Abstract

Permasalahan geopolitik pada masa sekarang adalah suatu hal yang sangat kompleks karena menyangkut bagaimana bangsa, negara serta masyarakat pada umumnya berinteraksi dengan tidak melepaskan kepentingannya masing-masing. Pada saat yang bersamaan, perkembangan teknologi telah membawa pada suatu kondisi yaitu interaksi tersebut terjadi secara sangat cepat yang belum pernah terjadi dalam sejarah umat manusia. Keberadaan interaksi yang tinggi ini dapat membawa keberkahan namun juga bencana bagi umat manusia, yang sangat tergantung dengan bagaimana para aktor untuk memahami dan memanfaatkan kemampuan geopolitik. Pemahaman dan kemampuan memanfaatkan geopolitik akan memberikan para aktor strategis suatu kesadaran terhadap konsekuensi untuk setiap kebijakan strategis yang diambilnya. Pemahaman geopolitik adalah mustahil dikembangkan tanpa mengakui pentingnya keberadaan konsep bangsa dan negara di masa kini.

Abstract

The book, which is published by the National University of Singapore Press, is written by two professors, John G. Butcher and R. E. Elson who are based in Australia. The writers explained on how Indonesia managed to earn the place as the greatest archipelagic state in the world, as gaining international recognition for its claim when the United Nations Convention on the Law of the Sea formally recognized the existence of a new category of states known as “archipelagic states” which had given these states sovereignty over their “archipelagic waters”, in the year of 1982. The book which has very strong subject on Indonesian and International Law is written by two professors which have no law background, put the important point on how a small group of Indonesians diplomat gave their persistence effort and finally give tremendous effect on how International Law of the Sea is currently conducted.

Abstract

The 1945 Constitution of the Republic of Indonesia in an explicit manner stipulates that every Indonesian citizen has the obligation to participate in defending the state. This is stated on the article 27 clause 3 of the Constitution, which reads, “Each citizen shall have the right and duty to participate in the effort of defending the state”. In a more specific manner, state defending is also stated on article 9 clause 1 and 2 of the Law number 3 year 2002 on the State Defence. The article mentions that the effort on state defending is elaborated in the performance of state defence, which includes civic education, compulsory basic military training, voluntary or compulsory service in Indonesia Armed Forces, and professional service. However, at practical level, the effort on state defending has not yet been performed in a systematic manner, particularly with the absence of comprehensive state defending education system for young generation. This circumstance may affect to the national resilience, which is related to the dynamics of geopolitics. This article suggests a system of state defending education, starts from secondary (junior high school and senior high school) to the preparation for tertiary education levels or entrance into workforce. In the future, the system may become reference for the formulation of concept on curriculum, as well as policy and regulation on state defending

Abstract

Pancasila as the basis of the state is the main guideline for Indonesian political and social life. In the field of law, Pancasila has been determined as the main source national legislation process. However, the competing interests in formulation of legal policies sometimes put Pancasila values at difficult position to be implemented. Indonesian lawmakers should end the unfavorable situation by utilizing geopolitical knowledge. Moreover, currently there is important change in the global geopolitical map which provides opportunity for Indonesia to make legal policies which are in accordance with its national interests. This research was conducted based on the inter-disciplinary legal research methodology by using a socio-legal approach for the data collection process. This research analyzes the natural resource sector which is very important for Indonesia, but vulnerable to foreign intervention. The result of the study finds the values of Pancasila in the midst of changes in the global geopolitical map can actually be implemented if the legal policy is mainly based on Indonesia's national interests.
