Abstract

The president has a very strong position in a government that adheres to a presidential system of government because in addition to being the head of government, the president is also the head of state. The President is based on Article 17 paragraph (2) of the 1945 Constitution of the Republic of Indonesia which states: The President appoints and dismisses ministers. The power that the President has over the powers granted by the Constitution of the Republic of Indonesia directly without interference from other institutions. This study aims to determine the legal position of the president in carrying out a cabinet reshuffle according to laws and regulations and to find out the legal consequences of a cabinet reshuffle carried out by the President. This research method uses normative legal research. The results of this study indicate that the power of the President in running the government is as the chief executive. In addition to the President and also the Vice President as the main center in the government, ministers are assisted. These ministers are not ordinary high-ranking employees but are technically executor of the president's duties. The president has a very strong position in a government that adheres to a presidential system of government because in addition to being the head of government.

Abstract

Bahwa bentuk perlindungan hukum atas para pihak baik dari pelaku maupun korban kecelakaan lalu lintas tersebut di jaminan hak hukum nya masing-masing sebagaimana dalam peraturan perundang-undangan. Baik korban maupun pelaku menempuh jalan terbaik untuk diselesaikan dengan musyawarah tanpa ada paksaan maupun tekanan atas kesepatan yang dibuat tersebut tidak dilarang oleh undang-undang malah sebaliknya bahwa undang-undang meberi perlindungan hukum selama itu tidak bertetantangan dengan hukum yang berlaku. Mediasi Penal adalah bentuk penyelesaian pelanggaran hukum pidana terhadap kecelakaan lalu lintas dimana penyelesaiannya diluar pengadilan. Mediasi Penal mengedepankan nilai-nilai kemanusian yang diwujudkan dalam bentuk keadilan bagi para pihak baik korban maupun pelaku. Mediasi Penal adalah suatu model penyelesaian yang menghadirkan korban, pelaku, keluarga korban maupun keluarga pelaku dan masyaarakat serta institusi resmi yaitu penyidik yang berhubungan dengan konflik hukum tersebut. Fungsi penyidik ini adalah penengah untuk menyelesaikan pelanggaran hukum. Mediasi Penal ini mendorong semua pihak untuk aktif dan berpartisipasi selain itu dalam proses penyelesaian ini dilakukan secara sukarela dan tanpa paksaan. Setelah adanya kesepakatan dari para pihak ini akan dituangkan dalam bentuk surat pernyataan yang ditanda tangani para pihak serta penyidik atas kesapakatan ini adalah sah menurut hukum.

Abstract

Kemajuan teknologi informasi khususnya dalam dunia online sudah digunakan masyarakat sebagai alat untuk memperoleh lainnya. Penegakan hukum pidana yang kurang tegas dan jelas terhadap berita bohong (hoax) dan perbuatan tidak menyenangkan lainnya di sosial media seringkali menjadi pemicu banyak terjadinya penyebaran berita bohong tersebut. Bagaimana penegakan hukum pidana terhadap penyebaran berita bohong (hoax), Penerapan penegakan hukum pidana terhadap penyebaran berita bohong (hoax). Penyebaran berita bohong (hoax) dapat diatur dalam Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 tentang perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Penyebarkan berita bohong (hoax) adalah media sosial, media sosial di internet seperti Facebook, Instagram, LINE, dan Whatsapp, Messanger dll.Dalam Penerapan berdasarkan kasus-kasus yang berkaitan dengan penyebaran berita bohong (hoax).

Abstract

The existence of the Council's Honorary Court as a supporting tool is contained in Article 119 of Law Number 17 of 2014 concerning MD3 in conjunction with Law Number 2 of 2018 concerning MD3 in conjunction with Law Number. 13 of 2019 concerning MD3. That the Council's Honorary Court was established by the DPR with the aim of maintaining and upholding the honor and dignity of the DPR as a representative institution of the people. That the implementation of the Election which is carried out directly is a manifestation of the implementation of democracy which is a manifestation of the sovereignty of the people. In the election, violations of the law were found as regulated in Law Number 7 of 2017 concerning Elections. That election crimes are a form of violation of the law related to acts of falsification of documents, money politics and there is also intimidation of voters and others. That these actions are alleged violations of election crimes because they are contrary to laws and regulations. That to ensure the existence of an election crime, it must go through a court process with a judge's decision, which must first be processed by the Gakkumdu Center, which is an element of Bawaslu, the National Police, and the Attorney General's Office of the Republic of Indonesia. That if proven to have committed an election crime as stated in the district court decision, the legislative candidate has committed an ethical violation, although this must be processed legally in accordance with the mechanism regulated in the DPR Council's Ethics Court, namely referring to the MD3 Law, Regulation of the People's Representative Council Number. 1 of 2015 concerning the Code of Ethics of the People's Representative Council of the Republic of Indonesia and Regulation of the People's Representative Council Number. 2 of 2014 concerning the Procedures of the Council's Ethics Court.
