Abstract

Conflict of land estates mastery between PT Sumber Sari Petung (PT SSP) and citizens of Ngancar Kediri with the background of the confidence of citizens in the three (3) villages, those are Babadan Village, Sugih Waras Village and Sempu Village Ngancar District that the land owned by PT SSP is the land which belongs to them, while PT SSP insisted that the land is theirs which is reinforced by the Right Granting Decree of BPN (SK. No. 28 / HGU / DA / 1074). This conflict began culminated with the release of the National Land Agency Decision No. 66 / HGU / BPN / 2000, which decided that the land that had been controlled by PT SSP area of 654.92 hectares of land declared as a state land and give the Cultivation Rights Title area of 3.842.760 M2 (three million eight hundred and forty-two thousand seven hundred and sixty meters square) to PT. SSP and the other 2.500.000 (250 Ha) is declared as an object of land reform. This conflict solution is initially done by approaches and discussions involving various parties. However, this method ultimately cannot resolve the conflict, and finally the solution is done through justice. In the judicial process, from the PTUN, the Civil Court to the Supreme Court ruling, all of them in favor of the PT SSP side. But the court ruling that already has a permanent legal force cannot be enjoyed by PT SSP, because BPN as the defeated party does not want to implement the ruling. Due to the absence of certainty, finally the completion  has been done again through  some case titles  by the Land Office from Kediri District. Finally, in 2011, PT SSP give up the land area of 250 hectares, to be released and declared as an object of Land reform which will be redistributed to farmers in three villages.

Abstract

In Yogyakarta Non-Indigenous Indonesian Citizens may not own land with proprietary rights, this is based on the Deputy Governor s Instruction No.898 I A 1975 concerning Univormity of Policy on Granting of Land Rights Against Non-Indigenous Indonesian Citizens, in reality the Deputy Governor’s Instruction is still valid to date although DIY has fully enacted the LoGA since 1984.This research is normative legal research. This study uses primary legal material in the form of applicable legislation and secondary legal material in the form of legal literature. This study uses a legislative approach that is used to review and analyse all laws and regulations that have relevance to the legal issues being addressed. Based on the research result obtained data that the land office in DIY still applies the Deputy Governor’s instruction No.898 I A 1975 so that non-native Indonesian citizens will not be given land with a status of ownership rights, and seen from the hierarchy of legislation the Deputy Governor s instruction should be No. 898 I A 1975 may not defeat the Law 1945 Constitusion of the Republic of Indonesia, the LoGA, and the Citizenship Act where the Deputy Governors Instruction is under the Act. This also violates the principle of Lex Superior Derogate Inferiori the higher Act defeats the Law under it.

Abstract

From the perspective of government administrative law, the protection of Village Treasury Land due to the village head's negligence is a serious violation of law. Village treasury land is a village asset that must be managed well to improve the welfare of village communities and increase village income. However, village treasury land is often converted and sold unilaterally for personal purposes, such as building a residence or housing built on village treasury land. This is a violation of government administrative law because the management of village treasury land is part of public law, which discusses government power in general and village government in particular. The Village Head, as the holder of management power, must manage the Village Treasury Land based on the Regulation of the Minister of Home Affairs of the Republic of Indonesia No. 01 of 2016 concerning Village Asset Management. In managing Village Treasury Land, the Village Head must coordinate with the Village Consultative Body (BPD) to improve the welfare of the Village community and increase Village income. Therefore, the protection of Village Treasury Land due to the Village Head's negligence is a violation of government administrative law that must be followed up.

