Abstract

Computer and mobile forensic is a new technique for most auditor in the Audit Board of the Republic of Indonesia (BPK). They can use this technique not only for investigative audit but also for state finance and performance audit. Investigative Audit Unit in BPK has already implemented computer and mobile forensic technique to support their assignment although need to improve in several areas. On the other hand, only a few of auditors outside Investigative Audit Unit know and implement this technique. The current issues in implementing this technique is BPK still do not make a special guidance for computer and mobile forensic. The recommendations for BPK regarding the result of the study project is organize a computer and mobile forensic training for all auditors and make a guidance of computer and mobile forensic techniques for auditor.

Abstract

Perkembangan teknologi informasi telah mengubah secara fundamental sistem pembuktian dalam peradilan Indonesia. Bukti digital kini memainkan peran penting dalam mengungkap kebenaran material, terutama pada kasus-kasus yang melibatkan aktivitas di ruang siber. Penelitian ini bertujuan untuk menganalisis dinamika penerimaan bukti digital di pengadilan Indonesia melalui studi komparatif terhadap kasus keberhasilan dan kegagalan pembuktian digital. Systematic Literature Review (SLR) yang dipadukan dengan analisis putusan pengadilan sebagai sumber data utama. Pendekatan SLR digunakan untuk mengidentifikasi, mengevaluasi, dan mensintesis berbagai literatur akademik, regulasi, serta dokumen hukum yang relevan dengan topik bukti digital dalam proses peradilan. Hasil penelitian menunjukkan bahwa keberhasilan bukti digital ditentukan oleh terpenuhinya prinsip autentisitas, integritas, dan chain of custody yang sesuai dengan standar internasional ISO/IEC 27037:2012. Sebaliknya, kegagalan terjadi akibat lemahnya prosedur akuisisi bukti, keterbatasan ahli forensik digital, serta ketidaksesuaian dengan standar pembuktian hukum acara. Penelitian ini menegaskan pentingnya peningkatan kapasitas teknis aparat penegak hukum, penguatan regulasi teknis, dan pengembangan pedoman nasional pembuktian digital untuk menjamin konsistensi serta keabsahan bukti elektronik di pengadilan Indonesia.

Abstract

The advancement of digital technology has brought significant changes to the legal system, particularly in the use of electronic evidence as a means of proof in court. However, the validity of digital forensic evidence is often questioned due to various technical, procedural, and legal challenges. This study aims to analyze the factors contributing to the failure of digital forensic evidence in legal proceedings and to formulate recommendations for improving its validity. The method used is a Systematic Literature Review (SLR) by examining various academic sources that discuss issues of digital evidence validity, forensic standards, and emerging legal challenges. The results of the study indicate that the failure of digital evidence generally stems from non-compliance in the processes of data collection and preservation with chain of custody standards, insufficient competence of law enforcement officers in digital technical aspects, and conflicts between legal requirements and data privacy regulations, such as the GDPR and CCPA. The case study of online gambling 2020, at the South Jakarta District Court confirms that the absence of forensic verification and chain of custody documentation caused the digital evidence to lose its probative value. Therefore, it is necessary to establish standardized forensic procedures, provide training and certification for law enforcement officials and forensic experts, and develop national guidelines for managing digital evidence aligned with international standards. This research is expected to contribute to strengthening the integrity and validity of digital evidence, thereby enhancing the enforcement of justice in the digital era.
