Abstract

Penelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum terhadap pemakai terdahulu dan kesesuaian bentuk perlindungan hukum pemakai terdahulu yang dikaitkan dengan putusan PN Niaga Surabaya Nomor. 1/Pdt.Sus/Paten/2019/PN.Niaga.Sby Penelitian ini menggunakan penelitian hukum normatif dengan pendekatan konseptual, pendekatan perundang-undangan dan pendekatan kasus. Sumber dan jenis bahan hukum dari studi kepustakaan yaitu bahan hukum primer dan sekunder. Kesimpulan yang didapat dari penelitian ini adalah bentuk perlindungan hukum terhadap pemakai terdahulu adalah berupa permohonan yang dijelaskan dalam Pasal 14 sampai Pasal 18 Undang-Undang Nomor 13 Tahun 2016 tentang Paten serta kesesuaian perlindungan hukum terhadap pemakai terdahulu adalah Penggugat bukan merupakan pemakai terdahulu karena invensinya tidak sama dengan Tergugat serta invensi tersbut telah dihapus oleh Direktorat Jenderal Hak Kekayaan Intelektual dikarenakan tidak membayar biaya tahunan.

Abstract

This study argues that the Commercial Court Decision NO 389/Pdt.Sus-PKPU/2020/PN-Niaga.Jkt.Pst has inadequate legal consideration, as well as identifies the legal standing of insurance holders that file the case of debt payment delay. This study is a normative one. Results of this study show that the regulation for this issue is the Law of Bankruptcy and Debt Payment Delay, Law of Financial Security Authority, Law of Insurance, Supreme Court Decision, and Rules of Financial Security Authority. In addition, the decision granting the plaintiff the delay has inadequate legal consideration, as the only institution eligible for the demand for delay is OJK. In other words, insurance holder is legally ineligible to file the case of delay demand.

Abstract

This study describes the regulation of Corporate Social Responsibility (CSR) of banking companies, as well as its practice at PT. Bank NTB Syariah. This study is a normative-empirical one with statute, conceptual, and sociological approaches. Results of this study show that the regulation regarding CSR refers to the Law No 40 of 2007 of Limited Company, the Government Regulation No 47 of 2012 of Social and Environmental Responsibility, and the Government Regulation No 54 of 2017 of Regional-Owned Enterprises. Those three regulation manage that companies must allocate 5% of their profit for Social and Envionmental Responsibility in the form of CSR. In the case of PT. Bank NTB Syariah, it has been providing social programs and activities as CSR for society, including education, religion, health, natural and non-natural disaster management, art, and culture.
