This study aims to describe and analyze the Notary Public’s accountability as an LDMO for the abuse of trust related to certificate embezzlement and legal remedies that can be taken by the appeared as the aggrieved party for this action. The type of research used in this research is normative juridical research. The type of data used in this research is secondary data through document studies or literature studies. The legal materials that have been collected are then processed and analyzed systematically using qualitative data analysis methods. The results showed that the Notary Public as LDMO has accountability for the abuse of authority given based on trust related to embezzlement of certificates in the management of land rights transfer registration. The accountabilities that can be charged are administrative, criminal, and moral accountabilities. In addition, legal remedies taken by parties who feel aggrieved are categorized through two channels, namely the non-litigation by reporting to the local Regional Supervisory Council of Notary Public and the litigation by reporting to the local police. Based on this conclusion, it is recommended that the Notary Public and the Notary Public as LDMO carry out their duties and positions by upholding and complying with the applicable code of ethics and laws and regulations. Then an amendment to Law No. 2 of 2014 and Government Regulation No. 24 of 2016. In this case, it is necessary to add provisions on criminal sanctions against the Notary Public’s actions that violate the Office Law and the code of ethics to have a deterrent effect. In addition, the Notary Public and LDMO will be more careful, responsible, and professional in carrying out their professions and offices.

Certificate of land ownership regulated in the Undang-Undang Pokok Agraria (“UUPA”) is an ownership proof of the land right where it becomes powerful evidence. The increasement of necessity of a land is not followed by the increasement of the availability of land that can be utilized by the society, which causes many disputes related to the ownership or land right. One of many problems that arises is double certificate on a land. Double certificate on a land causing risks on the owner of land right where such phenomena caused by the maladministration to criminal action. Badan Pertanahan Nasional (“BPN”) as an institution established by the Government that holds the sole authority in national land should be responsible in the matters related to the land dispute, especially double certificate. Beside that, there is a necessity on the legal protection to be provided by the State for the owner of land right to protect the rights of the land owner. The research performed using juridical normative with legislation approach and conseptual approach. Research result will be written in the form of explanatory-analysis where the writer explains the case in the case of lawsuit and the theories related with the problem, then analyzes the consistency between the problem and the applicable laws and regulations or theories. Deed of Recognition of Debt is a deed that is generally made by the notary public, followed by binding guarantees that are attached (accessoir) the main agreement. In practice, the Deed of Recognition of Debt can be transferred to another party who is willing to buy it, so that The Sale and Purchase Agreement of Rights to Cessie and Agreements of Transfer of Rights to Cessie is notarized made. The last party who has the cessie rights sometimes does not get his rights because the debtor is no longer known to exist. That is why the party who has the cessie rights claims it to District Court so that it can be determined as the owner of the object of collateral. This case happened at the North Jakarta District Court No. 123/Pdt.G/2018/PN. JKT.UTR where the Panel of Judges decided that the Court's Decision could be a substitute of the land deed sell and purchase based on the sale and purchase agreement of rights to cessie and agreements of transfer of rights to cessie. This court decision is certainly a new legal breakthrough, especially in the notarial and land affairs fields. This type of research is normative with qualitative data analysis, and concluding deductive means. Based on the author's analysis, The Sale and Purchase Agreement of Rights to Cessie and Agreements of Transfer of Rights to Cessie is valid is authentic deeds that are valid and in accordance with applicable law. The public notaries also run their authority properly, so that the deeds have fulfilled the external, formal, and material aspects. Land deed officer who will make the deed on Land Certificate Number. 5217/Bojongnangka has been protected by law because the Land deed officer is obliged to obey the Decision of the Panel of Judges as the competent general authority, and the land deed officer only run his authority after the Land Office of Tangerang Regency has processed the owner's name change of initials TN to SS.

One of the most observable achievements in the development of liberal democracy in Indonesia after the fall of the Soeharto’s New Order is the flourishing freedom of the press. One notable case was the Indonesian Playboy magazine and court decisions pertaining to it, which was successful in drawing massive public and even international attention. By thoroughly describing thoughts, feelings, values, and beliefs of various actors involved, this article explains the impacts of liberal democracy experimentation in Indonesia after the amendment of 1945 Constitution. This case has provided an excellent opportunity in observing the rule of law in enforcing the freedom of the press in Indonesia facing social cultural elements strongly adhered to by Indonesian people.

