Abstract

Ensuring the rights of individuals with disabilities continues to be a major challenge across various sectors in Indonesia. A key concern is safeguarding these rights within the judicial system, which is crucial for access to justice. Previous research has highlighted a range of paradigmatic, policy, and practical obstacles that often prevent individuals with disabilities from achieving fair access to the judiciary. This study investigates these challenges within the context of an Islamic court in Malang Regency, Indonesia. Through observations and interviews with court personnel and individuals with disabilities, it is evident that the Malang Regency Religious Court has made strides toward inclusivity. Efforts have been focused primarily on physical accessibility improvements, such as installing guiding blocks for the visually impaired, designating drop zones and parking spaces for disabled persons, providing ramps to access courtrooms, offering assistive devices, and issuing priority service cards. However, non-physical barriers still impede the development of a fully inclusive Islamic court. These include prevailing disability paradigms, cultural issues, and mental obstacles. [Pemenuhan hak-hak penyandang disabilitas masih menjadi tantangan besar di berbagai sektor di Indonesia. Salah satu isu krusial adalah perlindungan hak-hak tersebut dalam sistem peradilan, mengingat pentingnya akses terhadap keadilan. Penelitian-penelitian sebelumnya menunjukkan adanya berbagai hambatan paradigmatik, kebijakan, dan praktik yang kerap menghalangi penyandang disabilitas untuk memperoleh akses yang adil terhadap lembaga peradilan. Studi ini mengkaji tantangan tersebut dalam konteks pengadilan agama di Kabupaten Malang, Indonesia. Berdasarkan hasil observasi dan wawancara dengan aparatur pengadilan serta penyandang disabilitas, ditemukan bahwa Pengadilan Agama Kabupaten Malang telah melakukan sejumlah upaya menuju inklusivitas. Upaya tersebut terutama difokuskan pada peningkatan aksesibilitas fisik, seperti pemasangan guiding block bagi penyandang disabilitas netra, penyediaan drop zone dan area parkir khusus bagi penyandang disabilitas, penyediaan ramp untuk akses menuju ruang sidang, pemberian alat bantu, serta penerbitan kartu layanan prioritas. Namun demikian, hambatan nonfisik masih menghalangi terwujudnya pengadilan agama yang sepenuhnya inklusif. Hambatan tersebut meliputi paradigma disabilitas yang masih berkembang, faktor budaya, serta hambatan mental atau sikap aparatur dan lingkungan peradilan.]

Abstract

This study was inspired by a project in the United States called “accessible congregation”, a project that promotes accessibility in the places of worshsip. While idea of “accessible congregation” is not less known in Indonesia, it is important to study how accessible are Indonesian mosques. Modifying what are considered to be more relevant indicators of accessibility for mosques in Indonesia, this researh studies four main mosques in Yogyakarta. This study found that most mosques are not acceessible and one mosque are less accessible, meaning that no mosque in Yogyakarta are fully accessible.1

Abstract

The research is about the ‘struggle’ to name persons with disabilities in Indonesia. As in other countries that find naming as an important tool in the fight for equality, Indonesia witnessed various naming influenced by the way people see disability and persons with disability.  The research is aimed at understanding which naming that is more popular in terms of its usage and how a term is used. The data are gathered from the online use of three words: penyandang cacat, difabel, dan penyandang disabilitas. It seeks to see the poplarity of the words in three different levels: their trends, popular use in the online news media, and their academic use in the journals and books. The method to gather and analyze the data is mostly helped by Google search engine and its rich features. The researh concluded that there has been a dynamic use of the words across the level. ‘Difabel’ is the most popular word in trend; ‘Penyandang Disabilitas’ shared the popularity with ‘Difabel’ among news media; and surprisingly ‘Penyandang Cacat’ is still the most used term among scholars.[Penelitian ini difokuskan untuk meneliti ‘perebutan makna’ dan penggunaan berbagai istilah terkait dengan difabel. Penelitian bertujuan melihat istilah mana yang paling banyak digunakan dan bagaimana istilah-istilah itu digunakan. Penelitian dilakukan dengan mengumpulkan data-data daring (online) terkait dengan tiga istilah kunci dalam wacana disabilitas di Indonesia: penyandang cacat, difabel, dan penyandang disabilitas. Penelitian dilakukan dengan mengumpulkan data-data online dan menganalisisinya dalam tiga aspek: tren penggunaan istilah; popularitas di dunia berita daring; dan penggunaan di dunia akademik. Penelitian menunjukkan bahwa ada dinamika menarik dalam penggunaan ketiga istilah itu di ketiga wilayah pencarian. Istilah ‘difabel’, meskipun tidak diakui sebagai istilah resmi undang-undang, adalah istilah yang paling populer di tren. Sementara istilah ‘penyandang disabilitas’ mencatatkan skor popularitas yang sedikit lebih tinggi dari ‘difabel’ dalam penggunaan di media daring. Sementara istilah ‘penyandang cacat’ justru masih sangat populer dalam penggunaan akademik.]

Abstract

This article aims to answer one of the essential questions in the implementation and promotion of inclusive education in Indonesia, particularly inclusive higher education. Referring to the case of the State Islamic University (UIN) Sunan Kalijaga Yogyakarta, this research seeks to show the success of inclusive education in higher education through a career tracking (tracer study) of alumni with disabilities who graduated between 2011-2018. Data were collected through online surveys and interviews, either face-to-face or distance ones, to answer subjective and objective indicators of alumni success. This study found that students with disabilities were successfully studying at UIN Sunan Kalijaga. Their study time is relatively average (8-10 semesters). The alumni with disabilities have also succeeded in finding decent jobs matching to their diplomas and obtained satisfaction in terms of careers and income.[Artikel ini bertujuan menjawab salah satu pertanyaan penting dalam implementasi dan promosi pendidikan inklusif di Indonesia, khususnya dalam pendidikan tinggi inklusif. Dengan mengambil kasus Universitas Islam Negeri (UIN) Sunan Kalijaga Yogyakarta, penelitian ini membuktikan keberhasilan pendidikan inklusif di perguruan tinggi melalui pelacakan karier (tracer study) para alumni difabel yang telah diluluskan UIN Sunan Kalijaga sejak 2008-2018. Data dikumpulkan melalui survei daring dan wawancara, baik secara tatap muka atau jarak jauh, untuk menjawab indikator-indikator subjektif dan objektif keberhasilan dan kegagalan alumni. Penelitian menunjukkan bahwa pada saat kuliah para difabel telah berhasil menjalani proses kuliah di UIN Sunan Kalijaga dengan baik. Waktu tempuh belajar mereka relatif normal dan beberapa pengecualian dapat menyelesaikan studi dengan cepat (tujuh semester). Para alumni juga berhasil memperoleh pekerjaan yang layak, sesuai ijazah, dan mendapatkan kepuasan dalam hal karier dan penghasilan.]
