Abstract

Joint property in marriage law in Indonesia comes from Indonesian tradition law which isthen used as the written law namely Undang-Undang No. 1 Tahun 1974 About Marriage and Compila-tion of Islamic Law with the aim to provide balanced position between husband and wife. The objectiveis in line with maqashid al shariah. But, the joint property that occur automatically in the written lawneeds to be reconstructed based on the ownership of Islamic law that the existence of joint property isin line with Islamic law.

Abstract

Mediation dominates the dispute resolution process in BPSK Banjarmasin, including insurance disputes between consumers (TMC) and insurance business actors, resulting in a Peace Agreement. However, in reality, the business actors do not implement the Peace Agreement. The aim of this research is to identify the actions and factors causing consumer actions regarding the non-implementation of the Peace Agreement by the business actors in the dispute. This study adopts an empirical legal research method and utilizes a case study approach. The collected data is then processed and analyzed descriptively and qualitatively. The result of the research indicate that the action taken by the consumer is to negotiate with the business actors by contacting them through WhatsApp and Telegram. Several actions that should have been taken by the consumer but were not: 1) The consumer did not register the Peace Agreement resulting from the mediation by filing a lawsuit in court; 2) The consumer did not resolve the dispute through arbitration; 3) The consumer did not file a breach of contract lawsuit regarding the Peace Agreement resulting from the mediation that the business actors did not fulfill. There are three factors causing consumer actions, namely: 1) Knowledge; 2) Economic; 3) Cultural.

Abstract

Advokat merupakan profesi yang memberikan jasa hukum, saat menjalankan tugas dan fungsinya dapat berperan sebagai pemberi penasehat (advice) hukum, pendamping atau pun menjadi kuasa hukum untuk dan atas nama kliennya. Dalam penerapannya, seorang Advokat memberikan pembelaannya terhadap kasus dalam perkara pidana yaitu KDRT dimana seorang isteri melakukan kekerasan terhadap suaminya. Dalam kasus ini seorang Advokat memberikan pembelaan terhadap kasus perkara pidana tersebut agar mendapatkan keringanan serta kebebasan atas hukumannya dan Advokat tersebut berhasil membebaskan memberikan pembelaannya atas beberapa pertimbangan. Penelitian ini bertujuan untuk mengetahui bagaimana persepsi ulama terhadap upah (Ujrah) yang diterima oleh seorang Advokat atas pembelaan terhadap kasus dalam perkara pidana, dan mengetahui apa dasar hukum yang digunakan para Ulama dalam memberikan persepsinya. Jenis penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif, menggunakan metode wawancara, dengan para informan berjumlah 7 orang Ulama MUI Kota Banjarmasin. Berdasarkan hasil penelitian yang dilakukan oleh penulis, ditemukan 7 orang Ulama MUI Kota Banjarmasin yang menyampaikan persepsinya, para Ulama memiliki perbedaan pendapat yaitu ada 1 orang Ulama yang mengharamkan upah tersebut karena terdapat kezaliman dalam kasus yang ditangani oleh Advokat. Ada pula 6 Ulama yang menghalalkan upah tersebut karena para Ulama sepakat bahwa upah (Ujrah) yang di terima adalah termasuk dalam Ijarah dan upah tersebut sudah sesuai dengan kriteria upah yang di halalkan.

Abstract

The trade in mystical oil is a phenomenon that exists in society, one example being in Central Kalimantan, particularly in the city of Kuala Kapuas. This practice has raised doubts among the community regarding its legitimacy. Therefore, this study aims to explore the opinions of religious scholars in Kuala Kapuas and the arguments they use. This is an empirical legal study involving interviews with five religious scholars from the Indonesian Ulema Council (MUI) and the Majelis Ta’lim. The results of the study indicate that the religious scholars are divided into two groups: the first group permits the buying and selling of mystical oil provided it meets the legal requirements of Islam, while the second group prohibits it, as it is considered to involve elements of fraud and the potential for idol worship.

Abstract

This paper discusses the standardisation of Islamic financial products at the national and international levels to reveal what needs to be done to achieve standardisation of Islamic financial products at the national and international levels and how to ensure that Islamic financial products meet the established standards. This type of research is library research with a qualitative approach. Islamic financial products are products based on Islamic economic principles. Standardisation can be defined as the process of developing and implementing standards to ensure consistency, quality, and suitability of products. In the context of Islamic finance, the purpose of standardisation is to create a clear and transparent framework that can be followed by all Islamic industry players so that Islamic financial products and services are in line with Islamic principles, banking regulations, and market needs. According to the author, the way to achieve standardisation of Islamic financial products at the national and international levels is by establishing binding rules for all Islamic financial institutions that comply with Islamic principles, banking regulations, and market needs. To ensure that Islamic financial products meet Sharia standards and compliance, the Sharia Supervisory Board (SSB) must perform effectively.