Undang-Undang Jabatan Notaris (UUJN) telah mengatur secara jelas mengenai Kewajiban dan Larangan Notaris, tetapi sampai saat ini masih ada Notaris yang dalam menjalankan kewenangnya telah mengabaikan kewajiban dan larangan tersebut salah satunya terdapat dalam putusan Majelis Pengawas Wilayah Notaris Sumatera Barat Nomor 02/Pts/MJ.PWN.Sbr/09/2020 dalam membuat akta perubahan anggaran dasar CV Notaris membuat perubahan anggaran dasar tanpa persetujuan pengurus lain oleh karenanya dalam tesis ini bertujuan untuk menganalisa sesuai dengan permasalahan yang di angkat yaitu bagaimana tanggung jawab Notaris membuat anggaran asar CV tanpa persetujuan pengurus lain dan bagaimana akibat dan kekuatan hukum dari akta perubahan anggaran dasar CV tanpa persetujuan pengurus lain tersebut. Penelitian ini merupakan penelitian hukum dengan pendekatan yuridis normatif, dengan tipologi deskirptif eksplanatoris yang dilakukan dengan studi pustaka Berdasarkan hasil penelitian, diperoleh kesimpulan. Pertama, pertanggungjawaban hukum yang dapat dijatuhkan kepada Notaris terhadap akta-akta yang dibuatnya. Dalam hal Notaris telah melakukan perbuatan melawan hukum dengan memasukan keterangan palsu ke dalam akta yang berdampak kerugian terhadap pihak lain serta pelanggaran terhadap kewajiban sebagai notaris dalam prosedur pembuatan akta perubahan anggaran dasar CV, yang menyebabkan akta yang dibuatnya tergolong akta yang cacat hukum, maka dirinya dapat dipertanggungjawabkan secara hukum dan dikenakan sanksi Admistratif, Perdata dan Pidana. Akibat hukum dari akta anggaran dasar yang dibuat tanpa persetujuan pengurus lain yang cacat hukum menyebabkan pengurus yang tidak dimintakan persetujuan tersebut mengalami kerugian serta tidak dapat mendapatkan hak dan keuntungan dari CV oleh karenanya akta perubahan anggaran dasar CV tersebut harus dinyatakan batal demi hukum agar kekuatan hukum akta perubahan anggaran dasar CV tersebut tidak lagi mengikat para pihak dan harus kembali seperti keadaan semula dan perikatan-perikatan yang timbul sejak adanya akta perubahan anggaran dasar CV tersebut turut tidak berkekuatan hukum dan batal demi hukum karena terdapat kausa yang terlarang. Pembagian waris seharusnya diselesaikan secara adil dan sesuai fakta yang sebenar-benarnya, khususnya mengenai identitas para ahli waris. Jika terdapat dokumen palsu dalam pembagian waris, hal tersebut dapat merugikan ahli waris lainnya. Seseorang yang seharusnya bukan ahli waris lalu mendapatkan harta warisan, dapat menjadikan perhitungan harta warisan tidak sesuai dengan perhitungan dalam hukum waris. Penelitian ini bertujuan untuk mengetahui keabsahan dari surat Keterangan Waris jika dalam pembuatannya menggunakan dokumen palsu dan tanggungjawab notaris pembuat surat keterangan waris yang dalam pembuatannya menggunakan dokumen palsu. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan menggunakan analisa data yang digunakan adalah preskriptif. Jenis data yang digunakan adalah data sekunder Hasil penelitian yang penulis dapatkan bahwa Surat Keterangan Waris yang dibuat dengan menggunakan dokumen palsu mengakibatkan Surat Keterangan Waris tersebut menjadi tidak sah dan tidak mempunyai kekuatan pembuktian yang sempurna. Notaris yang tidak mengetahui kalau dokumen yang digunakan oleh penghadap adalah dokumen palsu, hanya bertanggungjawab terhadap akta yang dibuatnya, bukan terhadap dokumen yang palsu. Land is one of the valuable assets, because it has a high economic value. Land is a vital object in human life, because it has various values. Due to the high demand for land, it triggers the number of land mafias. The land mafia mode is to issue land evidence, manipulate cases and pretend to carry out land sales and purchase transactions. If someone wants to make a sale and purchase, someone is needed in the process of making the Sale and Purchase Deed. In the case of the land mafia that is currently rife, they will later work with a notary to process the AJB. The provisions of the Law on Notary Positions and this Code of Ethics have regulated the obligations and prohibitions of a Notary in carrying out his duties. The form of research used in this research is normative juridical research, namely research that refers to theories and laws and regulations related to this research. If there is a violation committed by a Notary which has been prohibited by laws and regulations. The notary will be subject to a code of ethics sanction as well as sanctions in the Notary Position Act. There are several efforts that can be done to eradicate the land mafia that is so rampant in Indonesia: 1) take firm action against the land mafia actors; 2) improve the integrity and professionalism of the apparatus; 3) improve cooperation/coordination between apparatus in handling and eradicating land mafia; 4) carry out land certification.

