The Historiography of Islamic Law: The Case of Tārīkh al-Tashrī‘ Literature Arif Maftuhin

Abstract

Tārīkh al-Tashrī‘ (the history of sharia affairs) is a relatively new genre of Islamic historiography and very popular among students of Islamic Law. Despite its popularity, academics of Islamic historiography seem not interested in studying it. There is hardly any academic paper seriously studied the literature. This paper is a first effort to explore the Tārīkhu’t-tashrī‘ literature through a historiographical analysis. As an initial exploration, it argues that Tārīkh al-Tashrī‘ is the latest development of Islamic historiography, developed in the 19th century, but it is a genre of the old Islamic historiography with some new elements. The new elements are influenced by both modern Western historiography and the need to re-open the supposedly closed gate of ijtihād. The paper studied books of Tārīkh al-Tashrī‘ available during the research between 2013-2015. [Tārīkh al-Tashrī‘ adalah genre yang relatif ‘baru’ dalam matarantai perkembangan historiografi Islam­. Literatur ini sangat popular dan menjadi mata kuliah wajib di fakultas-fakultas Syariah di Indonesia maupun Timur Tengah. Hanya saja, meskipun ia sangat populer sebagai mata pelajaran, Tārīkh al-Tashrī‘ belum banyak menarik minat para peneliti historiografi. Makalah in berusaha mengeksplorasi literatur Tārīkh al-Tashrī‘ dengan pendekatan historiografi. Makalah ini berpendapat bahwa Tārīkh al-Tashrī‘, meski terlihat ‘modern’ dari segi kelahirannya, tidak banyak berbeda dengan literatur historiografi klasik. Perbedaan terjadi karena adanya pengaruh historiografi Barat dalam model penulisannya dan karena kebutuhan untuk membuka kembali pintu ijtihad yang tertutup. Abstract

Sunan Kalijaga State Islamic University (UIN Sunan Kalijaga) Yogyakarta declared its commitment to become an inclusive university in 2007 with the establishment of its Centre for Disability Studies and Services (now Centre for Disability Services). As a higher education institution, this commitment should be reflected on its organizational structure as well as its three main missions, i.e. teaching and learning, research and publication, and community service and engagement. This study was aimed at examining and mapping UIN Sunan Kalijaga’s contribution to research and publication in the field of disability studies and inclusive education. A mixed-method approach was employed to collect data. Item pooling was conducted through literature study and structured interviews as well as focus group discussion. This was followed by a systematic content analysis to answer the main research question: in what forms has UIN Sunan Kalijaga contributed to research and publication in this field. A further analysis was conducted to examine the extent of its contribution in terms the number and kinds of research and publications and their impact to the academic world.[Universitas Islam Negeri Sunan Kalijaga Yogyakarta menyatakan komitmennya untuk menjadi universitas inklusif pada tahun 2007 dengan pendirian Pusat Studi dan Layanan Disabilitas (sekarang Pusat Layanan Disabilitas). Sebagai lembaga pendidikan tinggi, komitmen ini harus tercermin pada struktur organisasinya serta tiga misi utamanya, yaitu pengajaran dan pembelajaran, penelitian dan publikasi, serta layanan dan keterlibatan masyarakat. Penelitian ini bertujuan untuk menguji dan memetakan kontribusi UIN Sunan Kalijaga untuk penelitian dan publikasi di bidang studi disabilitas dan pendidikan inklusif. Pendekatan metode campuran digunakan dalam penelitian ini untuk mengumpulkan data. Pengumpulan dilakukan melalui studi literatur dan wawancara terstruktur serta diskusi kelompok yang terfokus. Penelitian diikuti oleh analisis konten sistematis untuk menjawab pertanyaan penelitian utama: dalam bentuk apa UIN Sunan Kalijaga berkontribusi untuk penelitian dan publikasi dalam bidang ini. Analisis lebih lanjut dilakukan untuk memeriksa sejauh mana kontribusinya dalam hal jumlah dan jenis penelitian dan publikasi serta dampaknya terhadap dunia akademik.]

