Abstract

This article aims to analyze the dispute between Indonesia and China regarding the Natuna Islands from an international law perspective. As a maritime country with many islands, Indonesia has abundant natural wealth in its territory. However, Indonesia and China's conflicting claims over the Natuna Islands have created tensions and disputes between the two countries. The dispute is related to the ownership and utilization of resources on Natuna Island which is in the Indonesian Exclusive Economic Zone. The impact of this dispute includes economic instability, divisions between countries, political losses, and social problems. In dealing with these impacts, it is necessary to carry out effective resolution efforts. Settlement of the Natuna islands dispute between Indonesia and China can be done through several strategic steps. First, regional border management is improved, economic activity is improved by exploring for oil in the Natuna Islands, then through an international legal approach, this article will review the relevant legal basis, legal arguments used by both parties, as well as possible settlement efforts.

Abstract

Abstrak Penelitian ini membahas pemikiran hukum Roscoe Pound, seorang tokoh hukum terkenal yang mempopulerkan pandangan sociological jurisprudence dan pragmatic legal realism. Pound memandang hukum sebagai alat rekayasa sosial yang bertujuan mencapai kebahagiaan dan kesejahteraan masyarakat dengan menyeimbangkan kepentingan umum, sosial, dan individu. Fungsi hukum, menurutnya, meliputi pemeliharaan hukum dan ketertiban, menjaga status quo, menjamin kebebasan individu, dan memenuhi kebutuhan masyarakat. Dalam implementasinya di Indonesia, teori Roscoe Pound tentang fungsi hukum dan penerapan hukum menuntut perubahan hukum yang mencerminkan karakter dan nilai-nilai bangsa dengan tetap mempertimbangkan prinsip-prinsip universal. Implementasi hukum progresif diperlukan untuk memastikan hukum melayani masyarakat dan membantu mencapai tujuan nasional. Lebih lanjut, teori Roscoe Pound juga berpengaruh terhadap bagaimana pengaturan tentang hukum kontrak diatur di Indonesia. Kata Kunci: Fungsi Hukum, Penerapan Hukum, Roscoe Pound; Legal Realism, Social Jurisprudence Abstract This research discusses the legal thinking of Roscoe Pound, a famous legal figure who popularized the views of sociological jurisprudence and pragmatic legal realism. Pound views law as a social engineering tool aimed at achieving the happiness and well-being of society by balancing public, social and individual interests. The function of law, according to him, includes maintaining law and order, maintaining the status quo, guaranteeing individual freedom, and meeting the needs of society. In its implementation in Indonesia, Roscoe Pound's theory regarding the function of law and the application of law demands legal changes that reflect the character and values of the nation by keep universal principles in mind. Progressive legal implementation is necessary to ensure the law serves society and helps achieve national goals. Morover, Roscoe Pound’s theory also has influence in how Indonesian contract law is regulated in Indonesia.
