Indonesia requires the explicit incorporation of the WHO Charter’s principles into implementing regulations, thereby fostering a health law system that is equitable, accountable, and grounded in human rights.