Abstract

Fatwa is an aspect of Islamic law that addresses all aspects of Muslims lives into details. It has significant influence in bridging divine will with mundane affairs. This study focuses particularly on the advocacy for the rights of people with disabilities in Indonesia through Nahdlatul Ulama’s (NU) fatwas. Based on primary data obtained from documents, observations, and interviews, this study describes the inclusion of the disability issue in this Indonesian traditional Islamic organization. The research describes how issues of the rights of people with disabilities proposed by disability-rights activists is adopted, modified, and formulated in the form of a typical NU religious fatwas called Fiqih Penguatan Penyandang Disabilitas. It argues that NU's fatwas can provide theological basis to promote the rights of people with disabilities in Indonesia and has been well accepted by public. Ministry of Religious Affairs has republished the book and distributed to their offices across the country.

Abstract

Since ratifying the CRPD (Convention on the Rights of Persons with disabilities), Indonesia has witnessed developments in promoting the rights of people with disabilities. Public policies and civil organizations make their respective contributions. Muhammadiyah responded favorably by issuing a comprehensive fatwa on Islam and disability in 2020, compiled in Fikih Difabel. This paper uses an interdisciplinary approach to understand the Fikih Difabel. It explores the historical context of disability in Muhammadiyah and analyzes religious interpretations that become the paradigm and content of Fikih Difabel. Data were collected from various primary sources, such as interviews, observations, and analyses of various Muhammadiyah documents. The research concludes that Fikih Difabel is an organizational and academic effort to find a theological basis to promote disability rights. Fikih Difabel has succeeded in listening to the disabled’s aspirations, integrating the national legal norms and current academic findings, and highlighting Islamic ideals of just and inclusive religion. Fikih Difabel is Muhammadiyah’s contribution to promoting Islam as an inclusive and friendly religion for persons with disabilities

Abstract

Penelitian ini berawal dari upaya UIN Sunan Kalijaga untuk mewujudkan pendidikan tinggi inklusif. Tujuan penelitian untuk mengidentifikasi hambatan-hambatan mahasiswa difabel dalam mengikuti program KKN (Kuliah Kerja Nyata). Penelitian mengambil kasus KKN Angkatan 93 yang diselenggarakan pada Juli-Agustus 2017 dan diikuti oleh delapan mahasiswa difabel. Penelitian menggunakan pendekatan kualitatif untuk mengidentifikasi tujuh jenis hambatan inklusi yang ditemui mahasiswa selama persiapan, penerjunan, pelaksanaan, dan penyelesaian KKN. Penelitian berkesimpulan bahwa hambatan yang dialami oleh mahasiswa adalah hambatan lingkungan fisik dan hambatan komunikasi ang terutama dialami oleh mahasiswa tunadaksa dan mahasiswa Tuli. Dalam hal lain, mahasiswa difabel dapat mengikuti KKN dengan baik, terlibat secara aktif dalam kelompok dan masyarakat. Panitia KKN, teman sekelompok, dan masyarakat setempat relatif dapat menerima dan akomodatif terhadap kebutuhan mereka. This research is aimed at identifying barriers in the implementation of an inclusive service-learning program (KKN) at the State Islamic University of Sunan Kalijaga, a self-determined and pioneer of inclusive higher education in Indonesia. The case of this study is the 93rd batch KKN organized in July-August 2017, in which 8 students with disabilities were involved. This is a qualitative study to elaborate seven barriers to inclusion faced by students with disabilities during the preparation, the field-implementation, and the post implementation of the service learning program. The research found that KKN 93 was a relatively inclusive with few barriers found in seven areas. The most prominent barriers are environmental and communication barriers, faced particularly by handicapped and deaf students.

Abstract

In the past decade, Indonesia has witnessed a surge in interest in exploring the intersection of Islam and disabilities. This trend began with a seminar at UIN Sunan Kalijaga in 2011, leading to numerous research initiatives and publications, culminating in the publication of separate Fikih Difabel by three prominent Islamic institutions. However, these works often treat disabilities as exceptions, relying heavily on exceptions (rukhṣah) rather than developing comprehensive solutions that integrate people with disabilities as full and equal members of the community. This article examines the approaches and limitations of those three Fikih Difabel and proposes a more inclusive Fikih Difabel. It advocates adoption a holistic paradigm encompassing approach, definitions, methods, and accessibility, emphasizing the need to move beyond the rukhṣah. Employing a contextual discussion on ṭahārah to illustrate my proposed approach, this article aims to encourage a more practical and comprehensive framework for addressing disabilities within fiqh in Indonesia.