AbstractOne of Mohammad Hatta's contributions to Indonesia was the selection of an economic system based on cooperatives as contained in Article 33 paragraph (1) of the 1945 Constitution of NRI. Hatta's thinking about cooperatives is still very relevant which was proven by the use of the rationale in the Constitutional Court Decision No .28 / PUU-XI / 2013 regarding the request for a judicial review of Law No. 17 of 2012 concerning Cooperatives. This study aims to determine what influences are believed to have contributed to the thinking of the Hatta cooperative. This study uses normative legal research methods with a historical approach. The results of the study found 3 (three) main influences for Hatta's cooperative thinking, namely: first economic and political thinking developed in Europe when Hatta settled there, secondly, the influence of the implementation of the colonial economic system by the Dutch East Indies Government. Third, the influence of the customs of the Indonesian people who have conformity with the values and principles of cooperatives. AbstrakSalah satu sumbangan pemikiran Mohammad Hatta bagi Indonesia adalah dipilihnya sistem ekonomi berdasarkan koperasi sebagaimana yang terdapat dalam Pasal 33 ayat (1) UUD NRI Tahun 1945. Pemikiran Hatta mengenai koperasi masih sangat relevan, hal ini dibuktikan dengan digunakannya landasan pemikiran tersebut dalam Putusan Mahkamah Konstitusi No.28/PUU-XI/2013 atas permohonan uji materiil Undang-Undang No.17 Tahun 2012 Tentang Perkoperasian. Penelitian ini bertujuan untuk mengetahui pengaruh-pengaruh apa saja yang diyakini telah memberikan kontribusi bagi pemikiran koperasi Hatta. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan historis (historiscal approach). Hasil penelitian menemukan 3 (tiga) pengaruh utama bagi pemikiran koperasi Hatta, yaitu: pertama pemikiran ekonomi dan politik yang berkembang di Eropa selama Hatta menetap di sana, kedua, pengaruh penerapan sistem ekonomi kolonial oleh Pemerintahan Hindia Belanda. Ketiga, pengaruh adat istiadat masyarakat Indonesia yang memiliki kesesuaian dengan nilai dan prinsip koperasi.Â

Ulayat rights are very unique rights in the control and management of natural resources that are carried out together. However, the implementation of Law Number 5 Year 1960 concerning the Basic Provisions of Agrarian Principles (UUPA), ulayat land is one of the sources of social conflicts that have occurred until now. This article discusses the historical study of customary land law and how to conduct a resolution of social conflict. Thus, it is very important to study the history of ulayat land in order to obtain a suitable model for solving the root-cause of conflict as well as its social conflict in the present time. This article was prepared using a normative legal research methodology with a historical approach. The results of this study found that the existence of ulayat land as a form of land law system that lived in adat law communities existed long before the arrival of the Europeans. The ulayat land conflict increased after independence, especially in the New Order Era and the Reformation Era. This research proposes two model prescriptions for handling communal land conflicts. First, long term which is led directly by the President by considering the involvement of the House of Representatives. Second, the short term led by the Ministry of ATR/BPN by accelerating the handling of ulayat rights cases. Abstrak Hak ulayat merupakan suatu hak yang sangat khas dalam penguasaan dan pengelolaan sumber daya alam yang dilakukan secara bersama-sama. Namun dalam praktik pelaksanaan Undang-Undang No. 5 Tahun 1960 tentang Pokok-Pokok Agraria (UUPA), tanah ulayat justru merupakan salah satu sumber konflik sosial yang terjadi sampai dengan sekarang. Artikel ini membahas mengenai telaah sejarah hukum tanah ulayat dan penanganan konflik sosialnya. Telaah sejarah hukum tanah ulayat sangat penting dilakukan agar diperoleh akar masalah konflik dan bentuk model penanganan konflik sosialnya pada masa sekarang. Tulisan ini disusun dengan metodologi penelitian hukum normatif dengan pendekatan historis. Hasil penelitian ini menemukan bahwa eksistensi tanah ulayat sebagai suatu bentuk sistem hukum pertanahan yang hidup di masyarakat hukum adat telah ada jauh sebelum kedatangan Bangsa Eropa. Konflik tanah ulayat justru menguat pasca kemerdekaan khususnya di Era Orde Baru dan Era Reformasi. Penelitian ini mengusulkan dua preskripsi model untuk penanganan konflik tanah ulayat. Pertama, jangka panjang yang dipimpin secara langsung oleh Presiden dengan mempertimbangkan keterlibatan Dewan Perwakilan Rakyat. Kedua, jangka pendek yang dipimpin oleh Kementerian ATR/BPN dengan percepatan penanganan kasus-kasus hak ulayat.

In both conventional and electronic buying and selling agreements, the protection of consumer rights should be the main concern of business actors. Although there are already regulations governing consumer protection, until now there are still frequent violations of consumer rights, especially in e-commerce transactions. This article is juridical-normative research that compares the laws and regulations concerning consumer protection law in e-commerce transactions between Indonesia, India, and the United States. Through comparative studies and analysis using data sources from the literature, this study explores how the legal certainty of consumer protection in e-commerce transactions in Indonesia is being achieved. In addition, this research also describes the comparison regarding the legal certainty of consumer protection in e-commerce transactions in Indonesia between India and the United States based on the United Nations Guidelines for Consumer Protection. Furthermore, this study provides a prescription for how the legal certainty of consumer protection in e-commerce transactions in Indonesia should be when viewed from a comparison of consumer protection laws in e-commerce transactions in India and the United States.
