Abstract

The construction of toll roads often comes into contact with the community, because the land used in the construction often involves community land, legal protection efforts for the community whose land is used for the construction of toll roads for public interest are very important considering that community losses are often not paid. Like the case of the Bajaj Bajuri Mat Solar comedy soap opera actor who has not received compensation for the construction of the Cinere-Serpong Toll project. For the public interest, the community is legally protected from the use of their land for toll road projects. In addition to knowing the community's efforts to obtain compensation in accordance with legal provisions reviewed from Law Number 2 of 2012 concerning Land Acquisition for Public Interest, this is intended to ensure legal protection for the community regarding the use of their land for toll road projects. The research methodology used is the normative legal approach (normative legal research method). By examining the laws and regulations and library sources, a normative legal research approach was carried out. This study focuses on library research to examine the legal materials used, both primary, secondary, and tertiary. The results of the study indicate that there is an imbalance between the legal provisions stipulated in the law and the reality of its application in the field. These factors include the lack of information in the community regarding the legal protection provided or the lack of public knowledge about community rights. Although some people are not satisfied with the compensation they receive, they can file a lawsuit with the local district court within 14 days of the minutes of the deliberation being signed to obtain the value and form of compensation. The government has ensured that the community can obtain their rights by following the deliberation path with the land institution with the recipient party. The lack of knowledge of the lower class community to obtain legal assistance and the large number of people who do not know their legal rights regarding land ownership are obstacles in defending the community whose land is used for toll road construction. This often causes them to be unable to fight for their rights when their land is used for public interest. .

Abstract

Bandung and Suwon were designated as sister cities on August 25, 1997. They were chosen as sister cities because they share several similarities, including their status as centers of education and innovation, their development as smart cities, their rich cultural values, and their deep historical backgrounds. Both cities are also strategically located. Urban development in Bandung and Suwon focuses on efforts to create cities that are comfortable to live in by ensuring safety and convenience for their residents. This study aims to analyze and compare the legal protection provided to pedestrians in the cities of Bandung and Suwon. Pedestrians are among the most vulnerable road users, often exposed to accidents and violations of their rights to public space. In Bandung, there is currently no regional regulation that specifically governs legal protection for pedestrians. In contrast, the Suwon city government has implemented a range of progressive policies, including pedestrian priority zones and national laws that safeguard pedestrian rights. The research employs a normative juridical method with a qualitative descriptive-comparative approach. The findings reveal that Suwon demonstrates a significantly higher level of effectiveness in implementing pedestrian protection regulations compared to Bandung. Legal certainty in Suwon is supported by clear, written, and consistently enforced regulations, whereas Bandung continues to face challenges related to the clarity and consistency of legal enforcement in practice. This study recommends that Bandung adopt Suwon’s best practices to strengthen legal protection for pedestrians.

Abstract

Abstract Legal protection for customers in the banking system plays a crucial role in maintaining public trust and ensuring national financial stability, particularly in cases of bank liquidation. This study aims to analyze the legal framework governing customer protection, identify obstacles in its implementation, and formulate strategic efforts to strengthen customers’ legal standing. The research employs a normative juridical approach through the study of legislation, legal literature, and relevant secondary data. The findings indicate that although legal protection has been regulated under Law No. 10 of 1998 concerning Banking and Law No. 24 of 2004 concerning the Deposit Insurance Corporation (LPS), its implementation still encounters challenges. These include customers’ low legal literacy, limited access to liquidation information, inaccurate customer data, and delays in the verification process by related institutions. Moreover, the status of customers as concurrent creditors weakens the certainty of their rights’ fulfillment. Therefore, strategic measures are required, including regulatory strengthening, enhanced transparency in the liquidation process, continuous legal advocacy, and improved synergy among banking authorities and the deposit insurance institution. Such efforts are expected to realize more effective, fair, and equitable legal protection for customers. Keywords: Legal protection; bank liquidation; Deposit Insurance Corporation.
