Abstract

Attention to sustainable development globally has accelerated the focus on renewable energy consumption in recent decades. This study discusses the causality between carbon dioxide emissions, renewable energy consumption-hydropower, renewable energy consumption-geothermal, biomass, and other sources on economic growth. Using the VECM and Granger Causality methods to see the relationship between variables in the long term and short term. This study uses time series data from 1990-2020 in Indonesia. The results of the study are that carbon dioxide emissions and renewable energy consumption-hydropower are significantly positive for economic growth in the long and short term, while renewable energy consumption-geothermal, biomass, and other sources are significantly negative for economic growth. In terms of causality, in the long term, all variables have a one-way causal relationship, while in the short term, carbon dioxide emissions and economic growth and renewable energy consumption-geothermal, biomass, and other and economic growth have an alternating causality relationship.

Abstract

This journal aims to increase public understanding about the use of rotator lights by the Jambi City Satpol PP. Among them are the provisions for the use of rotator lights by the Satpol PP according to law number 22 of 2009 concerning road traffic and trasportation and the level of effectiveness of the use of rotator lights by the Jambi City Satpol PP. this journal uses a legal sociology approach with data collection methods through observation, interviews and documentation. Based on the research conducted, the following results and conclusions were obtained: 1) the use of rotator lights by Satpol PP is regulated in law number 23 of 2014 concerning government, further provisions regalding Satpol PP are regulated in government regulation numer 16 of 2018 concerning police units. Civil service. Law numer 22 of 2009 concerning road traffic and transportation does not clearly regulate the use of rotator lights by satpol PP but only regulates generally the procedures for traffic. 2) the rotator ligh used by the jambi city Satpol PP is very effective in carrying out tasks when in an urgent situation because this rotator light can be a notification for the public to know that when the rotator ligh is turned on that there is a very critical situasion that needs to proritized. Abstract

This study critically examines the legal dynamics of restorative justice (RJ) implementation in Indonesia, focusing on the marginalization of customary legal systems as a result of state-driven formalization. While RJ is normatively intended to promote reconciliation and community-based dispute resolution, its centralization particularly through prosecutor-led Restorative Justice Houses has led to the symbolic domestication of indigenous justice practices. The central legal issue addressed in this study is the recolonization of customary law within the framework of state-administered RJ, which systematically weakens the roles of traditional mediators such as hakam and ninik mamak. Employing an empirical juridical method and a socio-legal approach, this research draws on field data from Jambi Province and offers comparative insights from RJ practices in New Zealand, Canada, and Rwanda to uncover the tension between formal legal norms and living customary law. The findings suggest that Indonesia’s RJ model reflects a form of legal recolonization rather than genuine legal pluralism. This article proposes a hybrid legal model that substantively empowers indigenous justice mechanisms within a plural legal framework. The main contribution of this research lies in its decolonial critique of state dominance in RJ practices and its proposal for a multilevel reconstruction strategy local, national, and international, that institutionalizes customary-based justice. The study is limited by its geographical scope and the absence of quantitative evaluation. Future research is encouraged to broaden regional coverage and empirically assess the effectiveness of hybrid legal models in balancing state authority with community autonomy.

Abstract

Penelitian ini bertujuan untuk menganalisis kepastian hukum putusan Dewan Kehormatan Penyelenggara Pemilu (DKPP) terhadap Komisi Pemilihan Umum (KPU) dalam pelaksanaan Pemilu 2024, ditinjau dari peraturan perundang-undangan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan analitis (analytical approach). Berdasarkan hasil penelitian, ditemukan bahwa meskipun putusan DKPP bersifat final dan mengikat sebagaimana diatur dalam Pasal 458 Ayat (13) Undang-Undang Nomor 7 Tahun 2017, dalam praktiknya, putusan ini masih dapat digugat melalui Pengadilan Tata Usaha Negara (PTUN). Ketidakpastian hukum ini menimbulkan implikasi terhadap integritas penyelenggaraan pemilu, khususnya terkait netralitas dan profesionalitas KPU. Mengacu pada teori kepastian hukum Lon Fuller, putusan DKPP idealnya harus memenuhi prinsip-prinsip kepastian hukum, termasuk konsistensi dalam penerapan hukum dan keberlakuan aturan yang jelas serta tidak bertentangan. Namun, dengan adanya celah hukum yang memungkinkan putusan DKPP dibatalkan melalui jalur PTUN, efektivitas putusan DKPP sebagai instrumen penegakan kode etik menjadi lemah. Abstract

This article examines the evolving role of the Indonesian Constitutional Court (Mahkamah Konstitusi, MK) in advancing substantive justice through constitutional adjudication grounded in Pancasila and informed by moral and religious values, particularly Islamic ethical reasoning. Departing from rigid legal formalism, the Court’s recent jurisprudence demonstrates an increasing reliance on principles of justice, humanity, proportionality, and public morality in interpreting constitutional norms. Employing a normative juridical research method with a conceptual and case-based approach, this study analyzes Constitutional Court Decision No. 97/PUU-XIV/2016 concerning the recognition of indigenous belief systems and Decision No. 24/PUU-XV/2017 on the constitutional right to religious education as primary legal materials. These decisions are examined in light of constitutional theory, comparative constitutionalism, and Islamic legal philosophy. The findings reveal that the MK no longer functions merely as a negative legislator that annuls unconstitutional statutes, but increasingly acts as a constitutional moral reasoner that actively shapes constitutional meaning. Islamic values, particularly those reflected in maqāṣid al-sharī‘ah, are not applied as formal sources of positive law but operate as ethical and normative references that enrich substantive justice within a Pancasila-based legal order. This integrative approach enables the harmonization of constitutionalism, moral reasoning, and religious values without undermining legal certainty, pluralism, or democratic governance. The article argues that Indonesian constitutionalism represents a distinctive model of value-based constitutional adjudication, offering a significant theoretical contribution to global constitutional discourse in plural societies.
