Abstract

Notary is a public official appointed by the government to carry out the task of making authentic deeds or other legal actions in accordance with applicable statutory provisions. The functions of a notary vary depending on the legal system in each country. In some cases where documents notarized by a notary contain false or fraudulent information, the notary may be subject to legal sanctions. Law Number 2 of 2014 concerning the Office of a Notary indeed regulates the duties of a notary in certifying detailed documents provided by clients, as stated in Article 16 paragraph (1) letter (f). Notary Honorary Council (MKN) is an institution established under UUJN and has a role in carrying out ethical oversight of notaries. However, MKN is not an institution that provides direct legal protection in criminal cases. MKN's duties are more focused on the ethical and disciplined aspects of the notary profession. This research uses a normative legal approach and departs from a void of norms, the aim of the research can be to identify and analyze the legal protection available to notaries in contexts where there are no specific provisions regarding the matter. The results of the study show that there is legal protection for notaries, namely stated in article 66 paragraph (1) UUJN by establishing a new legal protection institution for Notaries, namely MKN, law enforcers when summoning them must ask permission from the Notary Honorary Council.

Abstract

Abstrak Penelitian ini bertujuan untuk mengkaji kembali penerapan konsep 3R di Jakarta berdasarkan peraturan yang berlaku. Sebagai negara berkembang yang sedang mengalami proses industrialisasi besar-besaran, Indonesia juga menimbulkan sebuah kekhawatiran di balik perkembangan tersebut. Dimana, kekhawatiran ini ternyata menjadi kenyataan dan berdampak pada permasalahan-permasalahan yang terjadi saat ini. Dalam penerapannya kita harus memikirkan efek dari berkembangnya perindustrian itu sendiri. Seiring berjalannya waktu dan meningkatnya perindustrian, salah satu permasalahan yang mulai terjadi di berbagai daerah yaitu mulai terjadinya peningkatan volume sampah yang jika dilihat isu ini terus meningkat sepanjang tahun ke tahun. Isu ini menjadi penting karena beberapa sampah tidak mudah terurai , dan membuat pencemaran tanah serta mengurangi kesuburan tanah. Salah satu jenis sampah yang menghambat kesuburan tanah yaitu sampah plastik , hal ini dikarenakan sampah plastik butuh waktu yang lama dan sulit terurai oleh organisme didalam tanah . Sehingga diperlukan pengelolaan sampah sebagai salah satu cara untuk mengurangi sampah plastik adalah dengan menerapkan konsep 3R yaitu Reuse, Reduce, Recycle. Di dalam konsep ini diharapkan masyarakat dapat mengolah kembali limbah plastik agar menjadi barang yang dapat dipakai kembali. Konsep ini juga diatur dalam aturan perundang-undangan yang akan dibahas lebih lanjut di dalam artikel ini. Kata Kunci: Analisis, Konsep Reuse, Reduce, Recycle (3R), Peraturan Undang-undang, Jakarta Abstract This study aims to review the application of the 3R concept in Jakarta based on applicable regulations. As a developing country that is undergoing a massive industrialization process, Indonesia also raises a concern behind this development. However, this concern turned out to be a reality and emerged into the problems that occur today. In its application we must think about the impact of the development of the industry itself. As time goes by and the increase in industry, one of the problems that began to occur in various regions is the increase in the volume of waste, where this issue continues to increase from year to year. This issue is important because some waste is not easily decomposed, and pollutes the soil and reduces soil fertility. One type of waste that inhibits soil fertility is plastic waste. This because plastic waste takes a long time and is difficult to decompose by organisms in the soil. So waste management is needed. One way to reduce plastic waste is to apply the 3R concept Reuse, Reduce, Recycle. In this concept, it is hoped that the community can reprocess plastic waste so that it becomes reusable goods.