Abstract

The study aims to examine the Kasultanan (the Sultanate) and the Kadipaten, which are deemed to be legal entities recognized as having land ownership rights which are utilised and managed by the community. The proposed legal problems are, first, how the community utilise the land owned by the Kasultanan (the Sultanate) and the Kadipaten, second, how is the protection and legal certainty of the community that controls and utilises the land owned by the Kasultanan and the Kadipaten. The normative research method is used in this study, which includes a study of various relevant papers, journals, laws, and regulations, in addition to data and information obtained from various sources. The results of the study indicate that land owned by the Kasultanan and the Kadipaten is currently managed and utilised based on the Letter of Ownership. The Kasultanan and the Kadipaten can provide building rights and usage rights to the community, thus providing legal certainty and protection in return. It is hoped that the findings of this research can broaden the understanding and provide relevant data for the policy makers.Keywords: Kadipaten Land, Kasultanan Land, Legal Protection, Utilisation. AbstrakTujuan dari penelitian ini adalah untuk mengkaji Kesultanan dan Kadipaten sebagai badan hukum yang diakui memiliki hak milik atas tanah, digunakan dan dikelola oleh masyarakat. Rumusan masalah penelitian ini adalah, pertama, bagaimana masyarakat menggunakan tanah milik Kasultanan dan Kadipaten, dan kedua, bagaimana perlindungan dan kepastian hukum masyarakat yang mengguasai dan menggunakan tanah milik Kasultanan dan Kadipaten. Metode penelitian normatif digunakan dalam penelitian ini yang meliputi kajian terhadap berbagai makalah, jurnal, undang-undang, dan peraturan yang relevan, di samping data-data dan keterangan yang diperoleh dari berbagai sumber. Hasil penelitian menunjukkan bahwa tanah milik Kasultanan dan Kadipaten saat ini dikelola dan digunakan berdasarkan Surat Kekancingan. Kasultanan dan Kadipaten dapat memberikan hak guna bangunan dan hak pakai kepada masyarakat sehingga memberikan kepstian dan perlindungan hukum. Diharapkan bahwa hasil temuan penelitian ini dapat memperluas pemahaman dan menyediakan data yang relevan bagi para pembuat kebijakan.   Kata Kunci: Penggunaan, Perlindungan Hukum, Tanah Kasultanan dan Kadipaten.

Abstract

This study aims to comprehensively examine the transition process of land registration from analog certificates to electronic certificates, and to analyze how this mechanism can ensure legal certainty and provide legal protection for land ownership rights. The era of the industrial revolution 4.0, with the use of digital technology, is believed to be able to improve the quality of life of the community. Changes in information technology in public services are important, such as the digital transformation of land services, which is gradually realized with the transition of manual land services to electronic. Electronic certificates as digital identities are developing rapidly towards the implementation of e-government, with their application providing security guarantees that cannot be manipulated, damaged, or misused. The urgency of this research in Indonesia is related to analog certificates that are transformed into electronic certificates, making land data valid and minimizing land disputes and overlaps. High efficiency and effectiveness in land administration provide various benefits for security and transparency in land ownership. The method applied is empirical juridical research using primary and secondary data. This study explains the analysis of regulations for issuing electronic certificates in land registration activities that can guarantee data authentication, integrity, and anti-repudiation of electronic certificates. Thus, electronic certificates are proven to be more secure in terms of data protection and can improve efficient legal protection and modernize the land system.   Tujuan penelitian ini adalah untuk mengkaji secara komprehensif proses peralihan pendaftaran tanah dari sertipikat analog menuju sertipikat elektronik, serta menganalisis bagaimana mekanisme tersebut dapat menjamin kepastian hukum dan memberikan perlindungan hukum terhadap kepemilikan hak atas tanah. Era revolusi industri 4.0 dengan penggunaan teknologi digital diyakini mampu meningkatkan kualitas hidup masyarakat. Perubahan teknologi informasi dalam pelayanan publik menjadi hal penting, seperti transformasi digital pelayanan pertanahan yang diwujudkan secara bertahap dengan dimulainya pelayanan pertanahan manual menjadi elektronik. Sertipikat elektronik sebagai identitas digital berkembang pesat menuju implementasi e-government dengan penerapannya memberi jaminan keamanan yang tidak dapat dimanipulasi, dirusak atau disalahgunakan. Urgensi penelitian ini di Indonesia berkaitan dengan sertipikat analog yang bertransformasi ke sertipikat elektronik menjadikan data tanah menjadi valid dan meminimalisir adanya sengketa tanah dan tumpang tindih. Efisiensi dan efektivitas yang tinggi dalam administrasi pertanahan, memberikan berbagai keuntungan atas keamanan dan transparansi dalam kepemilikan tanah. Metode yang diterapkan yakni penelitian yuridis empiris menggunakan data primer dan sekunder.  Penelitian ini menjelaskan analisis terhadap peraturan penerbitan sertipikat elektronik dalam kegiatan pendaftaran tanah yang dapat menjamin autentikasi data, integritas dan anti penyangkalan sertipikat elektronik. Dengan demikian, sertipikat elektronik terbukti lebih aman dalam perlindungan data serta dapat meningkatkan perlindungan hukum yang efisien, dan modernisasi sistem pertanahan.
